ORDER !  ӛ ThisisanappealpursuanttoRule3oftheTennesseeRulesofAppellateProcedure.ThePetitionerappliedforawritofhabeascorpusinordertotestthelegalityofhisarrestonagovernorsextraditionwarrant.Afterconductinganevidentiaryhearing,thetrialcourtdismissedthepetitionforawritofhabeascorpus.ItisfromthisdismissalthatthePetitionerappeals.Weaffirmthejudgmentofthetrialcourt. ThePetitionertestifiedatthehearinginthetrialcourtthathewasnotthesamepersonchargedintheextraditionwarrantandthathewasnotinthedemandingstateatthetimethecrimewasallegedtohavebeencommitted.Thetestimonyofalawenforcementofficerfromthedemandingstate,alongwithotherevidence,directlycontradictedthetestimonyofthePetitioner.ThetrialcourtfoundthatthePetitionerhadbeenchargedwithacrimeinthedemandingstate,Ϝthattheextraditiondocumentswereinorderontheirface,thatthePetitionerwasthesamepersonnamedintheextraditionrequestandthatthePetitionerwasafugitivefromthedemandingstate.Thecourtfurtherfoundthattherewas overwhelmingevidencethatthePetitionerwasinthedemandingstatewhentheallegedoffenseoccurred. Weconcludethattheevidencedoesnotpreponderateagainstthefindingsofthetrialcourt.Wefurtherconcludethatnoerroroflawrequiringareversalofthejudgmentisapparentontherecord.
