Duringthependencyofhispetitioninthetrialcourt,thepetitionerfiledapetitionforwritofhabeascorpusinthefederalcourt,inwhichheraisedthesameissuesheclaimedinhisstatepostconvictionpetition.Afterseveralhearingsinthedistrictcourt,thepetitionerwasultimatelydeniedreliefinDecember,1995.ThefederalappealscourtdeniedacertificateofprobablecauseinApril,1996,andtheUnitedStatesSupremeCourtdeniedthepetitionerswritofcertiorariinOctober,1996.  OnDecember11,1996,thepetitionerfiledhissecondpetitionforpostconvictionreliefinthetrialcourt.ThetrialcourtdismissedthepetitiononJanuary13,1997,statingthatthepetitionwasbarredbythestatuteoflimitationandthattheissuesraisedhadbeenpreviouslydetermined.Onappeal,thepetitioner,citingSandsv.State,903S.W.2d297(Tenn.1995),arguesthatthestrictapplicationofthestatuteoflimitationinthiscasewoulddenyhimdueprocessoflaw.Specifically,thepetitionercontendsthathecouldnothavefiledhispostconvictionpetitionanyearlierbecausetheUnitedStatesSupremeCourtdidnotruleuponhispetitionforwritofcertiorariuntilOctober1996.Accordingtothepetitioner,statelawpreventedhimfromfilingtwosuitssimultaneouslyintwodifferentcourts.  T.C.A.4030206(c),uponwhichthepetitionerreliestosupporthisclaimonappeal,providesthatthetrialjudgemaysummarilydismissapetitionifitappearsthepetitioneralreadyhaspendingapetitionin eitherthetrialcourt,courtofcriminalappeals,orsupremecourt.Contrarytothepetitionersclaim,thepostconvictionstatutedoesnotaddresspleadingsfiledinthefederalcourts.Indeed,thestatutespecificallyonlyimposeslimitsonsimultaneousstatecourtfilings.T.C.A.4030202(c) contemplatesthefilingofonlyone(1)petitionforpostconvictionrelief[and][i]nnoeventmaymorethanone(1)petitionforpostconvictionreliefbefiledattackingasinglejudgment.Moreover,T.C.A.4030202(a)(emphasisadded)mandatesthat8 apersonincustodyunderasentenceofacourtofthisstatemustpetitionforpostconvictionrelief...withinone(1)yearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealhasbeentakenor,ifnoappealistaken,withinone(1)yearofthedateonwhichthejudgmentbecamefinal.Thistimelimit,however,isnottolledbyfederalproceedings.SeeT.C.A.4030202(b)(1)(3).Infact,nothinginthelanguageofthisstatutepreventsthepetitionerfromfilingapetitioninthestatecourtwhenheorshehasafederalhabeascorpuspetitionpending.SeeT.C.A.4030201222.  Thepetitioneralreadyfiledonepetitionforpostconvictionrelief,whichwasdismissedin1991.Thepetitionerneverappealedthatdismissal.Inaddition,morethanoneyearhaspassedsincethatdismissalbythetrialcourtand,also,sincethefinalactionofthehigheststateappellatecourtregardingthepetitionersconviction.Accordingly,thepresentpetitionwasfiledoutsidethestatuteoflimitation,andthetrialcourtwasthereforewithoutjurisdictiontoconsiderthepetition.SeeT.C.A.4030202.  Havingreviewedthestatesmotioninlightofthepetitionersresponseandtheentirerecordonappeal,wefindthatthemotioniswelltakenandshouldthereforebegranted.Accordingly,forthereasonsstatedabove,itisherebyORDEREDthatthejudgmentofthetrialcourtdismissingthepetitionwithoutthenecessityofanevidentiaryhearingisaffirmed.
