ÐòòSee€State€v.€Carla€Marie€Parrishóó,€No.€01C01„9801„CR„00017,€1999€WL€173963€(Tenn.€Crim.€App.Ð <#Œ" ÐMar.€30,€1999).€€Thus,€it€would€be€an€error€for€the€trial€court€to€consider€the€defendant's€finding€ofÐ "$r# Ðdelinquency€for€carrying€a€weapon,€a€Class€C€misdemeanor.€€However,€a€defendant's€drug€use€as€anÐ %X $ Ðadult€is€evidence€of€a€history€of€criminal€behavior,€which€can€be€properly€applied€as€enhancement.€Ð î%>!% ÐòòState€v.€Alexanderóó,€957€S.W.2d€1,€7€(Tenn.€Crim.€App.€1997).€€The€pre„sentence€report€reflects€thatÐ Ô&$"& Ðthe€defendant€admitted€to€using€drugs,€such€as€marijuana,€Valium,€LSD,€Zanax€and€other€pills.€Ð º' #' ÐHowever,€the€record€is€not€clear€as€to€whether€the€defendant€was€an€adult€at€the€time€of€such€usage.€Ð  (ð#( ÐTherefore,€we€cannot€agree€with€the€trial€court€that€enhancement€factor€(1)€applied€to€the€defendant.€Ð †)Ö$) ÐÌà  àThe€defendant€argues€that€the€trial€court€was€incorrect€in€applying€enhancement€factor€(6),Ð R+¢&+ Ðthat€the€personal€injuries€inflicted€or€the€amount€of€damages€to€property€were€particularly€great,€inÐ 8,ˆ', Ðthat€this€factor€is€inherent€in€both€of€the€offenses€of€aggravated€assault€and€vandalism.€€In€supportÐ ° Ðof€his€position,€the€defendant€cites€òòState€v.€Jones,€óó883€S.W.2d€597€(Tenn.€1994)€and€òòState€v.Ð –æ ÐGrissom,€óó956€S.W.2d€514,€518€(Tenn.€Crim.€App.€1997).€The€State€argues€that€this€factor€isÐ |Ì Ðapplicable€to€these€offenses.Ð b² ÐÌà  àAs€to€the€aggravated€assault€offense,€the€indictment€alleges€that€the€defendant€didÐ . ~ Ðintentionally€or€knowingly€cause€bodily€injury€to€Brian€Potts€by€the€use€or€display€of€a€deadlyÐ  d Ðweapon.Ð ú J ÐÌà  àTennessee€Code€Annotated€ðð€39„13„102€defines€aggravated€assault€as:Ð Æ   ÐÌ€à0  à(a)€A€person€commits€aggravated€assault€who:Ð’â (#(# Ðà  àà ` à(1)€intentionally€or€knowingly€commits€an€assault€as€defined€in€ðð€39„13„101€and:Ð xÈ  Ðà  àà ` àà ¸ à(A)€Causes€serious€bodily€injury€to€another;€orÐ ^®  Ðà0  àà0` (#(#àà0¸ ` (#` (#à(B)€Uses€or€displays€a€deadly€weapon.ÐD” ¸ (#¸ (# ÐÌBodily€injury€includes€ð ða€cut,€abrasion,€bruise,€burn€or€disfigurement;€physical€pain€or€temporaryÐ ` Ðillness€or€impairment€of€the€function€of€a€bodily€member,€organ,€or€mental€faculty.ðð€€Tenn.€CodeÐ öF ÐAnn.€ðð€39„11„106(a)(2).€€In€òòState€v.€Jones,€óóour€Supreme€Court€held€that€proof€of€ò òserious€bodilyÐ Ü, Ðinjury€ó ówill€always€constitute€proof€of€particularly€great€injury.€€òòJonesóó,€883€S.W.2d€at€602.€€Thus,Ð Â Ðfactor€(6),€causing€serious€bodily€injury,€is€an€element€of€the€offense€of€aggravated€assault€andÐ ¨ø Ðcannot€be€used€to€enhance€the€defendantððs€sentence.€€Since€the€State€did€not€allege€the€element€ofÐ ŽÞ Ðserious€bodily€injury€but€the€use€of€a€deadly€weapon€for€the€offense€of€aggravated€assault,€we€findÐ tÄ Ðthat€the€facts€in€this€case€are€distinguishable€from€òòState€v.€Jones.€óó€The€victim,€Brian€Potts,€sustainedÐ Zª Ða€skull€fracture,€black€eyes,€a€swollen€cheek,€scratches€and€cuts€to€his€shoulder,€and€a€broken€ringÐ @ Ðfinger€on€his€left€hand.€€As€a€result€of€the€fracture,€the€victim€was€hospitalized€for€five€(5)€days,Ð &v Ðwhere€bone€fragments€were€removed€from€his€brain.€€The€victimððs€medical€bills€exceeded€twentyÐ  \ Ðthousand€($20,000)€dollars.€€We€find€that€enhancement€factor€(6)€is€applicable€to€the€facts€in€thisÐ òB Ðcase.Ð Ø( Ðà  àAs€to€the€damages€sustained€by€Mrs.€Slaughter€to€her€home€in€the€amount€of€three€thousandÐ ¾ Ðone€hundred€and€thirty€one€dollars€($3,131),€we€find€that€enhancement€factor€(6)€is€not€applicable.€Ð ¤ô ÐA€person€who€knowingly€causes€damage€to€or€the€destruction€of€any€real€or€personal€property€ofÐ Š Ú Ðanother,€knowing€that€he€does€not€have€the€effective€consent€of€the€owner,€is€guilty€of€vandalism.€Ð p!À  ÐTenn.€Code€Ann.€ðð€39„14„408.€€Acts€of€vandalism€are€punishable€as€theft€under€Tenn.€Code€Ann.Ð V"¦! Ððð€39„14„105.€€Thus,€the€amount€of€damage€sustained€by€Mrs.€Slaughter€is€punishable€as€€a€Class€DÐ <#Œ" Ðfelony,€with€a€range€of€two€(2)€to€four€(4)€years.€€To€enhance€the€sentence€for€vandalism€based€uponÐ "$r# Ðdamages€caused€by€the€defendant€would€constitute€double€enhancement€in€violation€of€theÐ %X $ Ðsentencing€statutes.€òò€Grissom,€óó956€S.W.2d€at€518.€Ð î%>!% ÐÌà  àThe€defendant€complains€that€the€trial€court€improperly€applied€enhancement€factor€(8),€thatÐ º' #' Ðthe€defendant€has€a€previous€history€of€unwillingness€to€comply€with€the€conditions€of€a€sentenceÐ  (ð#( Ðinvolving€release€in€the€community.€€The€defendant€maintains€that,€as€a€juvenile,€he€was€placed€onÐ †)Ö$) Ðprobation,€but€the€State€failed€to€prove€that€any€violations€of€probation€occurred.€€The€defendantÐ l*¼%* Ðâ âargues€that€a€charge€of€ð ðin„state€runawayðð€was€an€informal€adjustment€by€a€Youth€Service€officer.€Ð R+¢&+ ÐThus,€this€informal€adjustment€was€not€adjudicated,€nor€was€the€defendant€sentenced€on€the€chargeÐ ° Ðof€ð ðin„state€runaway.ðð€€The€State€disagrees.Ð –æ Ðâ âÌà  àA€defendant's€juvenile€record€may€be€considered€by€a€trial€court€in€determining€if€Ð b² Ðenhancement€factor€(8)€may€be€utilized€by€the€trial€court€in€increasing€a€sentence€from€the€minimumÐ H˜ Ðrange.€€òòSee€State€v.€Griffin,€óó914€S.W.2d€564,€568€(Tenn.€Crim.€App.€1995);€òòState€v.€Mika,€óóNo.Ð . ~ Ð02C01„9508„CR„00244,€1997€WL€76812,€at€*3€(Tenn.€Crim.€App.€Feb.€25,€1997).€€From€our€reviewÐ  d Ðof€the€record,€the€defendant€was€charged€in€1993€with€being€an€ð ðin„state€runawayðð€and€ordered€toÐ ú J Ðreport€to€a€Youth€Services€officer€for€an€informal€adjustment.€€In€May€1993,€the€defendant€missedÐ à 0 Ðschool€and€failed€to€report€to€the€Youth€Services€officer,€whereupon€the€charge€of€ð ðin„state€runawayððÐ Æ   Ðwas€reinstated€in€an€order€to€Juvenile€Court€for€a€formal€hearing.€€In€November€1995,€the€defendantÐ ¬ ü  Ðwas€placed€on€intensive€probation€with€the€Department€of€Youth€Services.€€In€December€1995,€theÐ ’â  Ðdefendant€was€placed€with€the€Department€of€Human€Services€for€intensive€psychological€treatment,Ð xÈ  Ðbecause€he€made€statements€that€he€was€out€of€control€and€might€hurt€someone.€€Upon€theÐ ^®  Ðdefendantððs€release€from€the€Department€of€Human€Services,€he€was€placed€back€on€intensiveÐ D”  Ðjuvenile€probation.€€In€the€health€comments€of€the€pre„sentence€report€in€1997,€we€note€that€theÐ *z  Ðdefendant€was€sent€to€Pine€Point€Treatment€Center€in€Jackson,€Tennessee,€for€using€marijuanaÐ ` Ðduring€his€juvenile€probation.€€Other€than€this€one€episode,€we€find€no€violations€of€conditions€ofÐ öF Ðrelease€from€prior€sentences€imposed€on€the€defendant.€€We€are€of€the€opinion€that€a€formal€chargeÐ Ü, Ðand€an€informal€adjustment€of€ð ðin„state€runawayðð€are€not€sentences€within€the€meaning€ofÐ Â Ðenhancement€factor€(8).€€Also,€we€believe€that€the€removal€of€the€defendant€for€psychologicalÐ ¨ø Ðtreatment€during€intensive€probation€does€not€fall€within€the€determination€of€an€unwillingness€toÐ ŽÞ Ðcomply€with€the€conditions€of€release.€€We€find€that€the€trial€court€was€in€error€in€applying€thisÐ tÄ Ðenhancement€factor.€Ð Zª ÐÌà  àThe€defendant€asserts€that€the€trial€court€erred€in€applying€enhancement€factor€(9),€that€theÐ &v Ðdefendant€possessed€or€employed€a€firearm,€explosive€device,€or€other€deadly€weapon€during€theÐ  \ Ðcommission€of€the€offense.€€The€State€concedes€that€the€defendant€did€not€possess€a€deadly€weaponÐ òB Ðat€the€commission€of€the€vandalism€and€that€the€application€of€this€enhancement€factor€wasÐ Ø( Ðimproperly€considered€by€the€trial€court.€€Also,€the€State€contends€the€application€of€the€use€of€aÐ ¾ Ðdeadly€weapon,€enhancement€factor€(9),€is€questionable€as€to€the€offence€of€aggravated€assault.€€WeÐ ¤ô Ðdo€not€find€this€application€questionable.€Ð Š Ú ÐÌà  àThe€indictment€charged€the€defendant€with€ð ðbodily€injury€to€Brian€Potts€by€the€use€or€displayÐ V"¦! Ðof€a€deadly€weapon,€to€wit:€a€pool€ball€in€a€sock.ðð€€A€deadly€weapon€means€ð ð[a]nything€that€in€theÐ <#Œ" Ðmanner€of€its€use€or€intended€use€is€capable€of€causing€death€or€serious€bodily€injury.ðð€€Tenn.€CodeÐ "$r# ÐAnn.€ðð€39„11„106(a)(5)(B).€€This€Court€agrees€that€this€enhancement€factor€(9)€is€not€applicable,Ð %X $ Ðbecause€the€use€of€the€pool€ball,€used€as€a€deadly€weapon,€was€an€element€of€the€offense€ofÐ î%>!% Ðaggravated€assault.€òò€State€v.€Baker,€óó956€S.W.2d€8,€17€(Tenn.€Crim.€App.),€òòperm.€app.€denied,€óó(Tenn.Ð Ô&$"& Ð1997);€òòState€v.€Sims,€óó909€S.W.2d€46,€50€(Tenn.€Crim.€App.),€òòperm.€app.€deniedóó,€(Tenn.€1995).€€TheÐ º' #' Ðtrial€court€erred€in€applying€enhancement€factor€(9).Ð  (ð#( ÐÌà  àAs€to€enhancement€factor€(10),€the€defendant€asserts€that€the€trial€court€erred€in€applying€thisÐ l*¼%* Ðfactor€to€the€offenses€of€aggravated€assault€and€vandalism.€€The€State€concedes€that€enhancementÐ R+¢&+ Ðfactor€(10),€that€the€defendant€had€no€hesitation€about€committing€a€crime€when€the€risk€to€humanÐ 8,ˆ', Ðlife€was€high,€is€not€applicable€to€the€offense€of€aggravated€assault€but€was€properly€applied€to€theÐ ° Ðoffense€of€vandalism.€Ð –æ ÐÌà  à€We€agree€with€the€State€that€the€high€risk€to€human€life€is€not€inherent€in€all€vandalismÐ b² Ðoffenses.€€The€actions€of€the€defendant€in€this€case€certainly€had€the€potential€for€a€high€risk€of€lifeÐ H˜ Ðor€serious€bodily€injury€on€the€part€of€the€victim,€Mrs.€Slaughter.€€The€application€of€enhancementÐ . ~ Ðfactor€(10),€in€this€case,€is€a€close€question.€€However,€we€believe€that€under€the€proof€in€this€record,Ð  d Ðthe€trial€court€properly€applied€enhancement€factor€(10).€€The€pre„sentence€report€sets€forth€theÐ ú J Ðdefendantððs€encounter€with€Mrs.€Linda€Slaughter.€€The€defendant€broke€in€the€back€door,€ran€throughÐ à 0 Ðthe€house€while€Mrs.€Slaughter€was€sitting€on€the€couch,€and€then€ran€to€the€front€door.€€TheÐ Æ   Ðdefendant€turned€around€and€ran€out€the€back€door.€€Mrs.€Slaughter€called€911,€€obtained€a€pistol,Ð ¬ ü  Ðand€while€the€defendant€was€breaking€in€the€front€door,€she€shot€the€defendant€in€the€thigh.€Ð ’â  ÐNotwithstanding€his€gunshot€wound,€the€defendant€was€so€out€of€control,€that€the€arresting€deputiesÐ xÈ  Ðhad€to€shackle€him.€€Apparently,€the€defendant€was€under€the€influence€of€LSD.€€If€Mrs.€SlaughterÐ ^®  Ðhad€not€shot€the€defendant€before€he€gained€entrance,€she€would€have€been€confronted€by€a€drugÐ D”  Ðcrazed€individual€who€was€very€capable€of€inflicting€physical€harm.€€We€find€no€error€in€the€trialÐ *z  Ðcourt's€application€of€enhancement€factor€(10)€in€this€case€of€vandalism.Ð ` ÐÌà  àAs€to€the€aggravated€assault€offense,€we€find€that€the€trial€court€improperly€appliedÐ Ü, Ðenhancement€factor€(10),€because€there€was€no€proof€of€a€risk€to€the€life€of€a€person€other€than€to€theÐ Â Ðvictim.€€The€risk€involved€here€was€an€essential€element€of€the€offense€of€aggravated€assault.€€òòSeeóóÐ ¨ø ÐòòState€v.€Nix,€óó922€S.W.2d€894,€903€(Tenn.€Crim.€App.),€òòperm.€app.€denied,€óó(Tenn.€1996).€Ð ŽÞ ÐÌà  àThe€defendant€asserts€that€the€trial€court€improperly€applied€enhancement€factor€(13)€to€theÐ Zª Ðoffense€of€aggravated€assault€but€concedes€it€was€properly€applied€to€the€vandalism€offense.€€ThisÐ @ Ðfactor€states€that€the€felony€was€committed€while€the€defendant€was€released€on€bail€and€was€Ð &v Ðultimately€convicted€of€such€prior€felony.€€The€State€argues€that€enhancement€factor€(13)€wasÐ  \ Ðproperly€applied€to€the€offense€of€vandalism,€but€there€is€nothing€in€the€record€to€show€that€thisÐ òB Ðfactor€was€applied€to€the€offense€of€aggravated€assault.€Ð Ø( ÐÌà  àWe€agree€with€the€State€that€the€record€is€not€clear€as€to€whether€the€trial€court€appliedÐ ¤ô Ðenhancement€factor€(13)€to€the€offense€of€aggravated€assault.€€However,€the€trial€court€did€find€thatÐ Š Ú Ðthe€defendant€was€on€bail€when€he€committed€the€vandalism€offense.€€We€find€that€the€trial€courtÐ p!À  Ðproperly€assigned€enhancement€factor€(13)€to€the€defendant,€since€he€was€ultimately€convicted€ofÐ V"¦! Ðaggravated€assault€for€the€offense€of€vandalism.€€Ð <#Œ" ÐÌà  àThe€defendant€contends€that€the€trial€court€erred€in€failing€to€find€any€mitigating€factors€inÐ %X $ Ðconsidering€an€appropriate€sentence€for€both€offenses.€€The€State€argues€that€the€record€supports€theÐ î%>!% Ðtrial€courtððs€findings.€Ð Ô&$"& ÐÌà  àThe€defendant€would€argue€that€because€of€his€youth,€he€lacked€substantial€judgment€inÐ  (ð#( Ðcommitting€these€offenses.€€Tenn.€Code€Ann.€ðð€40„35„113(6).€€This€factor€is€supported€by€the€factÐ †)Ö$) Ðthat€the€defendant€was€institutionalized€for€his€mental€behavior,€and€he€was€only€18€years€old€at€theÐ l*¼%* Ðtime€of€the€commission€of€these€offenses.€Ð R+¢&+ ÐÐ 8,ˆ', Ðà  àIn€determining€the€applicability€of€this€mitigating€factor€(6),€trial€courts€should€consider€theÐ ° Ðdefendantððs€age,€education,€maturity,€experience,€mental€capacity€or€development,€and€any€otherÐ –æ Ðpertinent€circumstance€tending€to€demonstrate€the€defendantððs€ability€or€inability€to€appreciate€theÐ |Ì Ðnature€of€his€conduct.€òò€State€v.€Carter,€óó908€S.W.2d€410,€413€(Tenn.€Crim.€App.),€òòperm.€app.€denied,Ð b² Ðóó(Tenn.€1995)(citing€òòState€v.€Adams,€óó864€S.W.2d€31,€33€(Tenn.€Crim.€App.€1993)).€€At€the€time€ofÐ H˜ Ðthe€offenses,€the€defendant€was€18€years€old,€had€obtained€a€GED,€and€had€an€excellent€work€record.€Ð . ~ ÐHowever,€the€defendant€used€drugs€and€was€obviously€on€drugs€at€the€time€of€the€commission€of€theÐ  d Ðvandalism€offense.€€As€a€juvenile,€the€defendant€was€treated€for€psychological€problems€dealing€withÐ ú J Ðviolent€tendencies.€€We€believe€that€mitigating€factor€(6)€was€applicable€to€the€offense€of€vandalismÐ à 0 Ðand€that€the€trial€court€was€in€error€for€failure€to€apply€this€factor€to€the€offense€of€vandalism.€Ð Æ   ÐHowever,€we€do€not€find€that€the€trial€court€erred€in€failing€to€apply€factor€(6)€to€the€aggravatedÐ ¬ ü  Ðassault€offense.€€Based€upon€the€facts€of€the€aggravated€assault,€there€is€nothing€to€indicate€that€theÐ ’â  Ðdefendantððs€age,€maturity,€experience,€mental€capacity€or€development€caused€an€inability€toÐ xÈ  Ðappreciate€the€nature€of€his€assault€on€Brian€Potts.€Ð ^®  ÐÌà  àThe€defendant€contends€that€the€trial€court€failed€to€consider€other€mitigating€factors,€suchÐ *z  Ðas€his€remorse,€outstanding€employment€record,€and€exemplary€behavior€while€in€custody€for€eightÐ ` Ð(8)€months,€pursuant€to€ðð€40„35„113(13).€€The€State€points€out€that€the€trial€court€did€not€have€theÐ öF Ðopportunity€to€evaluate€the€defendantððs€sincerity€as€to€remorse,€since€the€defendant€did€not€testify.€Ð Ü, ÐWe€agree.€€The€only€evidence€of€remorsefulness€in€this€record€is€the€defendantððs€pre„sentence€reportÐ Â Ðstatement€and€his€grandmotherððs€testimony.€€We€cannot€find€that€the€trial€court€was€in€error€forÐ ¨ø Ðfailing€to€apply€any€remorse€as€a€mitigating€factor.€€However,€we€believe€that€the€defendant€hasÐ ŽÞ Ðestablished€that€he€has€a€good€work€record,€as€reflected€in€the€pre„sentence€report€by€a€letter€fromÐ tÄ Ða€Nissan€dealer€who€is€willing€to€re„hire€the€defendant.€€Also,€we€believe€that€the€defendantððs€periodÐ Zª Ðof€incarceration€should€be€considered€in€assessing€an€appropriate€sentence.€€Here,€the€record€reflectsÐ @ Ðthat€during€his€eight€(8)€month€confinement,€the€defendant€has€been€a€model€inmate.€€We€find€thisÐ &v Ðto€be€a€mitigating€factor€pursuant€to€ðð€40„35„113(13).€Ð  \ ÐÌà  àòòóóSince€we€have€determined€that€the€trial€court€misapplied€certain€enhancement€factors,€weÐ Ø( Ðconduct€our€review€without€a€presumption€of€correctness€pursuant€to€ðð€40„35„401(d).€€In€determiningÐ ¾ Ðan€appropriate€sentence,€the€trial€court€must€start€at€the€minimum€sentence€in€the€range,€enhance€theÐ ¤ô Ðsentence€within€the€range€as€appropriate€for€the€enhancement€factors,€and€then€reduce€the€sentenceÐ Š Ú Ðwithin€the€range€as€appropriate€for€the€mitigating€factors.€€Tenn.€Code€Ann.€ðð€40„35„210(e).€€In€ourÐ p!À  Ðòòde€novo€óóreview€of€the€record,€we€find€that€the€record€supports€the€application€of€enhancement€factorsÐ V"¦!
