In1976,whenhewasseventeenyearsandsevenmonthsold,thepetitionermurderedElmerTrentinthecourseofrobbinghimwithafirearm.Hewasnotindicteduntil1978;hepledguiltytothemurder afewweeksshyofhis19thbirthday. 2   ׀Atthetimehepledguilty,thepetitionerapparentlythoughtthathehadbeenovertheageofeighteenatthetimehemurderedTrent.Hedidnotdiscoverhisrealageuntil1986.HesubsequentlyfiledforpostconvictionreliefallegingthatthecriminalcourtinwhichhepledguiltyhadnothadsubjectmatterjurisdictionoverhimbecausehehadbeenajuvenileatthetimehecommittedTrentsmurder.  WhenthepetitionersclaimforreliefreachedourSupremeCourt,itorderedthecase returnedtothetrialcourtforadenovohearingtodeterminewhetherornot[thepetitioner]wouldhavebeentransferredfromjuveniletocriminalcourt,basedonthefactsexistingatthetimeofhisindictmentandtrial.Sawyersv.State,814S.W.2d725,729(Tenn.1991).Thishearingwasheldin1996andthecourtbelowfoundthatthepetitionerwouldhavebeentransferredandthereforedeniedpostconvictionreliefasecondtime.Itisfromthisrulingthatthepetitionernowappeals.  Inorderingthismatterremanded,ourSupremeCourtspecificallyreferredtoT.C.A.371134(a)andstatedthatanorderoftransferfromjuveniletocriminalcourt mustbepredicatedonadetermination...thattherearereasonablegroundstobelievethatthechild(a)committedthedelinquentactalleged,(b)isnotcommittabletoaninstitutionforthementallyillorretarded,and(c)needstobeplacedunderlegalrestraintordisciplineforthegoodofthecommunity. 3   ׀Sawyers,814S.W.2dat728.Inmakingthisdeterminationaftertherequiredhearing,thecourtbelowruled: 8 Itseemsobviousbeyondperadventurethatthejuvenilecourt,ifproceedingsinthatcourthadbeeninstituted,wouldhavedeterminedthattherewas[sic]reasonablegroundstobelievethatSawyerscommittedthemurderalleged,wasnotcommittabletoaninstitutionforthementallyillorretarded,andneededtobeplacedunderlegalrestraintordisciplineforthegoodofthecommunity.Thisbeingso,itwouldhavebeenthedutyofthejuvenilecourttotransferSawyerstothecriminalcourt.Thusitis,forthesecondtime,thatitshouldbeheldthatcommonsense,superimposeduponthesimplestdefinitionsofjusticeandstatutoryconstruction,dictatesthatSawyerswasproperlytriedasanadult.Thetransferwasunassailablyappropriate,andthepetitionisdismissed. 4   Inmakingitsfindings,thecourtbelowreliedona1978reportfromtheForensicServicesDivisionofMiddleTennesseeMentalHealthInstitutethatthepetitionerwascompetenttostandtrialandthatadefenseofinsanitycouldnotbesupported,andthatthepetitionerhadcommitteda comparablemurderinanothercountyafterhehadreachedtheageofmajoritybutbeforehehadbeenarrestedfortheinstantmurder.ThecourtalsohadbeforeitastatementthepetitionerhadgiventothepoliceinwhichheadmittedtohavingshotandkilledTrentinthecourseofrobbinghim.  Thepetitionercomplainsthatthecourtbelowshouldnothaveconsideredthathehadcommittedanothermurderbecausehehadnotbeenconvictedofthatoffenseatthetimethetransferdecisionwouldhavebeenmade.Weagree,butfindthatthecourtbelowcouldproperlyhaveconsideredthatthepetitionerhadbeenindictedforthissecondmurderattherelevanttime. 5   כWealsonotethatthepetitionerhadbeenconvictedoftwocountsoflarcenyfromthepersonin1977,receivingathreeyearsentenceforeachcount.Thisinformationwouldalsohavebeenavailabletothecourtin1978atthetimeofthetransferhearing.  AlthoughnotmentionedbyourSupremeCourt,wenotethattherelevantstatuteineffectin1978providedthat,inmakingthedeterminationtotransfer,thecourtcould 6   ׀considertheextentandnatureofthechildspriordelinquencyrecords;thenatureofpasttreatmenteffortsandthechildsresponsethereto;whethertheoffensehadbeenagainstpropertyorpersonwithgreaterweightinfavoroftransfergiventooffensesagainsttheperson;whethertheoffensehadbeencommittedinanaggressiveandpremeditatedmanner;andthepossiblerehabilitationofthechildbyuseofprocedures,servicesandfacilitiescurrentlyavailable.T.C.A.37234(b)(1976).Intheinstantcase,thepetitionerspriordelinquencyrecordconsistedofa1973orderbytheHamblenCountyjuvenilecourtfindinghimtobea dependentandneglectedchildandorderinghim committedtotheTennesseePreparatorySchoolforanindefiniteperiodoftime.Thispasttreatmenteffortwasobviouslyunsuccessful,giventhenumerouscrimesthepetitionerhadcommittedorbeenchargedwithbythetimehewasarrestedforTrentsmurder.Theoffenseunderconsiderationwasamurder:themostseriousoftheoffensesagainstthepersonandthereforeentitledtosubstantialweightinfavoroftransfer.    Moreover,ithadbeencommittedinanaggressiveandatleastsomewhatpremeditatedmanner.Accordingtothepetitionersstatementtothepolice,heandtwocohortshaddriventoamarketwithashotgunwhichthepetitionerloadedwithfourshells,chamberingoneofthem.Whenthevictimdroveupandwalkedtowardthedoorofhismarket,thepetitionercalledouttohim andtoldhimtostickuphishandsanddropthosemoneybags.Asthevictimstoppedandbegantoturnaround,accordingtothestatement,thepetitionerthoughthewasreachingforhisfrontpocket.Atthatpoint,thepetitioner pulledthetriggerandblastedhimfourtimes.Thus,atleastthreeofthefivestatutoryconsiderationsmitigatedheavilyinfavoroftransfer.Thereisnoproofintherecordastothepossiblerehabilitationofthepetitionerbyservicesandfacilitieswhichwouldhavebeenavailablein1978.However,becausethepetitionerwasnolongerachildin1978,wefindthisfactortobeinapposite.
