Theappellantcontendsthatthetrialcourterredinnotgrantingherposttrialdiversion.Shearguesthatthetrialcourterroneouslyconsideredthefactthatshehadexpungedtwooutofstateconvictionsfromherrecordbysuccessfullycompletingdiversionprogramsonbothcharges.Wedisagree. Indeterminingwhetheradefendantisqualifiedforjudicialdiversionthetrialcourtshouldconsider:(1)theaccused'samenabilitytocorrection,(2)thecircumstancesoftheoffense,(3)theaccused'scriminalrecord,(4)theaccusedssocialhistory,(5)theaccused'sphysicalandmentalhealth,and(5)thedeterrencevaluetotheaccusedaswellasothers.Statev.Bonestel,871S.W.2d163,168(Tenn.Crim.App.1993);Statev.Hammersley,650S.W.2d352,355(Tenn.1983).Thetrialcourt'sjudgmentwillnotbedisturbedabsentashowingofabuseofdiscretion.Inordertoestablishanabuseofdiscretion,thisCourtmustdeterminethatnosubstantialevidenceexiststosupportthetrialcourt'sfindings.Statev.Anderson,857S.W.2d571,572(Tenn.Crim.App.1992).  TheTennesseeSentencingReformActof1989mandatesthattrialcourtsconsiderthepastcriminalbehaviorofdefendantswhenmakingsentencingdeterminations.Tenn.CodeAnn.4035210(1990).Intheinstantcase,thetrialcourtwascorrectinitsconsiderationoftheappellant'stwopastdiversionexperiences.Thisinformationisveryindicativeofthelackofdeterrencediversionhasontheappellantandtoherlackofamenabilitytocorrection.Furthermore,duringherburglaryattempt,theappellantseverelybeatthevictimwithanaxhandle.Thesefactorssupportthetrialcourt'sdecision.Diversionwasinappropriatefortheappellant.Thisissueiswithoutmerit.  Inhernextissuetheappellantcontendsthatthetrialcourterroneouslyimposedfiveyearsprobationonherthreeyearsuspendedsentence.Shearguesthatthelengthofprobationcannotlegallyexceedthetermofhersentence.Wedisagree. Itiswellsettledthatatrialcourtmayfixthelengthofprobationuptothestatutorymaximumfortheclassoftheoffense.Tenn.CodeAnn.4035303(1990)SentencingCommissionComments.SeeStatev.BrianNecessary,No.02C019307CR00131(Tenn.Crim.App.,atJackson,Aug.10,1994).Thesentencingcommissionintendedtogivetrialcourtsgreatlatitudeinfixingthelengthofprobationtoencourageitsuseasasentencingalternative.Intheinstantcase,theappellantwasconvictedofaClassCfelonyasaRangeIstandardoffender.Therefore,thesentencerangeisthreetosixyears.Theappellantreceivedfiveyearsonprobation.Hersentenceis,therefore,appropriate.Thisissueiswithoutmerit.
