OnSeptember15,1993,theDefendantenteredapleaofguiltytotheoffenseoftheftofpropertyoverthevalueofonethousanddollars.HistwoyearsentenceintheDepartmentofCorrectionwassuspendedandhewasplacedonprobation.AprobationviolationwarrantwasissuedagainsttheDefendantonFebruary28,1994.AhearingontheprobationviolationwarrantwasconductedonMarch14,1995.ThetrialcourtrevokedtheDefendantsprobationandorderedhimtoservehistwoyearsentenceintheDepartmentofCorrection.ItisfromthisorderthattheDefendantappeals. ThiscasewassubmittedtothiscourtfordecisiononJune4,1996.ThesoleissueraisedinthisappealiswhetherthetrialcourterredinrevokingtheDefendantsprobationandorderinghimtoservehistwoyearsentenceintheTennesseeDepartmentofCorrection.ItcametotheattentionofthiscourtthattheDefendantwasparoledonApril8,1996.Suggestingthattheissueraisedinthisappealwasmoot,thiscourtenteredanorderonJune6,1996advisingtheDefendantthatthisappealwouldbedismissedunlesstheDefendantfiledanaffidavitwithinfourteendaysshowingwhythiscourtshouldconsidertheappealonthemerits.AnaffidavitwasfiledbytheDefendantsattorneyinwhichhestatedthattheDefendantdidnotrespondtotheattorneysattemptstocontacthim. Thedoctrineofjusticiabilitypromptscourtstostaytheirhandincasesthatdonotinvolveagenuineandexistingcontroversyrequiringthepresentadjudicationofpresentrights.McIntyrev.Traughber,884S.W.2d134,137(Tenn.Ct.App.1994).Theconceptofmootnessdealswiththecircumstancesthatrenderacasenolongerjusticiable.Id.Amootcaseisonethathaslostitscharacterasapresent,livecontroversy.Acasewillgenerallybeconsideredmootifitnolongerservesasameanstoproviderelieftotheprevailingparty.Id.Thetwomostrecognizedexceptionstothemootnessruleincludeissuesofgreatpublicinterestandimportancetotheadministrationofjusticeandissuescapableofrepetitionyetevadingreview.Id.Whethertotakeupcasesthatfitintooneoftherecognizedexceptionstothemootnessdoctrineisdiscretionarywiththeappellatecourts.Id. Inthecasesubjudice,itisobviousthatthiscourtcannotprovideanymeaningfulrelieftotheDefendantevenifwedeterminethatthetrialcourterredbyrevokingtheDefendantsprobation.AreversalofthetrialcourtsorderrevokingtheDefendantsprobationwouldserveonlytounnecessarilyconfuseandcomplicatetheDefendantsstatus.Wedeclinetoconsiderthisappealonthemerits.
