Theappellantappealsthedenialofhispetitionforpostconvictionrelief.Hecontendsthathewasdeniedeffectiveassistanceofcounseldueto:` X/ X8 (1) counselsfailuretotimelyfileamotionofnewtrial;8 (2) counselspresentationofonlyonewitness,whichwas ineffective;8 (3) counselsfailuretoobjecttoatapeofthevictimstestimonyat thepreliminaryhearing;8 (4) counselsfailuretoobjecttotheuseofasuggestive identification;8 (5) counselsfailuretofileamotiontosuppressaconfession;8 (6) counselsfailuretoproperlypreparefortrial;and8 (7) counselsfailuretofileanappellatebrief.Weaffirmthetrialcourtsdismissalofthepetition. Inpostconvictionproceedings,thepetitionerhastheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Thefindingsofthetrialcourtinpostconvictionhearingsareconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Butlerv.State,789S.W.2d898,899900(Tenn.1990).Furthermore,thisCourtmaynotreweighorreevaluatetheevidence,norsubstituteitsinferencesforthosedrawnbythetrialjudge.Blackv.State,794S.W.2d752,755(Tenn.Crim.App.1990). X  IndeterminingwhethertheappellantreceivedeffectiveassistanceofcounselasguaranteedbytheSixthAmendmentoftheUnitedStatesConstitutionandArticle1Section9oftheTennesseeConstitution,thisCourtmustdeterminewhethertheperformanceoftrialcounselwaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Toreverseaconvictiononthesegrounds,theappellantmustshowthatcounselsrepresentationwasdeficientandthattherewasprejudiceresultingfromthatdeficiency.Stricklandv.Washington,466U.S.668,686,104S.Ct.2052,2064(1984). Afterahearing,thetrialjudgefoundtheappellantscounseltobeineffective.Thestatedoesnotopposethiscontention.Therefore,thisCourtwillpresumethattheappellantscounselwasineffective.ThefirstprongofStricklandhasbeensatisfied. ThesecondprongofStricklandrequirestheappellanttoshowthathiscounselsdeficientrepresentationwasprejudicial.Deficientrepresentationbecomesprejudicialwhentheappellantisdeprivedofafairtrialwithareliableresult.Coxv.State,880S.W.2d713,717(Tenn.Crim.App.1994).IfthisCourtfindsthattheappellantsufferednoprejudice,anydeficiencyinhistrialcounselisconsideredharmless.Strickland,466U.S.at693.Therefore,eveniftheappellantscounselwasineffective,hemustshowthat thereisareasonableprobabilitythat,butforcounselsunprofessionalerrors,theresultoftheproceedingwouldhavebeendifferent.Id.at693. Theappellanthasnotcarriedtheburdenofprovingthattheresultsofhistrialwouldhavebeendifferenthadhereceivedmoreeffectiverepresentation.Thestatehadasubstantialcaseagainsttheappellant.Afteradvisementofrights,theappellantconfessedtocommittingthecrimeandwasarrestedwhileinpossessionofthestolenproperty.Thepostconvictionjudgestated, Idontseeadefensetothiscase. Weagreewiththecourt'sassessment.Regardlessoftheappellantstrialrepresentation,theevidencesupportshisconvictionbeyondareasonabledoubt.Anyerrorbycounselwouldnothavedeprivedtheappellantofafairadjudicationofthecase.
