àOn€September€16,€1987,€a€Lincoln€County€jury€convicted€the€petitioner,€Alvin€L.ÏSmith€of€aggravated€rape,€aggravated€kidnapping,€armed€robbery€with€a€deadly€weapon,Ïand€perpetration€of€a€crime€against€nature.€€This€Court€affirmed€the€petitionerððs€convictionÏand€modified€his€sentence€on€August€22,€1989.€€The€Tennessee€Supreme€Court€deniedÏpermission€to€appeal€on€November€6,€1989.€€The€petitioner€filed€a€petition€for€post„¼conviction€relief€on€March€9,€1998.€€On€June€23,€1998,€the€trial€court€dismissed€the€petitionÏfor€failure€to€file€within€the€statute€of€limitations.€€The€petitioner€appeals€this€decision,Ïclaiming€the€statue€of€limitations€was€tolled€because€he€was€not€legally€competent€for€anyÏmeaningful€period€from€November€6,€1989€to€March€9,€1998.€€Based€on€our€review€of€thisÏmatter,€we€affirm€the€decision€of€the€trial€court.ÌÌà ÐÌà ` àHere,€the€petitioner€claims€that€to€require€him€to€prove€a€continuous€state€ofÏincompetency€from€1989€to€the€filing€of€the€petition€in€1998,€or€to€require€him€to€proveÏð ðeach€and€every€period€of€competence€and€incompetence€between€1989€and€1998,"€wouldÏdeprive€him€of€a€reasonable€opportunity€to€litigate€his€post„conviction€claim.€€However,€itÏis€the€petitionerððs€burden€to€show€the€statue€of€limitations€has€not€expired.€€For€this€reason,Ð Ð8 4: Ðthe€trial€court€did€not€err€by€requiring€that€the€petitioner€provide€evidence€of€hisÏincompetence€from€1989€to€the€filing€of€the€petition.ÌÌà ` àIf€the€petitioner€was€competent€for€a€total€of€three€years€from€November€6,€1989€toÏMay€9,€1995,€the€three„year€statue€of€limitations€of€the€1989€Act€expired;€and€the€petitionÏwas€not€timely€filed.€€If€he€was€not€competent€for€a€total€of€three€years€prior€to€May€10,Ï1995,€the€subsequent€one„year€statute€of€limitations€then€applied.€€If€that€new€one„yearÏstatute€of€limitations€applied€and€the€petitioner€was€competent€for€a€total€of€one€yearÏbetween€May€10,€1995€and€the€filing€of€the€petition€on€March€9,€1998,€the€petition€was€notÏtimely€filed.€€The€petitioner€succeeds€in€his€claim€that€the€statue€of€limitations€did€not€expireÏonly€if€he€was€not€competent€for€a€total€of€three€years€from€November€6,€1989€to€May€9,Ï1995€òòandóó€he€was€not€competent€for€a€total€of€one€year€from€May€10,€1995€to€March€9,Ð tÄ Ð1998.€€The€trial€court€found€this€not€to€be€the€case.€€For€this€Court€to€reverse€the€decisionÏof€the€trial€court,€the€petitioner€must€now€show€the€evidence€presented€at€the€hearingÏpreponderates€against€this€finding.ÌÌà ` àTwo€witnesses€testified€at€the€hearing.€€Dr.€Jan€Allen€Mayer€testified€for€theÏpetitioner.€€Dr.€Mayer€was€his€treating€psychiatrist€at€the€DeBerry€Special€Needs€Facility.€ÏDr.€Mayer€stated€the€petitioner€was€admitted€to€the€facility€in€1989€because€of€ð ðsomeÏidentified€psychiatric€problem.ðð€€Admission€to€DeBerry€for€a€psychiatric€problem,€however,Ïdid€not€necessarily€mean€the€petitioner€was€incompetent.€€Dr.€Mayer€stated€he€couldÏaddress€the€petitionerððs€competency€only€for€the€period€that€the€petitioner€was€his€patient.€ÏThis€period€was€approximately€one€year€before€the€filing€of€the€petition€on€March€9,€1998.€ÏDuring€this€year,€the€petitioner€was€competent€only€for€eight€to€twelve€weeks€prior€to€theÏhearing.€€From€1992€to€the€time€Dr.€Mayer€began€treating€the€petitioner,€no€competencyÏevaluation€was€conducted.€€Dr.€Mayer€stated€there€was€no€way€to€determine€competencyÏin€the€past€from€reviewing€the€petitionerððs€medical€records.€€Dr.€Mayer€could€not€say€theÏpetitioner€was€incompetent€from€1992€until€he€began€treating€him.€€Dr.€Mayer€testified€thatÏhe€could€not€say€with€certainty€why€the€petitioner€was€admitted€to€the€DeBerry€facility€inÏ1989,€but€that€it€would€have€been€for€some€ð ðidentified€psychiatric€problem€because€thatÐ Ð8 4: Ðwas€the€purpose€for€the€facility.ðð€€However,€he€also€stated€that€a€person€could€have€aÏpsychiatric€problem€and€still€be€competent.ÌÌà ` àThe€petitioner€testified€he€was€in€the€general€prison€population€for€one€and€one„halfÏto€three€years€during€the€first€three€to€four€years€of€his€incarceration.€€He€was€housed€atÏDeBerry€at€all€other€times.€€He€first€began€thinking€of€filing€a€petition€around€1991€or€1992.€ÏHe€read€legal€books€and€talked€to€other€prisoners.€€He€spoke€to€his€doctors€and€his€familyÏabout€filing€a€petition,€but€he€said€they€told€him€he€could€not€file€a€petition€until€he€wasÏcompetent.€€He€has€been€on€and€off€medication€throughout€his€stay€at€DeBerry.€€At€theÏtime€of€the€hearing€he€was€taking€lithium,€tranquilizers,€and€anti„depressants.ÌÌà ` àThe€trial€court€found€that€although€the€petitionerððs€incarceration€in€DeBerry€ð ðraisedÏsuspicions€in€the€courtððs€mindðð€regarding€his€competency,€admission€to€DeBerry€did€not€inÏand€of€itself€prove€he€was€incompetent.€€After€considering€all€testimony€presented,€theÏcourt€found€that€the€petition€was€not€timely€filed€because€the€petitioner€did€not€meet€hisÏburden€of€showing€the€statute€of€limitations€was€tolled€due€to€incompetence.€€We€cannotÏsay€the€evidence€preponderates€against€this€finding,€therefore,€we€must€affirm€the€decisionÏof€the€trial€court.ÌÌÓÓÔ‡ X*ÁXXX*ÁÔà ` àà ¸ àà  àà h àà À àà  à________________________________________Ð Ô&$"& Ðà ` àà ¸ àà  àà h àà À àà  àALAN€E.€€GLENN,€JUDGEÌÌÌCONCUR:ÌÌÌÌÌ____________________________________ÌJOSEPH€M.€TIPTON,€JUDGEÌÌÌÌÌ____________________________________ÌJOE€G.€RILEY,€JUDGEÌà ` àÔ#†X*ÁXX X*Á×1#Ô
