àOPINIONóóÌThis€is€the€appellantððs€second€appeal€as€of€right€to€this€Court€following€hisÏconvictions€in€the€Davidson€County€Criminal€Court€for€three€(3)€counts€of€aggravatedÏrobbery,€one€(1)€count€of€aggravated€assault,€and€two€(2)€counts€of€attempted€secondÏdegree€murder.€€In€his€original€appeal,€the€appellant€challenged€the€sufficiency€of€theÏevidence€to€support€his€convictions,€the€length€of€his€sentences,€and€the€consecutiveÏnature€of€the€sentencing€ordered€by€the€trial€court.€€In€that€appeal,€this€CourtÏsustained€the€convictions€and€the€length€of€the€sentences€ordered€by€the€trial€court.€ÏHowever,€a€majority€of€the€panel€hearing€appellantððs€first€appeal€was€of€the€opinionÏthat€the€trial€court€failed€to€place€upon€the€record€sufficient€facts€and€reasons€forÏordering€consecutive€sentencing.€€Accordingly,€the€matter€was€remanded€to€the€trialÍcourt€for€a€new€sentencing€hearing€limited€in€scope€to€the€issue€of€consecutiveÏsentencing.€€œÌFollowing›€remand,€the€trial€court€once€again€ordered€consecutiveÏsentencing.€€The€trial€court€ordered€that€the€appellantððs€three€(3)€ten€(10)€yearÏsentences€for€the€aggravated€robberies€be€served€concurrently,€that€his€six€(6)€yearÏsentence€for€aggravated€assault€be€served€consecutively€to€the€robbery€sentences,Ïand€that€his€two€(2)€twelve€(12)€year€sentences€for€his€attempted€second€degreeÏmurder€convictions€be€served€consecutively€to€each€other€and€consecutive€to€theÏaggravated€assault€sentence.€€Therefore,€appellantððs€effective€sentence€is€forty€(40)Ïyears.ÌHaving€carefully€reviewed€the€record€upon€appeal,€including€the€transcript€ofÏthe€resentencing€hearing,€we€are€of€the€opinion€that€the€trial€court€was€justified€by€theÏfacts€and€the€law€in€ordering€consecutive€sentences€for€these€offenses,€andÏaccordingly,€we€affirm.ÌThe€facts€which€gave€rise€to€the€appellantððs€convictions€are€set€forth€in€detailÏin€this€Courtððs€opinion€from€appellantððs€initial€appeal.€€òòSeeóó€òòState€v.€John€L.€Smithóó,€NoÏ01C01„9309„CR„00308,€(Tenn.€Crim.€œApp›.,€Nashville,€Oct.€20,€1994).€€WithoutÏrehashing€those€facts,€suffice€it€to€say€that€the€appellantððs€participation€in€these€veryÏserious€crimes€was€egregious€and€aggravated,€resulting€in€one€completely€innocentÏvictim€being€shot€in€the€leg,€police€officers€being€fired€upon€by€the€appellant,€anotherÍvictim€receiving€head€wounds€by€being€pistol„whipped€by€the€appellant,€a€high„speed€vehicular€chase€through€the€streets€of€Nashville,€and€death€threats€made€byÏthe€appellant€to€persons€at€the€scene€of€the€robberies.€€Moreover,€the€evidenceÏclearly€supports€a€finding€that€the€appellant€was€a€leader€in€the€commission€of€theseÏcrimes,€and€that€these€crimes€were€committed€soon€after€the€appellant€had€beenÏplaced€upon€probation€following€an€earlier€conviction€for€vehicular€theft.€€ÌA€defendant€convicted€of€more€than€one€criminal€offense€can€be€givenÏconsecutive€sentences€if€the€trial€court€finds€by€a€preponderance€of€the€evidence€œthat:›ÌÓÓ(5)à8 àthe€defendant€is€a€dangerous€offender€whose€behaviorÏindicates€little€or€no€regard€for€human€life,€and€noÏhesitation€about€committing€a€crime€in€which€the€risk€toÏhuman€life€is€high;€[or]€ÌÌ(6)à8 àthe€defendant€is€sentenced€for€an€offense€while€onÏprobation.ÌÌTenn.€Code€Ann.€ðð€40„35„115(b)(5)€&€(6)€(1990).ÌÌÓÓRecently,€our€supreme€court€held€that€before€a€defendant€may€be€sentencedÏto€consecutive€sentences€as€a€dangerous€offender,€ð ðthe€proof€must€also€establishÏthat€the€terms€imposed€are€reasonably€related€to€the€severity€of€the€offensesÏcommitted€and€are€necessary€in€order€to€protect€the€public€from€further€criminal€actsÏby€the€offender.ðð€€òòState€v.€œWilkerson›óó,€905€S.W.2d€933,€938€(Tenn.€1995).€€Further,€theÏsentence€must€also€comply€with€the€Sentencing€Actððs€general€principles.€€òòId.óó€€ÌAt€appellantððs€resentencing€hearing€regarding€the€issue€of€consecutiveÏsentencing,€the€trial€judge€set€forth€in€detail€ample€findings€of€fact€justifying€theÏconsecutive€sentencing€ordered.€€First,€the€trial€court€found,€and€the€record€supports,Ïthat€the€appellantððs€behavior€indicated€little€or€no€regard€for€human€life€and€noÏhesitation€about€committing€a€crime€in€which€the€risk€to€human€life€was€high.€ÏSecond,€the€trial€court€found€that€consecutive€sentences€were€reasonably€related€toÏthe€severity€of€the€offenses€committed.€€In€that€respect,€the€trial€court€found€that€evenÏthough€the€crimes€arose€out€of€one€continuous€chain€of€events,€there€were€threeÏseparate€episodes€and€multiple€victims:€€first,€the€robberies€themselves,€withÏappellantððs€accompanying€threats€and€his€shooting€at€an€innocent€busboy€inside€theÏrestaurant;€second,€the€shooting€of€the€employee€outside€the€restaurant€who€in€noÏway€posed€a€threat€to€the€appellantððs€escape;€and€finally,€the€high€speed€auto€chaseÏculminating€in€a€physical€altercation€between€the€appellant€and€a€police€officer€tryingÏto€effect€his€arrest€wherein€the€appellant€took€the€officerððs€service€weapon€and€fired€itÏat€the€officer€while€attempting€to€flee€on€foot.€€The€trial€court€found€that€theÏconsecutive€sentences€are€necessary€to€protect€the€public€from€further€criminal€actsÏby€the€appellant.€€The€trial€court€particularly€emphasized€that€the€appellant€committedÏthese€crimes€while€on€probation€for€vehicular€theft€and€that€he€threatened€to€killÏseveral€people€.ÌMoreover,€it€is€uncontested€that€the€appellant€was€on€probation€for€vehicularÏtheft€when€these€offenses€occurred.€€This,€in€itself,€is€sufficient€to€order€consecutiveÏsentences.€€Tenn.€Code€Ann.€ðð€40„35„115(b)(6)€(1990).ÌAccordingly,€the€appellantððs€consecutive€sentences€are€affirmed.ÌÌÌÓӜǛà
