TheStatecontendsthatthedefendanthaswaivedhisrighttoappealtheorderbecauseheagreedtoitanddidnotreservethedoublejeopardyissueasacertifiedquestionoflaw.Inotherwords,theStateasserts,theconsentorderhastheeffectofaguiltyplea.Weagreethattheconsentorderis,ineffect,thecivilequivalent 2   כofaguiltyornolocontendereplea.However,aguiltypleadoesnotautomaticallyconstituteawaiverofadoublejeopardyclaimwhere,judgedonthefaceoftherecord,thechargeisonewhichtheStatemaybeconstitutionallyprohibitedfromprosecuting.Mennav.NewYork,423U.S.61(1975).SeealsoStatev.Rhodes,917S.W.2d708,711(Tenn.Crim.App.1995).Here,thefaceoftherecordrevealsthattheStateisseekingtosanctionthedefendantbaseduponseveralcriminaloffensesofwhichhehasbeenpreviouslyconvicted.UnderMenna,weholdthatadoublejeopardyclaimisnotwaivedbyaconsentorderunderthesecircumstances.
