Therecordrevealsthatthevictimwassevenmonthsoldatthetimeofthesexualassault.Theappellantwashernaturalfather.Thevictimsufferedavaginaltearrequiringsurgery.Theinjurywasdescribedaslifethreateningifleftuntreated.Shewassuturedfromhervaginatoherrectum.Duringsurgery,shesufferedaseizureandlossofblood.Shewashospitalizedthreedays. Atthetimeofthehearing,thevictimwastwentyonemonthsoldandcouldnotverbalize.Avictimimpactstatementrevealedthatthevictimwassufferingfromrecurringnightmaresanddidnotliketohavehergenitalareacleaned.Thevictim'smotherstatedthatfollowingtheincident,thevictimwould"cryandtrytocrawlaway"fromtheappellant.Hermotherisfurtherconcernedaboutthefuturepsychologicalimpactofthisincident. Appellant'ssentencerangeasaRangeI,standardoffenderwaseighttotwelveyears.Thetrialjudgefoundthreeenhancementfactors:(1)thevictim'svulnerabilityduetoherage,(2)theappellant'sabuseofapositionofprivatetrust,and(3)thevictim'ssufferingseriousbodilyinjury.Thetrialjudgefound,asamitigatingfactor,thatappellanthadnopriorcriminalrecord.Baseduponthefindingofthreeenhancementfactorsandonemitigatingfactor,appellantwassentencedtotenyears. Whenasentencingissueisappealed,thisCourtshallconductadenovoreviewwiththepresumptionthatthetrialcourt'sfindingsarecorrect.Tenn.CodeAnn.4035401(d)(1990);Statev.Byrd,861S.W.2d377,379(Tenn.Crim.App.1993).Thepresumptionofcorrectnessisconditioneduponanaffirmativeshowingthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofadefendant'ssentence,thisCourtmustconsider:(1)theevidencereceivedatthetrialandthesentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandargumentstosentencingalternatives,(4)thenatureandcharacteristicsofthecriminalconduct,(5)anymitigatingand  enhancementfactors,(6)anystatementsmadebythedefendantinhisownbehalf,and(7)thedefendant'spotentialforrehabilitationortreatment.Tenn.CodeAnn.4035210,103,and210(1990);Statev.Smith,735S.W.2d859,862(Tenn.Crim.App.1987). Infelonysentencing,theminimumsentenceispresumed.Tenn.CodeAnn.4035210(c).Procedurally,thetrialcourtincreasesthesentencewithintherangeforenhancementfactorsandfollowswithareductionformitigatingfactors.Tenn.CodeAnn.4035210(d)&(e)."[T]hereisnoparticularvalueassignedbythisstatutetothevariousfactorsandthe'weightaffordedmitigatingorenhancementfactorsderivesfrombalancingrelativedegreesofculpabilitywithinthetotalityofthecircumstancesofthecaseinvolved.'"Statev.Salazar,No.02C019105CR00098,slipop.45(Tenn.Crim.App.Jan.15,1992)(quotingStatev.Moss,727S.W.2d229,238(Tenn.1986)). Theappellantconcedestoproperapplicationoftheabuseofapositionofprivatetrustfactor.Tenn.CodeAnn.4035114(15).Theappellant,however,contendsthatthetrialcourterredinapplying,asenhancementfactors:(1)victimvulnerabilityduetoage(Tenn.CodeAnn.4035114(4))and(2)personalinjuriesinflicteduponvictimwereparticularlygreat(Tenn.CodeAnn.4035114(6)).He,therefore,arguesthatheshouldhavereceivedtheminimumsentenceofeightyears.Wedisagree. UnderTenn.CodeAnn.4035114(4),therelevantinquiryis"whetherornotthevictimwasparticularlyvulnerable."Salazar,slipop.at6.ThisCourthasdeemedthisfactorapplicabletoinfantsevenwhenageisanelementoftheoffense.Statev.Burch,No.130(Tenn.Crim.App.Dec.6,1990);seealsoStatev.Adams,864S.W.2d31,35(Tenn.1993)(upholdingfactor'sapplicability).Therationaleisthatinfantsaredistinguishablefromolderchildren.Infants,frombothaphysicalandmentalstandpoint,are"utterlydefenseless,""unabletoattempttoevadeorrebuffanassault...incapableofresisting,summoninghelporlatertestifyingagainsttheperpetrator."Salazar,slip.opat6.Accordingly,T.C.A.4035114(4)isapplicablewhenaggravatedsexualbatteryisperpetratedagainstasevenmontholdinfant. Withregardtothetrialcourt'sapplicationofTenn.CodeAnn.4035114(6),theappellantarguesthat"therecordisdevoidofanyevidencefromwhichtheCourtcoulddeterminethatthevictim'sinjurieswere'greaterthan,lessthan,orequivalenttothatwhichisordinarilyinvolved'inaggravatedchildsexualbatterycases."Again,wedisagree.Thevictimsufferedapotentiallyfatal,ifuntreated,lacerationfromhervaginatoherrectumwhichnecessitatedanemergencysurgicalprocedureandhospitalizationforthreedays.Inaddition,thevictimstillsuffersapparentemotionalmanifestationsfromtheassault.Furthermore,personalinjurywasnotapartoftheindictmentlanguageofappellant'scrime.Wefindthetrialcourtappropriatelyappliedthisenhancementfactor.
