FACTS    Onappeal,theappellantaversthathistrialcounselrenderedineffectiveassistanceby:(1)failingtosubpoenatwowitnesses,"JuneBug"and"Rabbit";(2)failingtodissuadetheappellantfromtestifyingonhisownbehalf;(3)failingtoassertaclaimofineffectiveassistanceondirectappeal;and(4)failingtointroducecertainphotographicevidence. Theappellanttestifiedathispostconvictionhearing.Hestatedthathisrelationshipwithtrialcounselhaddeterioratedandthathehadonlymetwithcounselon"aboutfourorfive"occasions.Duringoneofthosemeetings,heapparentlyrequestedcounseltolocatetwowitnesses,"JuneBug"and"Rabbit."Atthepostconvictionhearing,heclaimedthatbothwitnessespossessedinformationthatcouldhaveexoneratedhim.Hefurtherassertedthatcounselwasremissinfailingtointroducephotographsdepictingthelightingconditionsinsidetheclub. Theappellant'strialcounseltestified.Hestatedthatheattemptedtofinda"Rabbit"anda"JuneBug."He,however,wasunabletolocateanyindividualsreferredtobythosenames. 1   ׀Hestatedthatuponreviewingphotographsofthecrimescene,heconcludedthephotographswouldnotsupporttheappellant'sdefense.Astotheappellant'sdecisiontotestify,trialcounselstated:8 IputitontherecorditwasagainstmyadvicethathetestifyandthentheCourtsentusbackTheJudgegaveusanopportunitytotalktohimfurthersincehesaidhedidwanttotestify,eventhoughitwasagainstmyadvicetodoso. Thehearingjudgefoundthat"Rabbit"and"JuneBug"werenonlocatablewitnesses.Herememberedtheappellant'strialandheincessantlyreferredtocounsel'sperformanceas"outstanding"and"artful." 2   ׀Hefurtherrecalledthatcounsel:8 setupaselfdefensetheory,orinthealternative,toshowthatthehomicidewasnomorethanvoluntarymanslaughter.[Trialcounsel]didoneofthebestjobstheCourthasseentosetthatup.Herecalledthattheappellant'sproblemsarose,however,whentheappellantinsistedontestifyingagainsthisattorney'sadvice. 3   8 Whenhegotupandtestifiedthathehadabsolutelynothingtodowiththis,hadnopartinthekilling,hedestroyedhisselfdefensetheoryandthevoluntarymanslaughterpossibility...that[counsel]hadengineeredforhimduringthecourseofthetrial.   ANALYSIS    Thetestfordeterminingwhethercounselprovidedeffectiveassistanceattrialiswhethercounsel'sperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930(Tenn.1975).Appellantmustestablishbyapreponderanceoftheevidencethat:(1)counsel'sservicesoradvicefellbelow"therangeofcompetencedemandedofattorneysincriminalcases,"and(2)counsel'sdeficient  performanceprejudicedhisdefense.Stricklandv.Washington,466S.W.2d668(1984). Inpostconvictionproceedings,thepetitionerbearstheburdenofprovinghisallegationsbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Furthermore,thetrialcourt'sfindingsinpostconvictionhearingsareconclusiveonappealunlesstheevidencepreponderatesagainstthosefindings.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983);Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).  FAILURETOSUBPOENAWITNESSES    Theappellantallegesthattrialcounselrenderedineffectiveassistancebyfailingtosubpoena"JuneBug"and"Rabbit."Tosucceedonhisclaim,theappellantmustestablishthathewasprejudicedbycounsel'sfailuretosubpoenathewitnesses.Stricklandv.Washington,466U.S.668(1984).Toestablishprejudice,hemust:(1)producethewitnessathispostconvictionhearing;(2)showthatthroughreasonableinvestigation,trialcounselcouldhavelocatedthewitness;and(3)elicitbothfavorableandmaterialtestimonyfromthewitness.Statev.Black,794S.W.2d752,757(Tenn.Crim.App.1990). Theappellantfailedtoproduceeither"JuneBug"or"Rabbit"athispostconvictionhearing.Heis,therefore,unabletoestablishthathesufferedprejudicebycounsel'sfailuretosubpoenathosewitnesses. 4   ׀Thisissueisdevoidofmerit.  RELATIONSHIPWITHATTORNEY    Theappellantnextaversthattrialcounselwasineffectivebypermittinghimtotestify.Theappellantarguesthathisrelationshipwithhisattorneyhaddeterioratedsuchthat"hewasunabletobenefitfromtheexpertiseof[trialcounsel]."Asaresultofthedeterioratedrelationship,trialcounselwasunabletodissuadehimfromtestifying. Thehearingjudgerecalledthatcounselvehementlyandontherecordadvisedtheappellantnottotestify.However,asaRangeIImultipleoffender,theappellantwasnoneophytetothejudicialprocess.Hehadarighttotestifyandhechosetoexercisethatrightoverthesoundadviceofhisattorney.Heshouldnotnowbepermittedtocomplainsimplybecause,lookingback,henowrealizesthatheexercisedpoorjudgmentinrefusingtofollowtheadviceofhisattorney.Thisissueiswithoutmerit.  APPELLATECOUNSEL    Theappellantarguesthathisappellatecounselwasineffectiveforfailingtoraisetrialcounsel'sallegedineffectivenessondirectappeal.Theappellant,however,haswaivedthisissuebyfailingtosupporthisargumentwithcitationtoanyauthority.SeeTenn.R.Ct.Crim.App.,Rule10(b).  PHOTOGRAPHS    Theappellant'scontentionthatcounselwasineffectiveforfailingtointroducephotographicevidenceoftheshootingsceneiswithoutmerit.Thedecisiontointroducephotographicevidencewasatacticaldecision.Therecordindicatesthatcounselmadeaninformeddecisiontorefrainfromintroducingphotographicevidenceofthecrimescene.Wewillnot"secondguess"informedtacticalandstrategicdecisions.Cooperv.State,849S.W.2d744,746(Tenn.1993).Moreover,theappellantfailedtointroducethisphotographicevidenceathishearing.Appellantcannotestablishprejudicethroughmerebaldassertionthatintroductionoftheevidencewouldhavedictatedadifferentoutcome.
