JOSEPHD.BAUGH Nashville,TN37201    DistrictAttorneyGeneral (AtTrial)       JEFFBURKS        Asst.DistrictAttorneyGeneral       P.O.Box937       Franklin,TN370650937      OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY,Judge  ќ@ OPINION     Thedefendantwaschargedintheindictmentwithsixcountsofrapeofachildunderthirteenyearsofage,inviolationofT.C.A.3913522(Supp.1995).Atthecloseofproof,theStateelectedtoproceedupononecountoftheindictmentand,onMarch2,1995,thejuryfoundthedefendantguiltyonthatcount.AtthesentencinghearingonMarch27,1995,thetrialcourtsentencedhimtofifteenyearsintheDepartmentofCorrection.Inthisappealasofright,thedefendantchallengesthesufficiencyoftheconvictingevidence.Wefindthatthedefendantsissueonappeallacksmerit,andwethereforeaffirmthejudgmentofthetrialcourt.  TheincidentwhichledtotheinvestigationofthepresentcaseoccurredonOctober10,1993.Onthatdate,TeresaStokes,themotherofthevictim .   ׀andtheformerwifeofthedefendant,testifiedthatshehadwitnessedthedefendantstandinginthevictimsbedroomholdinghiserectpenis.Thevictimwassittingonherbedatthetime,andthedefendantwas pointingdownatherprivatepart.Stokeslaterquestionedthevictimaboutwhathadtakenplace.ThevictimeventuallyrevealedthatthedefendanthadbeensexuallyabusinghersinceapproximatelyMay1993.Thesexualabuseallegedlyincludedbothoralandvaginalsex.Inresponsetothisinformation,Stokestelephonedthepolice.Stokestestifiedfurtherthatthevictimhadbeensexuallyassaultedwhenshewasthreeyearsold.Thatincidentresultedintheprosecutionofanindividual,andhereceivedprobationandmandatorycounseling.Thevictimalsoreportedhavingbeensexuallyassaultedin1991byanotherindividual,butchargesinthatcaseweredropped.  ThevictimtestifiedthatonOctober10,1993,shehadbeensittingonherbedputtingpantsonoverhershorts.Thedefendantenteredherroom, grabbedhisprivatepart,pointedather privatepart,andaskedherto dosomethingwithhim.Thevictimsmotherinterruptedtheconversationandcalledthevictimintothebathroom.Atthispoint,thevictimtoldhermotherthatthedefendanthadbeensexuallyabusingher.  Thevictimtestifiedthattheabusehadbegunshortlyafterthedefendantmovedbackintothehomeinthespringof1993,whileheandTeresaStokeswereattemptingtosalvagetheirmarriage.Theabuseincludedoralandvaginalsex,andittookplaceineverymonthfromApril1993throughOctober1993.Thevictimtestifiedfurtherthat,althoughthedefendanthadnotsexuallyabusedheronOctober10,1993,hehadsexuallyabusedherduringOctoberpriortothatdate.Inall,thedefendantsexuallyabusedthevictimonmorethantenortwelveoccasions.ThevictimstatedthatshehadnottoldhermotherabouttheabusepriortoOctober10,Ϝ1993,becauseshewasafraidthatthedefendantwouldharmhermotherorherself.  BarbaraDerricks,apoliceinvestigator,testifiedthatshehadinterviewedthevictimafterthepolicewerecalledonOctober10,1993.ThevictiminformedDerricksofthesexualabuse,andoneincidentdrewDerricksattention.Ononeoccasion,thedefendantwassexuallyabusingthevictimwhenhewasinterruptedbyaknockatthedoor.Thevictimnoticedthatthedefendantspeniswasdrippingashejumpedupfromherbed.Basedonthisinformation,Derrickshadthevictimsbedspreadandsamplesfromthebedroomcarpettestedforthepresenceofsemen.WhenDerricksaskedthedefendantwhyhissemenmightbefoundonthevictimsbedspread,herespondedthathewouldsometimescoverhimselfwiththebedspreadashemasturbatedwhilewatchingfootball.  Dr.C.A.StilwelltestifiedthathehadexaminedthevictimonOctober11,1993.Duringhisexamination,Stilwelldiscoveredthatthevictimshymenwasstretchedsignificantly.Stilwellstatedthatsuchstretchingwascausedbya significantsexualexperience,meaningmultipleoccasionsofpenetrationbysomethingaslargeasanerectpenis.Stilwelltestifiedfurtherthattheconditionofthevictimsvaginacouldnothavebeencausedbyevenmultipleinstancesoffondlingordigitalpenetration.  DeanneJohnson,aforensicserologistwiththeTennesseeBureauofInvestigation,testifiedthatshehadtestedthebedspreadandthecarpetsamplesforthepresenceofbodilyfluids.SheconfirmedthepresenceofsemenonthevictimsbedspreadandstatedthatthesemencamefromamanwithtypeBblood.ShetestifiedfurtherthatthedefendantsbloodtestrevealedthathehastypeBblood.  MargaretBash,aforensicscientistspecializinginDNAanalysiswiththeTennesseeBureauofInvestigation,testifiedthatshehadconductedaDNAanalysisofthesemensamplefromthevictimsbedspread.HeranalysisrevealedthattheDNAfromthesemenonthebedspreadmatchedtheDNAfromthedefendantsbloodtest.ShetestifiedfurtherthattheprobabilityofselectinganunrelatedindividualfromtheAfricanAmericanpopulationhavingamatchingDNAprofileisoneintwohundredthirtythreemillion.  AtthecloseoftheStatescaseinchief,theStateelectedtoproceedupononecountoftheindictment,allegingthatthedefendanthadrapedthevictiminOctoberof1993beforeOctober10,1993.Thedefendantofferednoproofonhisbehalf.  Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,wemustreviewtheevidenceinthelightmostfavorabletotheprosecutionindeterminingwhether"anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt."Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,61L.Ed.2d560(1979).WedonotreweighorreevaluatetheevidenceandarerequiredtoaffordtheStatethestrongestlegitimateviewoftheproofcontainedintherecordaswellasallreasonableandlegitimateinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978).  Questionsconcerningthecredibilityofwitnesses,theweightandvaluetobegiventotheevidence,aswellasfactualissuesraisedbytheevidenceareresolvedbythetrieroffact,notthisCourt.Cabbage,571S.W.2d832,835.AguiltyverdictrenderedbythejuryandapprovedbythetrialjudgeaccreditsthetestimonyofthewitnessesfortheState,andapresumptionofguiltreplacesthepresumptionofinnocence.Statev.Grace,493S.W.2d474,476(Tenn.1973).  AdefendantchallengingthesufficiencyoftheproofhastheburdenofillustratingtothisCourtwhytheevidenceisinsufficienttosupporttheverdictreturnedbythetrieroffactinhisorhercase.ThisCourtwillnotdisturbaverdictofguiltforlackofsufficientevidenceunlessthefactscontainedintherecordandanyinferenceswhichmaybedrawnfromthefactsareinsufficient,asamatteroflaw,forarationaltrieroffacttofindthedefendantguiltybeyondareasonabledoubt.Statev.ϜTuggle,639S.W.2d913,914(Tenn.1982).  Fromareviewoftherecordinthiscase,wecanonlyconcludethatthefactsaresufficient,asamatteroflaw,forarationaltrieroffacttofindthedefendantguiltybeyondareasonabledoubt.Thevictimtestifiedthatthedefendanthadengagedinoralandvaginalsexwithheronatleasttenortwelveoccasions,includinganincidentinOctoberof1993beforeOctober10,1993.Amedicalexaminationofthevictimsvaginarevealedthatithadbeenpenetratedonmultipleoccasionsbysomethingaslargeasanerectpenis.ScientificanalysisconfirmedthepresenceofsemenmatchingthedefendantsDNAonthevictimsbedspread.Giventheproofintheentirerecord,thedefendanthasfailedtocarryhisburdenofdemonstratingthelegalinsufficiencyoftheconvictingevidence.
