àOPINIONóóÌThe€appellant,€Brian€Swick,€was€convicted€of€felonious€recklessÏendangerment,€a€class€E€felony,€by€a€jury€in€the€Circuit€Court€of€Greene€County.€€œHeÏwas€sentenced€to€serve€fifteen€(15)€months€in€the€county€jail.€€On›€appeal,€he€raisesÏthe€following€issues€for€our€consideration:ÌÓÓ(1)à8 àWhether€the€evidence€adduced€at€trial€was€sufficient€toÏsustain€the€verdict€of€the€jury.ÌÌ(2)à8 àWhether€the€trial€court€erred€in€refusing€to€grant€a€secondÏcontinuance€to€the€appellant.ÌÌ(3)à8 àWhether€the€trial€court€erred€when€it€refused€to€allow€theÏappellant€to€call€the€probation€officer€of€a€missing€witnessÏfor€the€purpose€of€explaining€to€the€jury€that€the€witnessÏwas€subject€to€an€outstanding€warrant.ÌÌ(4)à8 àWhether€the€sentence€imposed€by€the€trial€court€wasÏexcessive.ÌÌÓÓFor€the€reasons€contained€herein,€we€affirm€the€trial€court.ÌÌà@ àò òI.€€FACTUAL€BACKGROUNDó óÌOn€December€29,€1994,€around€7:00€p.m.,€Officer€œStewart›€Kilgore€of€theÏGreeneville€Police€Department€was€standing€next€to€his€police€cruiser€on€ChapelÏStreet.€€Chapel€Street€is€an€extremely€narrow€street€in€Greeneville,€Tennessee.€€TheÏofficer€heard€a€vehicle€coming€down€this€narrow€street€at€a€high€rate€of€speed.€€In€anÏattempt€to€wave€the€vehicle€down€and€warn€the€driver€to€slow€down€his€car,€the€officerÏwaved€his€flashlight€at€the€vehicle.€€The€vehicle,€a€truck,€did€slow€down€in€response€toÏthe€light.€€However,€as€the€truck€approached€the€officer€and€the€officer€reached€out€toÏtouch€the€driver„side€door,€the€driver€of€the€truck€suddenly€accelerated€the€truckÏrunning€over€Officer€Kilgoreððs€foot€in€the€process.€€The€truck€sped€away€from€theÏscene€and€the€officer€radioed€a€description€of€the€driver€and€the€passenger.€ÏBelieving€that€the€driver€was€Brian€Swick,€with€whom€the€officer€had€had€priorÏdealings,€the€officer€surmised€that€the€appellant€and€his€passenger€would€drive€to€theÏappellantððs€mobile€home.€€The€officer€went€to€the€appellantððs€mobile€home.€ÏChristopher€Smith,€the€passenger€of€the€speeding€truck,€opened€the€door€and€theÍofficer€went€into€the€home€and€effected€an€arrest€of€the€appellant€who€was,€in€OfficerÏKilgoreððs€opinion,€hiding€in€a€back€room€of€the€mobile€home.€€ÌOfficer€Kilgore€was€the€only€witness€presented€by€the€State€and€it€was€hisÏtestimony€that€the€driver€of€the€vehicle€who€ran€over€his€foot€and€sped€through€theÏstreets€of€Greeneville€on€the€evening€of€December€29,1995,€was€the€appellant.€€ÌThe€appellant€testified€in€his€own€behalf€and€agreed€with€Officer€KilgoreððsÏtestimony€as€to€the€events€of€that€evening€with€the€notable€exception€that€theÏappellant€claimed€that€he€was€not€driving€the€vehicle€but€was€merely€a€passenger.€ÏThe€appellant€testified€that€Christopher€Smith,€identified€by€Officer€Kilgore€as€theÏpassenger,€was€the€driver€of€the€truck€on€that€evening.€€Jerry€Bell€testified€on€behalfÏof€the€appellant€that€sometime€between€7:30€and€7:45€p.m.€on€the€night€in€questionÏChristopher€Smith€and€the€appellant€came€racing€down€the€road€on€which€he€lives€atÏa€high€rate€of€speed€towards€the€appellantððs€home€and€that€Christopher€Smith€wasÏthe€driver€of€the€truck.€€Similarly,€Randy€Ricker€testified€on€behalf€of€the€appellant€thatÏon€that€same€evening€he€observed€a€truck€driven€by€Christopher€Smith,€in€which€theÏappellant€was€a€passenger,€traveling€at€a€high€rate€of€speed€towards€the€appellantððsÏhouse€where€it€came€to€a€stop€and€both€the€appellant€and€Mr.€Smith€got€out€of€theÏtruck€and€ran€into€the€house.€€ÌœChristopher€Smith€did€not€testify.€€The›€appellant€attempted€to€call€ChristopherÏSmithððs€probation€officer€for€the€purpose€of€informing€the€jury€that€there€was€anÍoutstanding€warrant€for€œSmith€in€order€to€explain€Smithððs€absence.›€€The€trial€courtÏdenied€the€appellantððs€request€to€call€this€witness€apparently€on€grounds€that€SmithððsÏarrest€warrant€on€an€unrelated€matter€was€irrelevant.€The€trial€court€did€adviseÏcounsel€for€the€appellant,€however,€that€he€could€ask€the€appellant€if€œð ðthe›€policeÏofficers€are€not€out€looking€for€[Smith].ðð€€Counsel€did€not€ask€the€appellant€thatÏquestion.€The€appellant€was€asked,€however,€if€he€had€tried€to€locate€Smith,€andÏappellant€responded,€ð ðLooked€around€a€bit€and€all€Iððve€heard€and€everything€heððsÏsomewhere€in€Morristown.ððò òÌÌà@ àII.ó ó€€ò òSUFFICIENCY€OF€THE€EVIDENCEó óÌWhere€the€sufficiency€of€the€evidence€is€challenged,€the€relevant€question€forÏthis€court€is€whether,€after€reviewing€the€evidence€in€the€light€most€favorable€to€theÏprosecution,€any€rational€trier€of€fact€could€have€found€the€essential€elements€of€theÏcrime€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443€U.S.€307,€99€S.€Ct.€2781,Ï61€L.€Ed.€2d€560€(1979);€òòState€v.€Williamsóó,€657€S.W.2d€405,€410€(Tenn.€1983);ÏT.R.A.P.€13€(e).€€ÌA€guilty€verdict,€approved€by€the€trial€judge,€accredits€the€testimony€of€theÏwitnesses€for€the€State€and€resolves€any€conflicts€in€favor€of€the€State's€theory.€€òòStateÏv.€Hatchettóó,€560€S.W.2d€627,€630€(Tenn.€1978).€€On€appeal,€the€State€is€entitled€to€theÏstrongest€legitimate€view€of€the€evidence€and€to€all€reasonable€inferences€whichÍmight€be€drawn€therefrom.€€òòState€v.€Cabbageóó,€571€S.W.2d€832,€836€(Tenn.€1978).€€AÏverdict€against€the€defendant€removes€the€presumption€of€innocence€and€replaces€itÏwith€a€presumption€of€guilt€on€appeal.€€òòState€v.€Graceóó,€493€S.W.2d€474€(Tenn.€1973).€ÏThe€defendant€has€the€burden€of€overcoming€the€presumption€of€guilt.€€òòState€v.ÏBrownóó,€551€S.W.2d€329€(Tenn.€1977).€€ÌIn€accordance€with€the€above€standard€of€review,€we€hold€that€the€evidenceÏwas€sufficient€as€a€matter€of€law€to€support€the€juryððs€verdict.€ÌTennessee€Code€Annotated€section€39„13„103(a)€provides€that€ð ða€personÏcommits€an€offense€who€recklessly€engages€in€conduct€which€places€or€may€placeÏanother€person€in€imminent€danger€of€death€or€serious€bodily€injury.ðð€€Such€œreckless€Ïconduct€committed›€with€a€deadly€weapon€is€a€class€E€felony.€Tenn.€Code€Ann.€ðð€39„13„103(b)€(1991€Repl.).€€There€was€conflicting€testimony€from€the€witnesses€as€toÏwho€was€driving€the€truck€on€the€night€in€question.€€The€jury€obviously€resolved€thisÏissue€against€the€appellant€by€crediting€the€officerððs€testimony€that€the€appellant€wasÏthe€driver.€€ÌThe€appellant€argues€that€even€if€the€evidence€supports€the€conclusion€thatÏhe€was€the€driver€of€the€vehicle,€the€State€failed€to€prove€the€elements€of€the€offenseÏbeyond€a€reasonable€doubt.€€We€disagree.ÌA€person€acts€recklessly€when€ÌÓÓà8 àœ.€.€.€with›€respect€to€circumstances€surrounding€the€conductÏor€the€result€of€conduct€œ.€.€.›€the€person€is€aware€of€butÏconsciously€disregards€a€substantial€and€unjustifiable€riskÏthat€the€circumstances€exist€or€the€result€will€occur.€€TheÏrisk€must€be€of€such€a€nature€and€degree€that€its€disregardÏconstitutes€a€gross€deviation€from€the€standard€of€care€thatÏan€ordinary€person€would€exercise€under€all€theÏcircumstances€as€viewed€from€the€accused€personððsÏstandpoint.ÌÌ€œà àTenn.›€Code€Ann.€ðð€39„11„106(31)€(1995€Supp.).€€ÌÌÓÓConcluding,€as€the€jury€obviously€did,€that€the€appellant€was€the€driver€of€theÏtruck,€the€facts€support€the€determination€that€the€appellant€acted€recklessly€when€heÏdrove€at€a€high€rate€of€speed€on€a€very€narrow€street€in€the€dark€and€when€heÏdeliberately€sped€up€after€slowing€down€when€Officer€Kilgore€approached€andÏtouched€his€vehicle.€€The€appellant€€consciously€and€unjustifiably€disregarded€theÏinherent€risks€of€his€conduct.€€His€actions€placed€the€officer€in€imminent€danger€ofÏdeath€or€serious€bodily€injury€and€in€fact€did€cause€bodily€injury€to€the€officer.€€ÌA€deadly€weapon€is€ð ðanything€that€in€the€manner€of€its€use€or€intended€use€isÏcapable€of€causing€death€or€serious€bodily€injury.ðð€€Tenn.€Code€Ann.€ðð€39„11„106(5)(B)€œ(1995›€Supp.).€€€In€òòState€v.€Scott€W.€Longóó,€No.€03C01„9301„CR„00032Ï(Tenn.€Crim.€App.,€at€Knoxville,€August€19,€1993),€òòperm.€to€appeal€deniedóó€(Tenn.Ï1993),€this€Court€held€that€a€vehicle€can€be€a€deadly€weapon€when€misused.€€InÏòòLongóó€we€held€that€whether€an€automobile€is€a€deadly€weapon€or€not€depends€uponÏthe€method€of€use€and€that€the€resolution€of€the€issue€necessarily€turns€on€theÍparticular€facts€of€each€case.€€€In€the€case€at€bar,€the€appellant€drove€on€a€veryÏnarrow€street€in€Greeneville€in€the€dark€at€a€high€rate€of€speed.€€The€appellant€placedÏthe€life€of€Officer€Kilgore€in€danger.€€The€appellant€could€have€easily€killed€OfficerÏKilgore€when€he€sped€away€into€the€night€on€a€narrow€street€while€Officer€KilgoreÏstood€inches€away€from€the€truck.€€The€juryððs€conclusion€that€the€appellantððsÏspeeding€pickup€truck€was€a€deadly€weapon€is€supported€by€the€evidence€in€thisÏcase.€€€Accordingly,€this€issue€is€without€merit.ÌÌò àThe€crime€was€committed€under€circumstances€underÏwhich€the€potential€for€bodily€injury€to€a€victim€wasÏparticularly€great.ÌÌTenn.€Code€Ann.€ðð€40„35„114€(1995€Supp.).ÌÓÓÌAlthough€the€trial€court€considered€all€of€the€enhancement€factors€sought€byÏthe€State,€it€is€unclear€from€the€record€precisely€which€factors€the€court€applied€inÏreaching€its€decision€to€sentence€the€appellant€above€the€minimum€sentence€withinÏthe€range.€€We€therefore€review€the€sentence€òòdeóó€òònovoóó.€€It€appears€as€if€the€courtÏapplied€all€of€the€above€factors€except€enhancement€factor€thirteen€(13).€€We€haveÏreviewed€the€record€including€the€sentencing€hearing€and€conclude€that€none€of€theÏabove€factors€are€appropriate€in€this€case.ÌFelony€reckless€endangerment€requires€the€use€of€a€deadly€weapon;Ïaccordingly,€factor€nine€(9)€was€an€element€of€the€offense€and€it€was€improper€toÏenhance€the€sentence€on€this€basis.€ÌFactor€ten€(10)€was€likewise€improper€because€the€state€failed€to€show€thatÏthe€appellantððs€conduct€created€a€risk€to€human€life€greater€than€that€inherent€in€anyÏoffense€in€which€a€deadly€weapon€is€used.€€òòSeeóó€òòState€v.€Hillóó,€885€S.W.2d€357,€363Ï(Tenn.€Crim.€App.€1994);€òòState€v.€Hicksóó,€868€S.W.2d€œ729,€732›€(Tenn.€Crim.€App.Ï1993).€€ÌFactor€twelve€(12)€was€not€an€appropriate€factor€in€this€case€because€theÏState€failed€to€establish€that€the€appellantððs€conduct€in€running€over€the€officerððs€footÏwas€willful.€ÌEnhancement€factor€sixteen€(16)€was€not€an€appropriate€factor€in€this€case.€ÏAlthough€the€appellantððs€conduct€placed€Officer€Kilgore€at€risk€for€bodily€injury,€theÏState€failed€to€establish€that€the€appellantððs€conduct€created€a€risk€of€bodily€injury€toÏanyone€other€than€Officer€Kilgore.€€The€risk€of€bodily€injury€to€the€officer€was€anÏelement€of€the€offense€of€felonious€reckless€endangerment.€€Therefore,€the€sentenceÏcould€not€be€enhanced€on€this€basis.€€òòSeeóó€òòState€v.€Hillóó,€885€S.W.2d€357,€363€(Tenn.ÏCrim.€App.€1994);€òòState€v.€Hicksóó,€868€S.W.2d€œ729,€732›€(Tenn.€Crim.€App.€1993).€€ÏAlthough€there€was€testimony€that€there€were€two€(2)€bystanders€on€the€street€withÏthe€officer,€the€proof€failed€to€establish€that€they€were€at€risk€for€bodily€injury€as€aÏresult€of€the€appellantððs€conduct.€€€ÌHowever,€as€the€state€correctly€points€out€in€its€brief,€the€evidence€at€theÏsentencing€hearing€established€that€the€appellant€had€a€history€of€criminal€conductÍbeyond€that€necessary€to€establish€the€appropriate€sentencing€range.€€TennesseeÏCode€Annotated€section€40„35„114(1)€provides€that€this€is€a€ground€for€imposing€aÏsentence€above€the€presumed€minimum€sentence.€€Although€not€applied€by€the€trialÏcourt,€we€believe€that€this€factor€standing€alone€supports€a€sentence€of€15€months,€3Ïmonths€over€the€minimum€sentence.ÌAccordingly,€the€judgment€is€affirmed.ÌÌÓÓÌÌÌÌà
