#Z   ` ThesentencingofthisDefendantisgovernedbytheSentencingReform P,"$ Actof1989.ThroughtheenactmentofTennesseeCodeAnnotated4035102,thelegislatureestablishedcertainsentencingprincipleswhichincludethefollowing:Ӝ8 `  (5)Inrecognitionthatstateprisoncapacitiesandthefundstobuildandmaintainthemarelimited,convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincing 6-/` !` ! 8 ` failureofpasteffortsatrehabilitationshallbegivenfirstpriorityregardingsentencinginvolvingincarceration; ` !` ! МTenn.CodeAnn.4035102(5).̛ ` TheDefendantwasconvictedofaClassCfelonywhichcarrieswithitthestatutorypresumptionthatheisafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.EventhoughaClassCfelonymaybequiteaseriousoffense,thelegislaturehasprovidedthatthereisapresumptionofeligibilityforalternativesentencingoptionsforallClassCfelonies.Also,theprinciplesofsentencingreflectthatthesentenceshouldbenogreaterthanthatdeservedfortheoffensecommittedandshouldbetheleastseveremeasurenecessarytoachievethepurposesforwhichthesentenceisimposed.Tenn.CodeAnn.4035103(2),(4).ThecourtshouldalsoconsiderthepotentialforrehabilitationortreatmentoftheDefendantindeterminingthesentencealternative.Tenn.CodeAnn.4035103(5).#  Z #Z  ԛ "0  ` Atthetimeofthesentencinghearing,theDefendantwastwentyfouryearsoldandmarried.Hedroppedoutofhighschoolduringthetenthgrade.Hehadonechildbyapriormarriage,andhewasprovidingsomesupportforthischild.Hehadheldavarietyofjobsandhadapparentlybeenapparentlyregularlyemployedsincethetimehedroppedoutofschool.Atthetimeoftheaccidentwhichledtohisconvictionforvehicularhomicide,hehadnohistoryofcriminalconvictions,althoughheadmittedtoahistoryofalcoholusagewhileunderageandalsotoahistoryofsomemarijuanausage. ` IndeterminingthattheStatehadpresentedsufficientevidencetoovercomethepresumptionthattheDefendantwasafavorablecandidatefor 9p02 alternativesentencingoptions,thetrialjudgenotedtheDefendantshistoryofillegaldrugusage,observedthattheDefendanthadbeenuntruthfultothepoliceofficersshortlyaftertheaccidentoccurred,andexpressedhisopinionthatconfinementwasnecessarytoavoiddepreciatingtheseriousnessoftheoffenseandtoprovideforprovidingdeterrence.Beyondtheseconcerns,however,itisobviousfromthisrecordthatthetrialjudgewasconcernedprimarilywiththeDefendantsconductsubsequenttotheaccidentwhichcausedthedeathofthevictim.    ` ThevehicularhomicideoccurredonFebruary26,1995.TheDefendantwasfoundguiltyofaDUIwhichoccurredonApril25,1996.WhileonprobationfortheDUIconvictionhewasfoundguiltyofdrivingonarevokedlicenseonJune15,1996andagainonFebruary19,1997.AtthesentencinghearinginOctoberof1998,awitnesstestifiedthatshehadobservedtheDefendantdriving,againwithhislicenserevoked,inJulyof1998.WebelievethattheseactionsbytheDefendant,whichobviouslyreflectadverselyontheDefendantspotentialforrehabilitation,weighheavilyinfavorofupholdingthepresumptivelycorrectdiscretionexercisedbythetrialjudgeinthiscase.
