OnoraboutMarch17,1981,thepetitionerwasconvictedofseconddegreemurderandsentencedtoatermofninetynineyears.Asubsequentconvictionofjailescaperesultedinaconsecutiveoneyearsentence.Theconvictionforseconddegreemurderwasaffirmedondirectappeal.Statev.JerryD.Saulmon,No.81203III(Tenn.Crim.App.,atNashville,May8,1982).ThesupremecourtdeniedpermissiontoappealonJuly12,1982.  Later,apetitionforpostconvictionreliefwasdenied.Thiscourtaffirmedondirectappeal.JerryD.Saulmonv.State,No.86128III(Tenn.Crim.App.,atNashville,Mar.31,1987).ApplicationforpermissiontoappealtothesupremecourtwasdeniedonJune8,1987.  Inthispetitionforwritofhabeascorpus,thepetitionermaintainsthattheseconddegreemurderconvictionisvoidandthatheshouldbereleasedfromcustody.Thepetitionerassertsthatthetrialjudgeviolatedtheconstitutionintheinstructionstothejuryonthedefinitionofreasonabledoubt;hecontendsthattheuseofsuchtermsas"moralcertainty"and"aninabilitytoletthemindresteasilyastothecertaintyofguilt"servedtorelievethestateofitsburdentoproveguiltbeyondareasonabledoubt.SeeSullivanv.Louisiana,113S.Ct.2078(1993);Cagev.Louisiana,111S.Ct.328(1990).  Ifthepetitionerhadbeenfoundguiltyonastandardbelowthatofareasonabledoubt,thatwouldqualifyasaconstitutionalviolationandrenderthejudgmentvoidable.ConstitutionalviolationsmustbeaddressedunderthePostConvictionProcedureAct.Thepetitioner'sconvictionwasfinalpriortoJuly1,1986;therefore,apostconvictionpetitionhadtobefiledwithinthreeyearsofthatdateinorderforthepetitionertobeeligibleforrelief.Abstonv.State,749S.W.2d487(Tenn.Crim.App.1988).  Thehabeascorpusremedyinthisstateislimited.Thewritmaybegrantedonlywhereapetitionerhasestablishedlackofjurisdictionfortheorderofconfinementorthatheisotherwiseentitledtoimmediatereleasebecauseoftheexpirationofhissentence.SeeUsseryv.Avery,432S.W.2d656(Tenn.1968);State,exrelWadev.Norvell,443S.W.2d839(Tenn.Crim.App.1969).Habeascorpushasnostatutoryperiodoflimitations.Yetthepetitionerhasfailedtoassertanygroundswhichwouldentitlehimtohabeascorpusrelief.Archerv.State,851S.W.2d157(Tenn.1993);Pottsv.State,833S.W.2d60(Tenn.1992).Inourview,thetrialcourtproperlyruledthatreliefwasnotwarranted.  Whenapetitionerattemptstosetasideaconvictionbecauseoftheabridgementofaconstitutionalright,thePostConvictionProcedureActmustbeutilized.Luttrellv.State,644S.W.2d408(Tenn.Crim.App.1982).Habeascorpusisnotaviablealternative.  Ofequalimportanceisthattheuseoftheterm"moralcertainty"inconjunctionwiththereasonabledoubtstandardhasnotbeenconsideredasconstitutionalerrorsolongasthetermisnotusedinconnectionwithotherqualifyingphrasessuchas"substantial"or"grave."Statev.Hallock,875S.W.2d285(Tenn.Crim.App.1993);Statev.GaryLeeBlank,No.01C019105CC00139(Tenn.Crim.App.,atNashville,Feb.26,1992).Inpropercontext,theinstructionutilizedinthepetitioner'strialdidnotviolatehisrighttodueprocess.So,evenifthepostconvictionremedyhadbeenavailable,thepetitionerwouldnothavebeenentitledtoafavorablejudgment.
