TheDefendantpresentstwoissuesforreview:(1)Thattheevidencepresentedattrialwasinsufficienttosupporttheverdictofguilt,and(2)thatthetrialcourterredindenyingtheDefendantsmotionforamistrialaftertheStateswitnessesreferredtoothercrimescommittedbytheDefendant. OnJune19,1993,PrincellaTurner,aprostitute,wasconcludinga transactionwhensheexitedacaronthecornerofWoodbineandKerr,inMemphis.Agroupofmenfromtheneighborhoodweresittingunderatreenearthecorner.Shewasapproachedbyoneofthemen,whomsheknewas Frenchie.Sheidentified FrenchieastheDefendant.Hedemandedhermoneyandbegantohitherontheheadwithhisfist.Whenshewouldnotsurrenderthemoney,theDefendanthitherontheheadwithaquartsizedbeerbottle.Ms.Turnerrelinquishedthetwentydollarsshehadinherhand.TheDefendantrejoinedthegroupofmen,lookedbackatMs.Turnerandyelledthatsheshouldhavehadmoremoney.TheDefendantthenwalkeddownWoodbine. Ms.Turnerwenttoapaytelephoneandcalledthepolice.Officersrespondingtothecallinvestigatedandsearchedthearea,butdidnotlocatetheDefendant.OnJune22,Ms.TurnertelephonedthepoliceandreportedseeingtheDefendantonJamesStreet.ThepolicearrestedtheDefendant,whogaveanalias.TheylaterestablishedhistruenametobeFrenchSeldon,or Frenchie.ThepolicebroughthimtotheLittleGunMotel,whereMs.TurneridentifiedtheDefendantasherassailant.  AttheconclusionoftheStatesproof,thedefensemovedforajudgmentofacquittal.Themotionwasdeniedbythetrialcourt.DefensecounselalsorequestedthatthetrialcourtdeclareamistrialbecausetheStateswitnesseshadalludedtoothercrimescommittedbytheDefendantandthat,despitethecourtscurativeinstructions,thisprejudicedtheDefendant.Thetrialcourtdeniedtherequest.Thedefenseofferednoproof. TheDefendantfirstarguesthattheevidencesubmittedattrialwasinsufficienttoconvicthimofAggravatedRobberybeyondareasonabledoubt.Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,thestandardiswhether,afterreviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307,319(1979).Questionsconcerningthecredibilityofthewitnesses,theweightandvaluetobegiventheevidence,aswellasallfactualissuesraisedbytheevidence,areresolvedbythetrieroffact,notthiscourt.Statev.Pappas,754S.W.2d620,623(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1987).Normaythiscourtreweighorreevaluatetheevidence.Statev.Cabbage,571S.W.2d832,835(Tenn.1978). AjuryverdictapprovedbythetrialjudgeaccreditstheStateswitnessesandresolvesallconflictsinfavoroftheState.Statev.Grace,493S.W.2d474,476(Tenn.1973).Onappeal,theStateisentitledtothestrongestlegitimateviewoftheevidenceandallinferencestherefrom.Cabbage,571S.W.2dat835.Becauseaverdictofguiltremovesthepresumptionofinnocenceandreplacesitwithapresumptionofguilt,theaccusedhastheburdeninthiscourtofillustratingwhytheevidenceisinsufficienttosupporttheverdictreturnedbythetrieroffact.Statev.Tuggle,639S.W.2d913,914(Tenn.1982);Grace,493S.W.2dat476.  TheDefendantdoesnotchallengethesufficiencyoftheevidencetosupportalltheelementsofaggravatedrobbery.Rather,hearguesthatthetestimonyofthevictim,PrincellaTurner,issountrustworthythatitshouldnotsupportaguiltyverdict.DefendantbasesthisassertiononthefactthatMs.Turnerisaprostituteandthatherviolationofthelawnegateshercredibility.  Assessingthecredibilityofwitnessesistheprovinceofthejuryandsuchissuesareproperlyresolvedbythetrieroffact.Pappas,754S.W.2dat623.Evidencethatawitnessisaprostitute,standingalone,isnotsufficienttodiscreditthewitnesstestimonyinordertodisturbajuryverdict.SeeStatev.WillieC.Carpenter,No.1197,HamiltonCounty,slip.op.at5(Tenn.Crim.App.,Knoxville,May1,1991);Statev.Boyd,797S.W.2d589,593(Tenn.1990);Johnsonv.State,598S.W.2d803,805(Tenn.Crim.App.),perm.toappealdenied,id.(1980). TheDefendanthasofferednoilluminationofthefactsthatdemonstrateswhythejurycouldnothaveconvictedtheDefendantofaggravatedrobberybeyondareasonabledoubt.AstheDefendanthasnotmetthisburden,thisissueiswithoutmerit. TheDefendantfurtherarguesthatthetrialcourterredbynotgrantingamistrialbecausetheStateswitnessesalludedtoothercrimescommittedbytheDefendant.HecontendsthathewasprejudicedbythestatementsofMs.TurnerandOfficerWillieMiles,whomadethearrest.  Itiswithinthediscretionofthetrialcourttoassesswhetheranoccurrenceduringthetrialjustifiestheentryofamistrial.Statev.McPherson,882S.W.2d365,370(Tenn.Crim.App.),perm.toappealdenied,id.(1994).Theentryofamistrialisappropriatewhenamiscarriageofjusticewilloccurifthetrialcontinues.Id.Absentaclearabuseofdiscretiononthefaceoftherecord,thisCourtwillnotdisturbthedecisionofthetrialcourt.Id.;Statev.Jones,802S.W.2d221,222(Tenn.Crim.App.1990),perm.toappealdismissed,id.(1991).  First,theDefendantnotesthatoncrossexamination,Ms.Turnerwasaskedwhethershegavethepoliceadescriptionoftherobber.Shewasunresponsiveandstatedthatadescriptionwasnotnecessarybecause thepolicealreadyknowhimbecausehesknownintheneighborhoodfordoing...whathedidtome,referringtotheDefendant.Atthispoint,defensecounseldidnotobject,nordidcounselrequestacurativeinstruction. Failuretomakeacontemporaneousobjectionwaivesconsiderationbythiscourtoftheissueonappeal.SeeT.R.A.P.36(a);Teaguev.State,772S.W.2d915,926(Tenn.Crim.App.1988);perm.toappealdenied,id.(Tenn.1989).Statev.Killebrew,760S.W.2d228,235(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1988).Furthermore,apartywhoparticipatesinorinviteserrorisnotentitledtorelief.T.R.A.P.36(a).Therefore,thisissueiswaived. Second,theDefendantcitestwostatementsmadebytheStateswitness,OfficerMiles,towhichdefensecounselobjectedandreceivedcurativeinstructionsbythetrialcourt.Ondirectexamination,thewitnessstatedthatMs.Turnertoldhimshehadbeenrobbedby aparticularguywhohadbeenrobbingseveralwomen.Oncrossexamination,thewitness,whenaskedwhetherhehadlocatedotherwitnessestotherobbery,answered: NonethatIrecall.Therewereothervictims....  ThetrialjudgedidnotabusehisdiscretionindenyingDefendantsmotionforamistrial.Thereisnoevidenceintherecordthatsuggeststheprosecutiondeliberatelyelicitedtheunresponsiveanswerofthewitness.Thetrialcourtimmediatelyissuedcurativeinstructionstothejurytodisregardbothstatements.Thisissufficienttocuretheerror.SeeStatev.Walker,910S.W.2d381,39697(Tenn.1995);Jones,802S.W.2dat22223.Ajuryispresumedtohavefollowedthecurativeinstructions.Walker,910S.W.2dat397.Accordingly,thisissueiswithoutmerit.
