FACTS    Theappellee'shomewassearchedpursuanttoawarrant.ThepoliceconfiscatedtenDilaudidpillsand$124.50.Theseizedmoneywasstoredinajarandconsistedmainlyofcoins.TheappelleewasservedwithanoticeofseizureonApril3,1995.Thenoticeadvisedthatshehad30dayswithinwhichtofileaclaimifsheintendedtocontestforfeitureofthemoney.Theappellee,however,chosenottofileaclaim.ThepropertywassubjectedtoadministrativeforfeiturebythestateonJuly12,1995. OnMay15,1995,thegrandjuryreturnedatruebillofindictmentagainsttheappelleeforpossessionofDilaudidwithintenttodeliver.Theappelleemovedtodismissthecriminalindictmentarguingthatfurthercriminalprosecutionwouldviolatetheprinciplesofdoublejeopardy.Thetrialcourtfoundthattheappelleehadpreviouslybeenpunishedbytheforfeiture.Thecourtdismissedtheindictmentasconstitutingmultiplepunishmentsforthesameoffense.  ANALYSISANDHOLDING    TheappelleeconcedesthatshewasprovidednoticeoftheforfeitureϜproceedings.She,however,electedtoneitherfileaclaimnorenteranappearancetocontesttheforfeiture.Accordingly,wemustdecidewhetheranontrialadministrativeforfeitureconstitutespunishmentwhichwouldoperatetobarsubsequentcriminalsanctions.̜ Apartyassertingdoublejeopardymusthavebeenapartytoapriorproceeding.UnitedStatesv.Schinnell,80F.3d1064,1068(5thCir.1996);UnitedStatesv.Torres,28F.3d1463,1465(7thCir.1994).Toattainpartystatusinacivilforfeiture,onemust,attheveryleast,fileaclaiminresponsetothenoticeofseizure.SeeUnitedStatesv.Walsh,873F.Supp.334,33637(D.Ariz.1994)(citingTorresforpropositionthatjeopardydidnotattachtoforfeitureproceedingwheredefendantdidnotmakeanyclaimincivilforfeitureproceeding).
