InOctober1997,thepolicewereinpursuitofEricCollinsonanunrelatedcharge.Collinsrushedinto_Ptosha_ԀSims)s)apartmentwiththepolicebehindhim.Onceintheapartment,thepolicesawmarijuanaandcrackcocaineonatable.SimsandWatsonwereintheapartment.Theywerearrestedandchargedwithunlawfulpossessionofcontrolledsubstanceswiththeintenttosellanddeliver.Thedefendantspleadedguiltytounlawfulpossessionofacontrolledsubstancewiththeintenttosellandtosolicitationtocommitafelony,namely,unlawfulpossessionofcocainewiththeintenttosell.Duringthesentencinghearing,thedefendantsrequestedasuspendedsentence.Thetrialcourtsentencedeachdefendanttoincarcerationforoneyearwitha$2000fineforeachoffense.Thetrialcourtallowedthesentencestobeservedwithincarcerationfromthesentencingdate,October29,untiltheendoftheyear(63days),followedbyoneyearofprobation.Thedefendantsappealedthesentencingdetermination.
