OfficerT.MichaelCheavestestifiedthathearrivedatthescenetostarttheinitialinvestigation.Therewerenofingerprintsfoundatthesceneofthecrime.HecheckedthelicensenumberontheMercuryCapriparkedinthechurchlot,andthelicensenumberbelongedtothedefendant. Severalwitnessestestifiedforthedefense.AngieUnderwoodtestifiedthatthedefendanthadspentthenightatherresidencewithherfourchildren.HehelpedherchildrengetreadyforschoolthemorningofNovember29,1995.Thedefendantleftherresidencearound8:30a.m.AllenHouser,abrickmason,testifiedthatthedefendantarrivedattheirjobsitearound9a.m.Theywaitedformaterialstoarrive,butthematerialsdidnotarrivethatday.Everyoneatthejobsite,includingthedefendant,leftaround9:30a.m.CarolGriffin,anemployeeatthePopNGo,sawthedefendantusingthepayphoneoutsidethestoreafewminutesafter10:00a.m. Thedefendanttestifiedthat,aftermakingphonecallsatthepayphoneoutsidethePopNGo,hedrovetothechurchparkinglotto killtime.Heexitedhiscartosmokeacigarette,andhenoticedthewindowpanewasmissing.  :04 Heheardanoisecomingfrominsidethechurch,andheenteredthechurchthroughthewindowtoinvestigate.Asheenteredthechurch,hesawblindsonthefloornearthewindowandaradio.Thedefendantwalkedupthestairsnoticingatypewritersittingonthefloor.Hetestifiedthatheneverenteredanoffice.Padgettopenedthedoorandpointedagunathim.
