X  BACKGROUND    `  ooThesubmittedrecordincludesatranscript,whichcomprisesooootestimonyofthedefendantandtwowitnesses,testimonyofacodefendantsentencedatthesamehearing,andthetrialcourtsfindings. `  Thefirstwitness,LatonyaFlenoy,testifiedthatshewasthedefendantsgirlfriend.AccordingtoFlenoy,thedefendanthadnoregularemployer.However,variouspersonswouldcallhimfor handymanjobs,andsheclaimedthatheworkedapproximatelythirtyhoursperweekonthesejobs. `  Thedefendantsmother,ChristineDeniseWilliams,essentiallytestifiedthatshewouldhelphersonsucceedinCommunityCorrections.WilliamsisaDirectorofOperationswithShoneysInc.andpromisedtohelphersonobtainajob.Shecandidlystatedoothatooooshewouldnotsupportoohimooooifhecontinuedpursuingcriminalactivities.Shewould,however,devoteherselftohelpingthedefendantoowithootheconsequencesofhiscurrentooconvictions.oooo `  ThedefendantguaranteedhiscompliancewithanyrestrictionsimposedunderaCommunityCorrectionssentence.Oncrossexamination,whenasked  :38 thenameofhiscocainesource,thedefendantreplied, Well,see,Ididntknowhisname.Hiscounselobtainedabriefrecess,conferredwithhisdefendant,andcrossexaminationresumed. `  Thestatepursuedthesourcesidentity,andthedefendantassertedthathissource,GaryDouglas,haddied.Thedefendantsfurthertestimonyonthispointwasnotenlightening.ooThedefendanthadonlyknownDouglas acoupleofmonths,#tXX#XXtyetDouglasoooowouldadvanceoohimatooooleastoneandonehalfouncesof   oococaineoo.TheoooodefendantfirsttestifiedthathedidnotknowuDouglasuuuuDouglassuaccomplicesandneversawhimwithotherpeople.However,thedefendantsubsequentlydescribedabusynightcluboosceneoooowhereheooapparentlymetandassumedlycultivatedsomerelationshipwithDouglas.ooTheoodefendantoovaguelydescribedoothemechanicsoftheoointeraction:ooooTheywere alloointheooclub...minglingooandtalking. XInshort,thedefendantclaimedapaucityofknowledgeregardingϜuDouglasuuDouglassubusiness,statingthathe didntknowmuchaboutitand didntknowmuchabout[Douglas].IgnorantooastooouDouglasuuDouglassuresidence,thedefendanthadcontactedhimthroughapagernumber.RegardingthedefendantsrelationshipwithcodefendantBeverlyD.Ray,thedefendanttestifiedthatheprovideddrugs [m]aybetwomaybetwoorthreetimestoRaybeforethethreetransactionsleadingtohisconvictions.Duringthefinalandlargesttransaction,twomalesubjectsinavehiclefollowedthedefendantfromonelocationtoanother,apparentlyconductingcountersurveillance.Thedefendantnoticedthesubjects ridingaroundintheareabutdeniedanyfurtherknowledgeofthem. X9P28 Afterthedefendanttestified,thetrialcourtcommentedthatthedefendantwascoveringforaccomplicesandprotectinginvolvedparties,includingtheapparentcountersurveillance.Thetrialcourtcouldnotanticipatea straightanswerfromthedefendant.TherecordcomprisescodefendantBeverlyD.Rayssentencinghearingtestimony.Shetestifiedthatshenotonlyobtainedthedrugsforthethreesalesfromthedefendantbutalsohadobtaineddrugsforherpersonalusepriortothetransactions.ooBeforethesetransactions,sheoohadseenthedefendantwithdrugsandknewhewasaoodealer.ooAccordingtoRay,thedefendantcouldhaveprovidedoothetwoooouncesofoococaineoosheoriginallyanticipateddeliveringinthethirdtransaction.Attheconclusionoftheoohearings,oothetrialcourtassessedthedefendantasaRangeIoffenderandfoundneitherenhancingnormitigatingfactors.Atasubsequentproceeding,thetrialoocourtdeniedooCommunityCorrectionsq,findingqooqthatqooqthedefendantsconvictionsbarredqooqalternativeqooqsentencing,includingCommunityCorrections,asamatteroflawq.#tXXN#ԛ !  X  XXt ANALYSIS#tXX%#  %"   XXXtThedefendantoo#tXX%&#XXtassertsooonlyoothatoothetrialcourtabuseditsdiscretionby '| $ denyingCommunityCorrections.Whenanaccusedchallengesthelengthormannerofserviceofasentence,thisCourtreviewstherecorddenovo withapresumptionthatthedeterminationsmadebythecourtfromwhichtheappealistakenarecorrect.Tenn.CodeAnn.4035401(d).Thepresumptionofcorrectnessiscontingentontherecordindicatingboththelowercourtsreasonsforarrivingatasentencingdecisionandcompliancewiththestatutorysentencingguidelinesandprinciples.SeeStatev.Wilkerson,905S.W.2d933, 4-2 934(Tenn.1995).Theappellantbearstheburdenofshowingthatthesentencingwasimproper.SeeTenn.CodeAnn.4035401(d)sentencing 706 commncmts;Statev.Jernigan,929S.W.2d391,395(Tenn.Crim.App.1996). |9t28 Thefollowingconsiderationsapply:(1)theevidencereceivedattrialandatthesentencinghearing;(2)thepresentencereport;(3)theprinciplesofsentencingandargumentsastosentencingalternatives;(4)thenatureandcharacteristicsofthecriminalconductinvolved;(5)anystatutorymitigatingorenhancementfactors;(6)anystatementmadebytheaccusedonhisownbehalf;and(7)thepotentialorlackofpotentialforrehabilitationortreatment.SeeTenn.Code   Ann.oo4035102,103,210;ooStatev.Smith,735S.W.2d859,863(Tenn.   Crim.App.1987).TheestablishedcriteriaforsentencingtoCommunityCorrectionsareasfollows: 4 XH X,DXLXD X,DXLXH(1) Personswho,withoutthisoption,wouldbeincarceratedina   correctionalinstitution;LD X,DXLX X,DXLX-L(2) Personswhoareconvictedofpropertyrelated,ordrug/alcohol   relatedfelonyoffensesorotherfelonyoffensesnotinvolving crimesagainstthepersonasprovidedintitle39,chapter13, parts15;(3)Personswhoareconvictedofnonviolentfelonyoffenses;(4)Personswhoareconvictedoffelonyoffensesinwhichtheuse orpossessionofaweaponwasnotinvolved;(5) Personswhodonotdemonstrateapresentorpastpatternof "  behaviorindicatingviolence;(6)Personswhodonotdemonstrateapatternofcommitting violentoffenses4 Tenn.CodeAnn.4036106(a). XEvenifthedefendantmerertsssthesecriteria,eligibilityforCommunityCorrectionsdoesnotmandatethatalternativesentencing.CommunityCorrectionsisa communitybasedalternative tt []toooincarceration.ooTenn.Code .', Ann.4036103(1)(emphasisooprovided).ooRelevantprovisionsoftheCriminalSentencingReformActgovernapplicationofalternativesentencing,includingCommunityCorrections.ooSeeoouuStateoov.Ashby,823S.W.2d166(Tenn.1991)(On 3,2 reviewinganappealfromdeniedCommunityCorrections,theTennesseeSupremeCourtappliedthestatuteforthattimeperiodregardingprobation.). X9P28 Therefore, [i]nreviewingatrialcourtsdenialofanalternativesentence,wemustfirstdeterminewhethertheappellantisentitledtothestatutorypresumptionthatheisafavorablecandidateforalternativesentencing.Statev.   Zeolia,928S.W.2d457,461(Tenn.Crim.App.1996).Thedefendant,convicted l d ofthreeClassBfelonies,isnot presumedtobeafavorablecandidateforalternativesentencingoptions.Tenn.CodeAnn.4035102(b).Further,thetrialcourtfoundthatthedefendantstestimonylackedcandorandtruthfulness.
