Havingreviewedthestatesmotioninlightofthepetitionersbriefandresponse,andtherecordasawhole,weconcludethatthemotioniswelltakenandshouldbegranted.Indenyingthepetition,thetrialcourtfoundthatthepetitionerhadfailedtoshow uponthefaceofthejudgmentortherecordthattheproceedingsuponwhichthejudgment[was]renderedthat[the]convictingcourtwaswithoutjurisdictionorauthoritytosentence[thepetitioner]orthat[thepetitioners]sentenceofimprisonmentorotherrestrainthasexpired.SeeStatev.Archer,851S.W.2d157(Tenn.1993).  Weagreewiththetrialcourtsruling.Theconvictingcourtinthiscasehadjurisdictionoverboththesubjectmatterandperson,andnothingintherecordbeforeusdemonstratesthattheconvictingcourtsactionswereunauthorized.Norhasthepetitionershownthathissentencehasexpired.Accordingly,evenifthepetitionersclaimhasmerit,suchclaimrendersthejudgmentvoidable,notvoid,anditmaynotbecollaterallyattackedinasuitforhabeascorpusrelief.Passarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994).However,thisstateshabitualcriminalacthasbeendeclaredtobeconstitutionalinseveralcasesinvolvingthisveryissue.Seee.g.Pearsonv.State,521S.W.2d225(Tenn.1975);Morelockv.State,454S.W.2d189(Tenn.Crim.App.1970).Thecourtbelowthereforecorrectlydeniedthepetitionertherequestedhabeascorpusrelief.  Accordingly,havingreviewedtheentirerecordinlightofthepetitionersclaims,wecannotfindanyerrorcommittedbythetrialcourtindenyingthepetition.ItisthereforeORDEREDthatthestatesmotionisgranted.PursuanttoRule20oftheRulesoftheCourtofCriminalAppeals,weaffirmthetrialcourtsdenialofthepetitionerspetitionforwritofhabeascorpus.Costsofthisappealshallbeassessedagainstthepetitioner.
