Theofficersaskedforpermissiontosearch.Thedefendantrefused,sotheyobtainedasearchwarrant,conductedasearchandfoundthemarijuanaanddrugparaphernaliawhichgaverisetotheprosecution. Thetrialjudgegrantedthedefendantsmotiontosuppress.Withoutfurtherelaboration,hefoundthat thesearchwasbad.̜ BoththeStateandthedefendantrelyonStatev.Clark,844S.W.2d597,599(Tenn.1992)inwhichofficersenteredthedefendantsapartmentwithoutpermissionandlaterobtainedasearchwarrantbasedontheirobservationofcontrabandduringtheirnonconsensualentry. Inthiscase,theofficershadthedefendantsconsenttoenterhisportionoftheduplex.Therefore,theywerelawfullyonthepremises.Basedonthemarijuanaroachtheyobservedfromtheirlegalvantagepoint,theycertainlyhadreasonablegroundstobelievethatacrimewasbeingcommitted,justifyingtheultimateissuanceofthesearchwarrant.
