Asst.DistrictAttorneyGeneral       363CourtSt.         Maryville,TN37804                   OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY, Judgeǜ `   @ OPINION   Afterajurytrial,thepetitionerwasconvictedofaggravatedassault,Ϝseconddegreeburglarywhilepossessingafirearm,andtwocountsofaggravatedϜkidnapping.Hisconvictionswereaffirmedondirectappeal.Hepetitionedforpostconvictionreliefallegingthathisindictmentwasmultiplicitousandthereforeinviolationofhisconstitutionalrightsagainstdoublejeopardy,andthathehadreceivedineffectiveassistanceofcounsel.Afterahearing,thecourtbelowdeniedrelief.Weaffirm.  Thepetitionercontendsthathisconstitutionalrightsagainstdoublejeopardywereviolatedbecausetheindictmentagainsthimchargedmultiplecountsforhiscommissionoftheaggravatedkidnappingandaggravatedassaultoffenses.Specifically,thepetitionerwaschargedwithaggravatedkidnappingagainsteachoftwovictimsandaggravatedassaultagainstoneofthesevictims.Eachofthecrimeswasallegedtohaveoccurredintwoways.CountoneoftheindictmentchargedthatthepetitionerkidnappedScottButlerwhilehe(thepetitioner)wasarmedwithadeadlyweapon.CounttwoallegedthatButler'skidnappingwasdoneforthepurposeofobtainingransom.BothofthesecountswerealternativemethodsofchargingaggravatedkidnappingpursuanttoT.C.A.392301(1988Supp). 0   ׀CountthreeallegedthatthepetitionerassaultedButlerwhiledisplayingadeadlyweapon;countfourallegedthatheassaultedButlercausingseriousbodilyinjury.ThesetwocountswerealternativemethodsofchargingaggravatedassaultpursuanttoT.C.A.392101(1988Supp).CountssixandsevenallegedthesamealternativeoffensesofaggravatedkidnappingagainstMichaelKeeble.  Thismethodofchargingthepetitionerdidnotsubjecthimtodoublejeopardy.Ourstateandfederalconstitutionsprotectapersonfrombeingprosecutedasecondtimeforthesameoffenseafteracquittalorconviction,andfrombeingpunishedmultipletimesforthesameoffense.Statev.Mounce,859S.W.2d319,321(Tenn.1993).Here,thepetitionerwasconvictedofonechargeofaggravatedkidnappingagainstButler,onechargeofaggravatedassaultagainstButler,andonechargeofaggravatedkidnappingagainstKeeble 1   כ.Hehasnotbeenprosecutedtwiceforanyoftheseoffenses,norishesufferingmultiplepunishmentsforthem.Thisissueiswithoutmerit.  Inthecontextofraisinghisdoublejeopardyclaim,thepetitioneralsocomplainsthattheindictmentwasimproperlymultiplicitous.However,hedidnotraisethisissueonhisdirectappeal.Accordingly,itiswaived.T.C.A.4030112(b)(1990).Nor,accordingtothepetitioner'samendedpetitionforpostconvictionrelief,wasitraisedbeforehistrial.Objectionsbasedondefectsintheindictmentmustberaisedpriortotrialortheyarewaived.Tenn.R.Crim.P.12(b)(2).     Inhisnextissue,thepetitionercontendsthathistrialcounselwasineffectiveforfailingtocallaparticularwitnessforthedefense. 2   ׀HefirstraisedthiscontentioninhisdirectappealandthisCourtdeterminedthattherecorddidnotestablishthathisattorney'srepresentationfellbelowtherequiredstandard.Thus,itfoundthisissuetobewithoutmerit.Statev.KennethTeague,No.03C019102CR00053,BlountCounty(Tenn.Crim.App.filedAugust27,1991,atKnoxville).Ithasthereforebeenpreviouslydetermined.T.C.A.4030112(1990).Moreover,thepetitioner'strialcounseltestifiedatthehearingbelowthattherewerestrategicreasonsforhisdecisionnottocallthewitness.ThisCourtshouldnotsecondguesstrialcounselstacticalandstrategicchoicesunlessthosechoiceswereuninformedbecauseofinadequatepreparation,Hellardv.State,629S.W.2d4,9(Tenn.1982),andcounselshouldnotbedeemedtohavebeenineffectivemerelybecauseadifferentprocedureorstrategymighthaveproducedadifferentresult.Williamsv.State,599S.W.2d276,280(Tenn.Crim.App.1980).  Thecourtbelowfoundthattheevidencedidnotsupportthepetitioner'sclaimofineffectiveassistanceofcounsel.
