Memphis,TN38103                   OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY, Judge  @ OPINION     Thedefendantwasindictedformultiplecountsofsellingcocaine,possessingcocainewiththeintenttodeliver,andpossessingcocainewiththeintenttosell.Hepledguiltytofourcountsofsellingover.5gramsofcocaineandacceptedanagreedsentenceofeightyearsoneachcount,torunconcurrently,witha$2,000fineoneachcount.HewasdesignatedaRangeIstandardoffender.Theonlyissuelefttothesentencingcourtwaswhethertograntprobationorsomeotherformofalternativesentence.Thecourtbelowdeniedanyformofalternativesentence.Inthisappealasofright,thedefendantchallengesthatdenial.Afterareviewoftherecord,weaffirmthejudgmentbelow.  Whenadefendantcomplainsofhisorhersentence,wemustconductadenovoreviewwithapresumptionofcorrectness.T.C.A.4035401(d).Theburdenofshowingthatthesentenceisimproperisupontheappealingparty.T.C.A.4035401(d)SentencingCommissionComments.Thispresumption,however, isconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).  T.C.A.4035103setsoutsentencingconsiderationswhichareguidelinesfordeterminingwhetherornotadefendantshouldbeincarcerated.Theseincludetheneed toprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct,theneed toavoiddepreciatingtheseriousnessoftheoffense,thedeterminationthat confinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses,orthedeterminationthat measureslessrestrictivethanconfinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothedefendant.T.C.A.4035103(1).  Indeterminingthespecificsentenceandthepossiblecombinationofsentencingalternatives,thecourtshallconsiderthefollowing:(1)anyevidencefromthetrialandsentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandtheargumentsconcerningsentencingalternatives,(4)thenatureandcharacteristicsoftheoffense,(5)informationofferedbytheStateorthedefendantconcerningenhancingandmitigatingfactorsasfoundinT.C.A.4035113and114,and(6)thedefendantsstatementsinhisorherownbehalfconcerningsentencing.T.C.A.4035210(b).Inaddition,thelegislatureestablishedcertainsentencingprincipleswhichincludethefollowing: D      (5)Inrecognitionthatstateprisoncapacitiesandthefundstobuildandmaintainthemarelimited,convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincingfailureofpasteffortsatrehabilitationshallbegivenfirstpriorityregardingsentencinginvolvingincarceration;and(6)Adefendantwhodoesnotfallwithintheparametersofsubdivision(5)andisanespeciallymitigatedorstandardoffenderconvictedofaClassC,DorEfelonyispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.       T.C.A.4035102.  Afterreviewingthestatutessetoutabove,itisobviousthattheintentofthelegislatureistoencouragealternativestoincarcerationincaseswheredefendantsaresentencedasstandardormitigatedoffendersconvictedofC,D,orEfelonies.However,itisalsoclearthatthereisanintenttoincarceratethosedefendantswhosecriminalhistoriesindicateacleardisregardforthelawsandmoralsofsocietyandafailureofpasteffortstorehabilitate.  Inthiscase,thedefendantwasconvictedoffourclassBfelonies,T.C.A.3917417(c)(1),eachhavingoccurredonadifferentday.Whileheisthereforeeligibleforprobation,T.C.A.4035303(a),andcommunitycorrections,T.C.A.4036106(a),heisnotpresumedtobeafavorablecandidateforalternativesentencing.T.C.A.4035102(6).Rather,thedefendanthastheburdenofprovingthatheissuitableforprobation.T.C.A.4035303(b);Statev.Davis,750S.W.2d167,168(Tenn.Crim.App.1988).  Thedefendantadmittedthathehadmadedrugsalesotherthanthoseforwhichhewasarrested.Healsoadmittedthathehadsmokedmarijuanawhilethismatterwaspendingbeforethecourtbelow.Hisrecordofpastcriminalactivityorbehaviorincludedacontemptofjuvenilecourtconvictionfornonsupportandajuvenileoffenseofaggravatedrape.Headmittedthathehadsoldthedrugsinordertomakemoneytopayhisbills,thathiscurrentjobpayedonly$5.00perhour,andthathecouldpayonly$300towardhis$8,000fineatthetimeofthesentencinghearing.Heprofessedregretforhisactionsandassertedthathehadlearnedhislessonandthathewasgoingtostartover.    Indenyingprobation,thecourtbelowconsideredthatthedefendanthadsoldthedrugsformoneyratherthanbecauseofanaddiction;thateachsaleconstituted"adeliberatewillfulintentionalactofsellingahighriskdrugthatcankillyou;hiscriminalhistory;andhissocialhistoryincludingsixchildrenbyseveralwomenandbeingengagedtoanother,allbytheageoftwentysix. 3   ׀Inlightofthesefactors,thecourtbelowfoundasapplicablethesentencingconsiderationssetforthatT.C.A.4035103(1)(A)and(B),towit,thatconfinementwasnecessarytoprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct,andthatitwasnecessarytoavoiddepreciatingtheseriousnessoftheoffense,orthatitwasparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses.T.C.A.4035103(1)(A)and(B).Italsoreliedonspecificdeterrenceindenyinganalternativesentence.  Inmakingitsdecision,thecourtbelowconsideredthesentencingprinciplesandrelevantfactsandcircumstances.Thissentenceisthereforeclothedwiththepresumptionofcorrectness,anditisthedefendantsburdentodemonstratethatitisimproper.This,thedefendanthasnotdone.Thesalesofcocainewereneitheruniquenorextraordinaryforthisdefendant,andcombinedwithhispastcriminalconduct,hisbehaviorindicatesacontinuingdisregardforourlaws.Hisprofessionthathehadlearnedhislessonwasapparentlylessthanconvincingtothecourtbelow.Accordingly,wethinkthedenialofalternativesentencingwasproperinthiscase.
