Afterhishearing,thesentencingcourtdeniedthedefendantanyformofalternativesentencing.Henowappealsthatdecision.  Whenadefendantcomplainsofhisorhersentence,wemustconductadenovoreviewwithapresumptionofcorrectness.T.C.A.4035401(d).Theburdenofshowingthatthesentenceisimproperisupontheappealingparty.T.C.A.4035401(d)SentencingCommissionComments.Thispresumption,however,"isconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991). Allrelevantfactsandcircumstancesincludeanymitigatingandstatutoryenhancementfactors,id.,thepresenceorabsenceofwhichmustbeplacedontherecord.T.C.A.4035210(f)andcommentthereto.  T.C.A.4035103setsoutsentencingconsiderationswhichareguidelinesfordeterminingwhetherornotadefendantshouldbeincarcerated.Theseincludetheneed"toprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct,"theneed"toavoiddepreciatingtheseriousnessoftheoffense,"thedeterminationthat"confinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses,"orthedeterminationthat"measureslessrestrictivethanconfinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothedefendant."T.C.A.4035103(1).Thisstatutealsoprovidesthat thepotentialorlackofpotentialforrehabilitationortreatmentofthedefendantshouldbeconsideredindeterminingthesentencealternativeorlengthofatermtobeimposed,and [t]rialjudgesareencouragedtousealternativestoincarceration.T.C.A.4035103(5),(6).  Indeterminingthespecificsentenceandthepossiblecombinationofsentencingalternatives,thecourtshallconsiderthefollowing:(1)anyevidencefromthetrialandsentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandtheargumentsconcerningsentencingalternatives,(4)thenatureandcharacteristicsoftheoffense,(5)informationofferedbytheStateorthedefendantconcerningenhancingandmitigatingfactorsasfoundinT.C.A.4035113and114,and(6)thedefendant'sstatementsinhisorherownbehalfconcerningsentencing.T.C.A.4035210(b).Inaddition,thelegislatureestablishedcertainsentencingprincipleswhichincludethefollowing:    Ӝ(5)Inrecognitionthatstateprisoncapacitiesandthefundstobuildandmaintainthemarelimited,convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincingfailureofpasteffortsatrehabilitationshallbegivenfirstpriorityregardingsentencinginvolvingincarceration;and(6)Adefendantwhodoesnotfallwithintheparametersofsubdivision(5)andisanespeciallymitigatedorstandardoffenderconvictedofaClassC,DorEfelonyispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.    ҜT.C.A.4035102.  WhilethedefendantisnotentitledtothepresumptionthatheisafavorablecandidateforalternativesentencingbecausehiscocaineconvictionisaClassBfelony,heisstilleligibleforprobation.T.C.A.4035303(a).Moreover,thesentencingcourtwasrequiredtoautomaticallyconsiderprobationforthisdefendant.T.C.A.4035303(b).Theburdenofprovinghissuitabilityforprobationrestswiththedefendant.Id.Itshouldbenoted,however,that,whiletheStateopposedprobationforthisdefendant duetotheseriousnessoftheoffense,itwasamenabletosplitconfinementandsostatedatthesentencinghearing.  Thesentencingcourtmadethefollowingfindingsasitimposeditssentenceonthedefendant(emphasisadded):    [S]aleofcocainecasesareincreas[ing]exponentiallyand...wehaveaseriousprobleminDicksonCountywithregardtothesaleandthepossessionforresaleofcocaine. Thesaleofcocaineisaseriousoffense.Cocaine,obviously,isaveryaddictivedrug,adangerousdrug,anditisbecomingincreasinglyprevalentandmoreofaproblem.Somethinghastobedone.IfnothingelseIamnotaparticularlybigfanofdeterrence,becauseIdontbelievethatthefactthatIputMr.Thompsoninthepenitentiaryisgoingtostopsomebodyelsefromsellingcocaine.Itsjustnotgoingtohappen.Anyonewhothinksthatislivinginafantasyworld.Bythesametoken,ifIputMr.Thompsoninthepenitentiaryforeightyears,itwillstopMr.͐Thompsonfromsellingcocaine,atleastontheoutside.̜TheonlyproofwevehadfromMr.ThompsonisthedefendantsversioninthepresentencereportwhereMr.Parkerstatedthathesaid, IonlysellmarijuanawhenmoneyistightandIneedtomakeendsmeet.Hedidntmention,obviously,thereasonforsellingcocaine.ButtheCourtisoftheopinionthatthisgentlemanisinthepracticeofsellingcontrolledsubstances.̜Therefore,forthereasonoftheseverityoftheoffenseandthenecessityfordeterrence,theCourtisoftheopinionthatMr.ThompsonshouldservehisentiresentenceintheTennesseeStatePenitentiary,andthatallindividualswhocomebeforethisCourtfoundguiltyofpossessionofcocaineforresaleorsaleofcocaine,shouldreceiveasimilarsentence.̜Therefore,therequestforanytypeofsuspensionorsplitconfinementisdenied.Ӝ D   Althoughthedefendanthadfiledanoticeclaimingfourmitigatingfactors,thesentencingcourtmadeabsolutelynofindingswithrespecttomitigating(orenhancing)factors.Thisfailure,combinedwiththesentencingcourtsfailuretoconsiderthedefendantspotentialforrehabilitation,defeatsthepresumptionofcorrectness.  InStatev.DennisRogers,No.01C019102CC00057,HickmanCounty(filedSeptember5,1991,atNashville),thisCourtconsideredtheappealofthetrialcourtsdenialofprobationtoadefendantwhohadreceivedtwoClassCfelonyconvictionsforthesaleofcocaine.Rogerswasathirtyeightyearoldautomobilemechanicwhohadadmittedtopreviouscasualuseofmarijuanaandcocaine.AlthoughheadmittedtoapriorspeedingticketandaremoteD.U.I.,theprobationofficerwasunabletoconfirmeitheroftheseandfoundnoothercriminalrecord.    Thetrialcourtdeniedprobationoutright,stating: 8    AndIhavetakenafirmstanceagainstpeoplewhosellcocaine.Unlessthereissomethingabouttheircasethatwouldoutweighthedeterrentvalueofincarceration,IhaveuniformlymadepeopleservetheirsentencesbecauseIthinkitsimportantthatthiscourtsendsamessagetothecommunitythatifyoudealinthisdruginthiscommunity,youregoingtoserveyoursentence. 8 ̜.... 8   ӜMr.Rogershasagoodpresentencereport,hedoesnthaveanyprioroffenses,buthesdealtinsomethingthatheknewwascausinginjurytootherpeople.SoIwoulddenyasuspendedsentenceinthiscase.̜ D   ThisCourtreversedthetrialjudgesrulingandremandedforresentencing,finding:̜    [O]ncethelegislaturehasspecificallyauthorizedtheuseofsentencingalternative[s]toconfinementforaparticularoffense,trialcourtsmaynotsummarilyimposeadifferentstandardbywhichalternativesentencingisdeniedsolelybecauseofthedefendantsguiltforthatoffense....Inotherwords,ifthelawpermitsandencouragesalternativesentencingforanoffense,itcannotbesummarilyrejectedbyapolicyestablishedbythetrialcourt.̜ D   ӛ  ThedefendantinthiscaseoccupiesapositionsimilartothatofRogers.Hewasthirtythreeatthetimethepresentencereportwaspreparedandworkedforaconcretebusiness.Hisemployertestifiedthatthedefendantwasa verygoodworkerand veryreliableandthathecouldkeephisjobifplacedonanalternativesentence.HedidnotcompletehighschoolbutlatercompletedavocationalcourseatTennesseeTechnologyCenterinDickson.Headmittedtoaremoteconvictionforreceivingandconcealingstolenproperty,buttheprobationofficerwasunabletoverifythisortolocateanypriorjuvenileorcriminalrecord.Hewasingoodhealth,admitteddrinkingbeer,butdeniedthecurrentuseofanyillegaldrugs.Headmittedthathehadusedmarijuanafromageeighteentotwentytwo,andthathesoldmarijuana whenmoneyistight.𛀀TheprobationofficerwhopreparedtheϜpresentencereportincludedastatementthat,ifthedefendantweregrantedprobation, thedefendantwouldbeplacedonmediumsupervision...[and]thisofficerwouldrecommend...200hours[of]publicservicework.Inspiteofableargumentbydefensecounsel,thesentencingcourtinthiscasesummarilyrejectedthedefendantspleaforanalternativesentenceinmuchthesamewaythatthetrialcourtdidinRogers.  AsthisCourtdidinRogers,therefore,wefindthat therecordreflectsthatthetrialcourtdecidedtheissueofalternativesentencingunderapolicyithadestablishedwhichfailedtotakeintoaccountthespecificcriteriaofthe1989SentencingAct.Regardlessofthemerit,orlackthereof,inthiscasetothedefendantsclaimofentitlementtoalternativesentencing,itwashisrightforthetrialcourttoevaluatehiscaseasprovidedbythe1989ActrelativetoClass[B]felonies.Accordingly,aswasdoneinRogers,wereversethelowercourtsdenialofprobationandremandthismatterforresentencingincompliancewiththe1989SentencingAct.Ӝ̛       ______________________________       JOHNH.PEAY,JudgeCONCUR:̜______________________________JOEB.JONES,Judge̜______________________________DAVIDG.HAYES,Judge%
