I.    Thedefendantwasarrestedonthree(3)separateoccasionsin1993and1994fordrivingundertheinfluenceofanintoxicantandwasconvictedthesameyears.Thesecondandthirdconvictionswereadjudicatedonthesameday,althoughcommittedondifferentdays.TheDistrictAttorneyGeneralfiledapetitiontohavethedefendantclassifiedasanHMVO.Ahearingwasheldwherethedefendant,representedbycounsel,admittedthattheconvictionswerevalid.Althoughacknowledgingthevalidityofthethree(3)priorDUIconvictionsin1993and1994,thetrialcourtdeclinedtodeclarethedefendantanHMVOnoting:   ` (1)allthree(3)DUIconvictionsweretreatedasfirstoffensesbytherespectivecourts;and(2)therehabilitativeeffortsandpresentcircumstancesofthedefendantindicatethatanHMVOdeclarationwouldbeinappropriate.    Thestateappealsthisruling.  II.   Habitualoffenderstatusmaybeconferredupononewho,duringathree(3)yearperiod,isconvictedofthree(3)ormoreoftheoffensesenumeratedinTenn.CodeAnn.5510603(2)(A)(Supp.1997).Drivinganautomobileundertheinfluenceofanintoxicant,Tenn.CodeAnn.5510401,isoneofthelistedoffenses.Tenn.CodeAnn.5510603(2)(A)(viii)(Supp.1997).     Tenn.CodeAnn.5510603doesnotallowdiscretioninthetrialcourt.Ifadefendantisfoundtohavebeenvalidlyconvictedoftherequisitenumberofenumeratedoffenseswithintheapplicabletimeperiod,thedefendantwillbedeclaredanHMVO.SeeTenn.CodeAnn.5510613(a).RehabilitationeffortsandthepresentcircumstancesofadefendantareirrelevanttotheHMVOdeclaration.  Thetrialcourterroneouslyconsideredthetwo(2)convictionsadjudicatedonthesamedayasone(1)offense.TheHabitualOffenderActdoesprovidethatoffensescommittedonthesamedaywillcountasoneoffenseforthepurposesofHMVOstatus.Tenn.CodeAnn.5510604(b).Thedefendant,however,wasarrestedfordrivingundertheinfluenceofanintoxicantonthree(3)separateoccasions.ThedatesofadjudicationareofnorelevanceexceptindeterminingtheapplicableperiodinwhichtheconvictionsmustoccurtohaveHMVOstatusconferred.SeeTenn.CodeAnn.5510604(c). Furthermore,thefactthatthepriorconvictionsweretreatedbytherespectivecourtsasfirstoffensesisirrelevant.Habitualoffenderstatussimplyrequiresthree(3)convictionsoftheenumeratedoffenses,committedondifferentdates,withinthethreeyearperiod.SeeTenn.CodeAnn.5510603(2)(A),604(Supp.1997).
