ThisisanappealpursuanttoRule3oftheTennesseeRulesofAppellateProcedure.TheDefendantfiledapetitionseekinghabeascorpusreliefonthegroundsthatTennesseessentencinglawsviolatetheseparationofpowersclauseoftheTennesseeConstitutionandthatthesentencesauthorizedareindeterminateinnatureandthuscontrarytolaw.Thetrialcourtdeniedhabeascorpusrelief.Weaffirmthejudgmentofthetrialcourt. ThepetitionforwritofhabeascorpusallegesthattheDefendantisinthecustodyoftheTennesseeDepartmentofCorrectionasaresultofbeingconvictedoffirstdegreemurderandassaultonMay19,1995,intheCircuitCourtofWilliamsonCounty,Tennessee.ThepetitionallegesthattheDefendantreceivedasentenceoflifeplusfifteenyears. Wefirstnotethatapetitionforwritofhabeascorpusmustcontainacopyofthe legalprocessuponwhichrestraintisbased,orasatisfactoryreasonforitsabsence.Tenn.CodeAnn.2921107(b)(2).Thepetitioninthiscasecontainsneither.Thisomissionalonewouldwarrantthetrialcourtsdismissalofthepetition.Stateexrel.Woodv.Johnson,393S.W.2d135,136(Tenn.1965).Inahabeascorpusproceeding,theburdenofshowingtheinvalidityofthejudgmentofconvictionisuponthepetitioner, andintheabsenceofaproductionofthejudgment,oracopythereof,wemustpresumeitwasandisvalidinallrespects.Stateexrel.Georgev.Bomar,390S.W.2d232,234(Tenn.1965).ItistheAppellantsobligationtohavepreparedanadequaterecordinordertoallowmeaningfulreviewonappeal.Tenn.R.App.P.24(b);Statev.Banes,874S.W.2d73,82(Tenn.Crim.App.1993).Thetrialcourtdidnoterrwhenitdeniedhabeascorpusrelief. Onappeal,theDefendantarguesthatourstatutoryschemeofsentencingviolatestheseparationofpowersclauseoftheStateConstitution.SeeTenn.Const.art.II,1&2.Insentencingadefendant,thetrialjudgemustfirstdeterminetheappropriatesentencingrangewhichdeterminesthereleaseeligibilitypercentage.TheDefendantarguesthatthisjudicialfunctionencroachesuponthepoweroftheexecutivebranchtodetermineaninmatesparoleeligibility.TheDefendantthereforearguesthatweshouldstrikedownourentiresentencingcode.WerejecttheDefendantsargumentbecauseweconcludethatithasnomerit.Somefunctionsofthethreedepartmentsofstategovernmentarenecessarilyoverlappingandinterdependent.Webelievethisisparticularlytrueinourcriminaljusticesystem.SeeLavonv.State,586S.W.2d112,115(Tenn.1979);Underwoodv.State,529S.W.2d45,47(Tenn.1975);Woodsv.State,130Tenn.100,169S.W.558(1914).Accordingly,wedonotbelievethejudicialfunctionofsettingsentencingrangesisanunconstitutionalencroachmentonthepowersoftheexcecutivebranch. TheDefendantfurtherarguesthatthesentencingrangesalongwiththereleaseeligibilitypercentagesestablishindeterminatesentencesinviolationofTennesseeCodeAnnotatedsection4035211,whichprohibitsindeterminatesentences.Wealsorejectthisargumentbecauseweconcludethatithasnomerit.ThefactthattheBoardofParolesmaygrantordenyparoledoesnotconvertadeterminatesentenceintoanindeterminatesentence.Paroledoesnotcauseasentencetoexpireorterminatebutisaconditionalreleasefrommorerestrictiveconfinement.SeeHowellv.State;569S.W.2d428,433(Tenn.1978);Doylev.Hampton,207Tenn.399,403,340S.W.2d891,893(1960).Aparoleeremainsinconstructivecustodyuntiltheexpirationofthefulltermofhisorhersentence.Howell,569S.W.2dat433.
