Afterareviewoftherecord,weaffirmthetrialcourtsjudgment. Theappellantcontendsthatthereasonabledoubtinstructionprovidedbythetrialcourtisconstitutionallyinvalidduetotheuseoftheterm moralcertaintycombinedwiththe mindresteasylanguage.Hearguesthatthesephrasestogethercouldhaveallowedareasonablejurortofindhimguiltybasedonalowerstandardofproofthanthatrequiredforguiltbeyondareasonabledoubt.AlthoughtheTennesseeSupremeCourthasrecentlyheldsuchjurychargestobeconstitutional,theappellantarguesthatthosedecisionsdonotapplytohiscasebecausethecourtdidnotspecificallyaddressthe mindresteasyphrase.SeeStatev.Nichols,877S.W.2d722,734(Tenn.1994)andPettyjohnv.State,885S.W.2d364,365(Tenn.Crim.App.1994).Thisargument,however,iserroneous.InNichols,theTennesseeSupremeCourtheldconstitutionallyvalidaninstructionwhichallowed moralcertaintytobeconsideredinconjunctionwithaninstructionthat [r]easonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyuponthecertaintyofyourverdict,Id.(emphasisadded).Theappellatecourtsofthisstatehaverepeatedlyfoundthisjuryinstructionconstitutionallyvalid.SeeStatev.Sexton,917S.W.2d263,265266(Tenn.Crim.App.1995)andCovingtonv.State,No.01C019606CC00250(Tenn.Crim.App.atNashville,Sept.30,1996).Thisclaimiswithoutmerit.
