Thepetitionercontendsthattheapplicationofthethreeyearstatuteoflimitationstohispetitionresultsinadenialofhisrighttodueprocess.Burfordv.State,845S.W.2d204(Tenn.1992).HearguesthatthesufficiencyoftheevidencetosupporthisconvictionforfirstdegreemurdershouldbereexaminedinlightoftheTennesseeSupremeCourtsdecisioninStatev.Brown,836S.W.2d530(Tenn.Ϝ1992).However,wehaveconsistentlyrefusedtoapplyBrownsholdingsretroactively.̛̜ TherecordreflectsthatthepetitionforpostconvictionreliefwasfiledinthetrialcourtonJanuary4,1993.T.C.A.4030102,effectiveonJuly1,1986,affordedapetitionerthreeyearsfromthedateofthefinalactionofthehigheststateappellatecourtinwhichtofileapostconvictionpetition.IncaseswherethefinalactionoccurredpriortotheeffectivedateofT.C.A.4030102,thepetitionerhadthreeyearsfromtheeffectivedateofthestatuteoflimitationsinwhichtofileanypostconvictionpetition.Thepetitionerfailedtofilehispetitionwithinthreeyearsofthatdateandpresentsnojustcauseforthetollingofthestatuteoflimitations.
