àThe€Defendant,€Clinton€Darrell€Turner,€appeals€as€of€right€his€convictionÏand€sentence€for€DUI.€€Following€a€jury€trial,€the€Defendant€was€convicted€ofÏdriving€a€motor€vehicle€while€under€the€influence€of€€an€intoxicant€and€driving€onÏa€revoked€license€in€the€Cocke€County€œCircuit›€Court.€€The€trial€court€sentencedÏthe€Defendant€to€eleven€(11)€months€and€twenty„nine€(29)€days€on€the€chargeÏof€driving€while€under€the€influence€and€six€months€for€the€charge€of€driving€on€aÏrevoked€license.€€The€sentences€were€ordered€to€be€served€concurrently.€€TheÏtrial€court€suspended€the€entire€sentence€for€the€conviction€of€driving€on€aÏrevoked€license.€€On€the€DUI,€the€Defendant€was€ordered€to€serve€seven€daysÏin€jail€with€the€balance€to€be€served€on€probation.€€In€addition€to€challenging€theÏsufficiency€of€the€evidence,€Defendant€also€argues€the€trial€court€erred€byÏallowing€an€officer€to€testify€as€to€field€sobriety€tests€when€the€officer€was€notÏtrained€to€administer€those€tests.€€The€last€issue€the€Defendant€raises€is€that€theÏtrial€court€erred€by€sentencing€him€to€serve€seven€days€rather€than€the€two€(2)Ïday€minimum€provided€by€law.€€We€affirm€the€judgment€of€the€trial€court.ÌÌà@ àOfficer€Bennie€Shelton€of€the€Cocke€County€Sheriffððs€Department€was€theÏStateððs€only€witness€at€trial.€€The€Defendant€presented€no€proof.€€Officer€SheltonÏtestified€that€on€July€15,€1994€at€1:30€a.m.,€he€was€on€patrol€and€observed€theÏDefendantððs€car€traveling€down€Asheville€Highway.€€The€Defendantððs€carÏheadlights€were€not€on,€and,€while€the€car€was€not€a€convertible,€it€had€no€top.€ÏAfter€Officer€Shelton€pulled€behind€the€vehicle€with€his€blue€lights€on,€theÏDefendant€pulled€over€to€the€side€of€the€road.€€He€approached€the€driverððs€sideÏand€found€the€Defendant€to€have€bloodshot€eyes.€€When€he€asked€DefendantÏfor€his€license,€Officer€Shelton€noticed€that€his€speech€was€somewhat€slurred€inÏresponse.€€€Defendant€failed€to€produce€his€license.€€Shelton€asked€DefendantÏto€get€out€of€his€car,€and€the€Defendant€then€told€him€he€did€not€have€a€license.€ÏWhen€the€Defendant€exited€his€car,€Shelton€observed€that€he€was€walking€off„balance.€€A€computer€check€indicated€that€Defendantððs€license€had€beenÏrevoked.€€ÌÌà àOfficer€Shelton€administered€three€separate€field€sobriety€tests,€includingÏthe€horizontal€gaze€nystagmus,€recitation€of€ABCððs,€and€the€finger€to€nose€tests.€ÏWhile€the€Defendant€did€follow€his€directions,€he€was€unable€to€completelyÏfollow€the€pen€during€the€horizontal€gaze€nystagmus€test€without€moving€hisÏhead.€€During€his€recitation€of€the€ABCððs,€he€left€out€some€letters€and€his€speechÍwas€notably€slurred.€€€When€the€Defendant€tried€to€€perform€the€finger€to€noseÏtest,€he€was€only€able€to€touch€his€top€lip.€€Defendantððs€performance€on€theseÏtests,€in€addition€to€the€smell€of€alcohol€about€the€Defendant,€his€slurred€speech,Ïbloodshot€eyes,€and€driving€with€no€headlights,€indicated€to€Officer€Shelton€thatÏthe€Defendant€was€impaired€by€an€intoxicant.€€Furthermore,€the€Officer€observedÏan€empty€liquor€bottle€in€the€Defendantððs€car,€and€the€Defendant€stated€that€heÏhad€just€left€a€local€bar,€The€Brown€House,€where€he€drank€some€alcoholicÏbeverages.€€Based€upon€all€these€observations,€Officer€Shelton€determined€thatÏDefendant€was€operating€a€motor€vehicle€while€under€the€influence€ofÏintoxicants€and€arrested€him.€€Defendant€subsequently€refused€to€submit€to€aÏbreath€alcohol€test.ÌÌà àOfficer€Shelton€admitted€on€cross„examination€that€he€was€not€formallyÏtrained€in€the€administration€of€the€horizontal€gaze€nystagmus€test€or€the€finger€toÏnose€test.€€He€had€observed€state€troopers€administer€the€horizontal€gazeÏnystagmus€test.€€He€added€that€he€was€aware€of€what€would€be€ð ðnormalðð€in€aÏperformance€of€the€ð ðrecitation€of€ABCðð€test€and€the€ð ðfinger€to€noseðð€test.€€OfficerÏShelton€also€added€that€he€had€made€many€prior€arrests€for€DUI€in€the€previousÏseven€years€service€as€a€law€enforcement€officer.ÌÌà àDefendant€was€convicted€of€driving€while€under€the€influence€of€anÏintoxicant.€€Tenn.€Code€Ann.€ðð€55„10„401(a).€€At€the€time€of€the€offense€thisÏstatute€provided€that,€ð ÑS.W.2d€454,€459€(Tenn.€Crim.€App.€1988)€this€court€held€that€in€general€fieldÏsobriety€tests€are€not€ð ðscientific€testsðð€and€that€the€admissibility€of€the€results€ofÏsuch€tests€are€not€to€be€governed€by€rules€pertaining€to€the€admission€ofÏscientific€evidence.ÌÌà à€€A€challenge€as€to€the€length,€range€or€manner€of€service€of€a€sentenceÏrequires€this€Court€to€conduct€a€òòde€novoóó€review€with€a€presumption€that€theÏdeterminations€made€by€the€trial€court€are€correct€so€long€as€the€recordÏdemonstrates€that€the€trial€court€properly€considered€relevant€sentencingÏprinciples.€€Tenn.€Code€Ann.€ðð€40„35„401(d);€òòState€v.€Ashbyóó,€823€S.W.2d€166Í(Tenn.€1991).€€In€conducting€a€òòde€novoóó€review€this€Court€must€weigh€theÏevidence€received€at€trial€and€sentencing€hearing,€the€pre„sentence€report,Ïstatutory€principles€for€sentencing,€counselððs€arguments€regarding€sentencing€œÇalternatives,›€the€criminal€conduct€and€its€nature,€mitigating€and€enhancing€factors,Ïthe€defendantððs€statement,€and€the€defendantððs€potential€for€rehabilitation€orÏtreatment.€€òòAshbyóó,€823€S.W.2d€at€169.€€The€record€reflects€that€the€trial€judgeÏfailed€to€follow€the€sentencing€principles€of€òòAshbyóó€and,€therefore,€there€is€noÏpresumption€of€correctness.€€However,€upon€review€of€the€record€we€find€noÏreversible€error€in€the€sentencing€of€Defendant.ÌÌà àWhile€no€presentence€report€was€completed,€the€Defendant€asserts€thatÏhe€had€no€prior€criminal€record€and€that€there€were€no€enhancement€factorsÏapplicable€to€his€offense.€€The€record€fails€to€reflect€that€the€trial€judge€found€anyÏenhancement€or€mitigating€factors.€€The€record€does€reflect€that€theÏcircumstances€of€the€offense€were€serious€in€that€the€Defendant€was€drivingÏalong€a€state€highway€without€his€lights€on€at€1:30€a.m.€€In€his€statement€to€theÏtrial€court,€Defendant€admitted€to€having€driven€numerous€times€while€his€licenseÏwas€revoked.€€Such€acts€were€in€knowing€violation€of€the€law.€€In€considerationÏof€the€above,€we€cannot€conclude€that€the€trial€court€erred€in€ordering€a€sentenceÏwhich€was€greater€than€the€minimum€forty„eight€(48)€hours€€mandated€by€theÏstatute.€€òòSeeóó€òòState€v.€œWarner€D.›€Brannonóó,€C.C.A.€03C01„9508„CR„00233,ÏKnox€County€(Tenn.€Crim.€App.€at€Knoxville,€filed€April€3,€1996),€òòpermóó.€òòtoóó€òòappealóóÏòòdeniedóó€(Tenn.€1996).ÌÇÌà
