Attrial,testimonyshowedthattheappellantwenttoMichelleSangster'shousetosmoke"crack."ThevictimwasasleepinSangster'slivingroomwhentheappellantarrived.TheappellantandSangsterwentintothekitchenandbegansmoking"crack."Initially,theyusedacanasasmokingapparatus.TheappellantcomplainedaboutthecansoSangsterlefttogetapipe.Aftersheleft,theappellantwentintothelivingroomandrapedthevictim. Thevictimtestified.Shestatedthattheappellantjumpedontopofherandchokedher.Heinstructedhertodoasherequestedorhewould"eliminateher."Sheattemptedtoresist,buthehitherandtoldhernottomakeasound.Herippedherjumpsuitapartandcarriedherintoabedroom.Heforcedhertohavesexualintercoursewithhim.Shestatedthatheslappedherwhenevershemadeasound.WhenSangsterreturnedtothehouse,theappellantstopped.Hetoldthevictim"[i]fyouscream,I'llbreakyourjaw."Thevictimdidnotknowwhethertheappellanthadreachedclimax. MichelleSangstertestifiedthatshewasgoneapproximatelythreeminutes.However,shestatedthatsheleftherhouseandwentacrosstherailroadtracks,toahouseabouttenhousesdownfromhers,toborrowa"crack"pipe.Whenshereturned,theappellantwaszippinguphispantsandthevictimwascrying.Sheaskedtheappellantwhathewasdoing.Theappellantreplied,"I'mgettingmesome." OfficerJohnnyBlackburntestified.Hestatedthatwhenhearrived,thevictimwascryingandherclothesweretorn.Shestatedthatshehadbeenraped.Aftertheappellantwasarrested,headmittedtohavingbeenatSangster'sbutcouldnotrecallwhattranspiredaftersmokingthe"crack." ATBIforensicscientisttestifiedthathereceivedarapekitcontainingsamplesofthevictim'sblood,saliva,andavaginalswab.Thevaginalswabcontainedamixtureofsemenandvaginalfluidwhichindicatedthatsexualintercoursehadoccurred.Fromthesample,theexpertstatedthatintercourselikelyoccurredwithatypeOmale.However,duetothesmallamountofsemenandspermatozoapresent,testingwasinconclusive.TheappellantistypeO. Theappellant'sthreeissuesgotothesufficiencyoftheevidence.Theappellant'sargumentisbasedonthepremisethatarapedidnotoccurbecause:(1)thevictimandtheappellantwereonlyaloneforthreeminutes,(2)thestatefailedtooffersufficientprooftoestablishthatpenetrationhadoccurred,and(3)theDNAtestingprecludedthepossibilitythatcertainsemenstainsonMichelleSangster'sbeddingcamefromtheappellant. Appellant'sargumentsaremisguided.AlthoughMichelleSangstermayhavetestifiedthatshewasgoneforapproximatelythreeminutes,thejurycouldhaveinferredfromSangster'sdescriptionofherventure,thatshewasgoneforalongerperiodoftime.ThejurymayhavealsoinferredthatSangster'suseofcrackcocaineimpairedhersenseoftime.Astothebeddingstain,themerefactthatanapparentlyolddrysemenstainonthebeddingwasinconsistentwiththeappellant'sDNAstructuredidnotprecludethejuryfromfindingthattheappellantrapedthevictim. Greatweightisaccordedjuryverdictsincriminaltrials.Juryverdictsaccreditstate'switnessesandresolveallevidentiaryconflictsinthestate'sfavor.Statev.Williams,657S.W.2d405,410(Tenn.1983);Statev.Banes,874S.W.2d73,78(Tenn.Crim.App.1993).Onappeal,thestateisentitledtoboththestrongestlegitimateviewoftheevidenceandallreasonableinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571S.W.2d832(Tenn.1978).Moreover,guiltyverdictsremovethepresumptionofinnocence,enjoyedbydefendantsattrial,andreplaceitwithapresumptionofguilt.Statev.Grace,493S.W.2d474(Tenn.1973).Appellants,therefore,carrytheburdenofovercomingapresumptionofguiltwhenappealingjuryconvictions.Id. Whenappellantschallengethesufficiencyoftheevidence,thisCourtmustdeterminewhether,afterviewingtheevidenceinalightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofacrimebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307(1979);Statev.Duncan,698S.W.2d63(Tenn.1985);Tenn.R.App.P.13(e).Theweightandcredibilityofawitness'testimonyaremattersentrustedexclusivelytothejuryasthetriersoffact.Statev.Sheffield,676S.W.2d542(Tenn.1984);Byrgev.State,575S.W.2d292(Tenn.Crim.App.1978).
