Indenyingrelief,thepostconvictioncourtconcludedthattheappellanthadnotmethisburdenofprovingthathehadbeendeprivedoftheeffectiveassistanceofcounselandthathisguiltypleaswerevoluntarilyentered.Toprovethathewasdeniedtheeffectiveassistanceofcounsel,theappellantmustshow,byapreponderanceoftheevidence,Taylorv.State,875S.W.2d684,686(Tenn.Crim.App.1993),perm.toappealdenied,(Tenn.1994),first,thatcounsel'srepresentationfellbelowtherangeofcompetencedemandedofattorneysincriminalcases,Baxterv.Rose,523S.W.2d930,936(Tenn.1975),and,second,that,butfortheseerrors,theresultoftheproceedingwouldhavebeendifferent.Stricklandv.Washington,466U.S.668,694,104S.Ct.2052,2068(1984);Statev.Melson,772S.W.2d417,419n.2(Tenn.),cert.denied,493U.S.874,110S.Ct.211(1989).Onpostconvictionreview,thereisastrongpresumptionofsatisfactoryrepresentation,Barrv.State,910S.W.2d462,464(Tenn.Crim.App.1995). First,theappellantcontendsthattrialcounselfailedtosubpoenaapotentialwitnessinsupportofhisdefense.Theappellantbearstheburdenofpresentingthatwitnessattheevidentiaryhearing.Blackv.State,794S.W.2d752(Tenn.Crim.App.1990)(emphasisadded).Theappellantfailedtopresentsuchwitness,thus,hefailstoestablishtheprejudiceprongmandatedbyStricklandv.Washington,supra.Black,794S.W.2dat753.Second,theappellantarguesthattrialcounselsfailuretorequiretheStatetomorespecificallyanswerhisbillofparticulars,citingBurlisonv.State,501S.W.2d801(Tenn.1973),constitutesdeficientperformance.Assuming,forargumentssake,thatBurlisonisapplicabletoguiltypleas,theappellanthasfailedtoshowprejudiceresultingfromtrialcounsel'sfailuretoobtainamorespecificbillofparticulars.Third,therecordindicatesthatboththeappellant'strialcounselandthetrialcourtinformedhimastothenatureandconsequencesofhisguiltypleasincludingthefactthathewouldbecome"paroleeligibleatthirtypercent."Thisissueiswithoutmerit. Whenthiscourtundertakesreviewofalowercourt'sdecisiononapetitionforpostconvictionrelief,thelowercourt'sfindingsoffactaregiventheweightofajuryverdictandareconclusiveonappealabsentafindingthattheevidencepreponderatesagainstthejudgment.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978),cert.denied,441U.S.947,99S.Ct.2170(1979).Afterreviewingtherecord,wecannotconcludethattheevidencepreponderatesagainstthepostconvictioncourt'sfindings.Moreover,wefindnoerroroflawmandatingreversalofthecourt'sjudgment.Thepostconvictioncourt'sdismissaloftheappellant'spetitionforpostconvictionreliefisaffirmed.     ____________________________________     DAVIDG.HAYES,JudgeCONCUR:________________________________________GARYR.WADE,Judge________________________________________CURWOODWITT,Judge
