InSeptemberof1990,thedefendantenteredguiltypleastotwocountsoftheftunderIndictmentNo.14180;thetrialcourtgrantedprobationonconcurrenttwoyearsentenceswhichwereorderedtobeservedconsecutivelywiththeconvictionsunderthepriortwoindictments.  ItwasnotuntilSeptemberof1994thatthestatefiledapetitiontorevokethecommunitycorrectionssentences.Thatpetitionincludedanallegationwhich,fromallappearanceswithinthisrecord,ismistaken;thatis,thesentencesforIndictmentsNo.14075and14125wouldnotbefullyserveduntil1996.Therecord,whileincomplete,assuggestedbythemajority,doesindicatethatsometimeaftertherevocationpetitionwasfiled,thetrialcourteventuallyincreasedtheeffectivesentencetotenyears.  BecausethejudgmentsarefaciallyvalidandindicatethattheMarch1990twoyearsentencewhichwaslegitimatelylengthenedafterwardtofouryears,thesentencesunderIndictments14075and14125appeartohavebeenfullyservedasearlyasMarchof1994.Thus,thetrialcourt,whichwouldhaveotherwisebeenabletoincreaseacommunitycorrectionssentencewithintheapplicablerange,wouldhavehadnoauthoritytoactbeyondthedatethesentenceshadexpired.SeeCarrollv.Raney,868S.W.2d721(Tenn.Crim.App.1993).  Judicialeconomywouldbeservedbetterbyaddressingtheissue.Otherwise,sincewehaverejectedtheappeal,thedefendantwilllikelyfileapetitionseekingpostconvictionorhabeascorpusrelief.Avoidsentencemaybesetasideatanytime.SeeStatev.PhillipR.Woods,_____S.W.2d_____,No.02C019505CC00129,slipop.at56(Tenn.Crim.App.,atJackson,April17,1996).SeealsoStatev.Mahler,735S.W.2d227(Tenn.1987).Furthermore, HabeascorpusreliefisavailableinTennessee...whenitappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentenceofimprisonmentorotherrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993).OurConstitutionprovidesthat aproperpetitionforissuanceofawritofhabeascorpusmaybebroughtatanytimewhilethepetitionerisincarceratedtocontestavoidjudgmentoranillegalconfinement.Id.(CitingarticleI,section15oftheTennesseeConstitution).̀  Underthesecircumstances,itappearsthatthemoreappropriateremedywouldhavebeentoremandthecausetothetrialcourtforfurtherconsiderationoftheunderlyingfacts.Thatwouldappeartobethebestpossiblecourseunderthesecircumstancesasopposedtoaltogetherrejectingtheappealonproceduralgrounds.     ________________________________________     GaryR.Wade,Judge
