Inthisappealofright,thesingleissuepresentedbythedefendantiswhetherthetrialcourterredbyrefusingtogranttheentiresentencetobeservedinthecommunitycorrectionsprogram.Wefindnoerrorandaffirmthejudgmentofthetrialcourt.  OnoraboutApril26of1997,thedefendantenteredtheresidenceofthevictim,LillardEarleAilor,andstolefurniture,appliances,tools,buildingsupplies,abicycle,andaboattrailer.Thevictimsawthedefendantleavingthesceneandnotedhislicenseplatenumber.Afterward,thedefendantturnedhimselfintotheauthorities.  Whileadmittinghiscrimes,thedefendantblamedhisactionsonseriousmaritaldifficultiesarisingfromhisdrugandalcoholaddiction.Heexplainedthathewasnotlivingathome,hadnoplacetogo,andwasstealinginordertosupporthisaddiction.    Atthetimeofthesentencinghearing,thedefendant,agethirtythree,wasmarriedandhadtwochildren.Whilehehaddroppedoutofhighschool,hehadobtainedaGEDandhadworkedprimarilyinconstruction.Sincehisarrest,the 8.4 defendanthadobtainedacommercialdriver'slicenseandhaddevelopedplanstobecomeatruckdriver.Hehadahistoryofheavydrinkingsincehewasateenagerandusuallyconsumedaboutonecaseofbeerperday.Bythetimeoftheseoffenses,hiscocainehabitcostbetween$400.00and$500.00perweek.Theftwashissourceofincome.Afterthecommissionofthesecrimes,thedefendantvoluntarilysoughtinpatienttreatmentforhisaddiction.Adrugscreenaboutaweekbeforethesentencinghearinghadyieldednegativeresults.  Thedefendanthadseveralprioroffenses,manyofwhichweredrugandalcoholrelated.Hisrecordincludedpublicintoxication,threeconvictionsfordrivingundertheinfluence,possessionofmarijuana,drivingonarevokedlicense,harassment,twomisdemeanorthefts,andtwothirddegreeburglaries.Sincehisarrest,adomesticaltercationwithhiswiferesultedinhisguiltypleaandafine.Thetrialcourt,inpertinentpart,ruledasfollowsinorderingsentencesoneyearabovetheminimumanddenyingimmediateprobationorcommunitycorrections:8 8 (# (#TheenhancingfactorthatIusedinraisingthisfromtheminimumwastherecordofpastconvictionsandcriminalactivity.Iconsideredthefactthatthisdidn'tinvolveanypersonalinjuryinmitigation....   8 8 (# (# < Indecidingwhetheritshouldbeservedonreleaseorinconfinement,splitconfinement,periodicconfinement,CommunityCorrections,[or]DepartmentofCorrection[],Ilookedatthenatureoftheoffense,lookedatyourrecord,listenedtoyourtestimony,[and]consideredthefactthatyou'vebeenbackintreatmentsincethesehappenedbackinAprilof[19]97.   8 8 (# (# < Ihavetriedtoevaluateyoursituationasfarasrehabilitationandlikelihoodofreoffending.That'samixedbag.Youwentthroughtreatment,thatisinyourfavor.You'vebeenworking,thatisinyourfavor.Youcommittedamisdemeanorassaultseveralmonthsdowntheroad.That'sdefinitelynotinyourfavor.Yourhistoryisnotinyourfavor.     Because񜛜thedefendant'scriminalbehaviorhadextendedoveraperiodoffourteentofifteenyears,thetrialcourtdeterminedthatasentenceabsentsome 8/5 periodofconfinementwoulddepreciatetheseriousnessoftheoffenses.Asixmonthsentencetojailfollowedbyacommunitycorrectionsprogramwasdeemedtobetheappropriatealternativesentence.  Thedefendantnowarguesthatbecausehehadbeencandidabouthisinvolvementintheoffensesandhadtakenpositivestepstowardshisrehabilitationfromhisaddiction,thetrialcourtshouldhavegrantedimmediatereleaseorncommunitycorrections.Heinsiststhathecanstayoutoftroublesolongasheremainsonthe"sobrietywagon."Hearguesthatjailovercrowdingisrampantandthatshouldhavebeengivenmoreconsiderationbythetrialjudge.  Whenachallengeismadetothelength,range,ormannerofserviceofasentence,itisthedutyofthiscourttoconducta"denovoreview...withapresumptionthatthedeterminationsmadebythecourtfromwhichtheappealistakenarecorrect."Tenn.CodeAnn.4035401(d).XXX XThispresumptionis "( "conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991).# XXXX#ԀTheSentencingCommission '" Commentsprovidethattheburdenisonthedefendanttoshowtheimproprietyofthesentence.  Ourreviewrequiresananalysisof(1)theevidence,ifany,receivedatthetrialandsentencinghearing;(2)thepresentencereport;(3)theprinciplesofsentencingandtheargumentsofcounselrelativetosentencingalternatives;(4)thenatureandcharacteristicsoftheoffense;(5)anymitigatingorenhancingfactors;(6)anystatementsmadebythedefendantinhisownbehalf;and(7)thedefendant'spotentialforrehabilitationortreatment.Tenn.CodeAnn.4035102,103,210. 8.4 ЇXXX X  IncalculatingthesentenceforfelonyconvictionscommittedbeforeJuly1,1995,thepresumptivesentenceistheminimumwithintherangeiftherearenoenhancementormitigatingfactors.Tenn.CodeAnn.4035210(c)(1990)(amendedJuly1,1995toprovidethatthepresumptivesentenceforaClassAfelonyasthemidpointintherange).Ifthereareenhancementfactorsbutnomitigatingfactors,thetrialcourtmaysetthesentenceabovetheminimum.Tenn.CodeAnn.4035210(d).Asentenceinvolvingbothenhancementandmitigatingfactorsrequiresanassignmentofrelativeweightfortheenhancementfactorsasameansofincreasingthesentence.Tenn.CodeAnn.4035210.Thesentencemaythenbereducedwithintherangebyanyweightassignedtothemitigatingfactorspresent.Id. $ # XXXX##  EspeciallymitigatedorstandardoffendersconvictedofClassC,D,orEfeloniesare,ofcourse,presumedtobefavorablecandidates"foralternativesentencingoptionsintheabsenceofevidencetothecontrary."Tenn.CodeAnn.40-35-102(6).  Amongthefactorsapplicabletoconsiderationforanalternativesentencearethecircumstancesoftheoffense,thedefendant'scriminalrecord,socialhistoryandpresentcondition,andthedeterrenteffectuponandthebestinterestofthedefendant.Statev.Grear,568S.W.2d285(Tenn.1978).The /%* purposeoftheCommunityCorrectionsActof1985wastoprovideanalternativemeansofpunishmentfor"selected,nonviolentfelonyoffendersinfront-endcommunitybasedalternativestoincarceration."Tenn.CodeAnn.40-36-103.Thecommunitycorrectionssentenceprovidesadesireddegreeofflexibilitythatmaybebothbeneficialtothedefendantyetservelegitimatesocietalaims.Statev.Griffith, 8.4 787S.W.2d340,342(Tenn.1990).ThatthedefendantmeetstheminimumrequirementsoftheCommunityCorrectionsActof1985,however,doesnotmeanthatheisentitledtobesentencedundertheactasamatteroflaworright.Statev.   Taylor,744S.W.2d919(Tenn.Crim.App.1987).Thefollowingoffendersare d eligibleforcommunityCcorrections:X 4(1)Personswho,withoutthisoption,wouldbeincarceratedinacorrectionalinstitution;(2)Personswhoareconvictedofproperty-related,ordrug/alcohol-relatedfelonyoffensesorotherfelonyoffensesnotinvolvingcrimesagainstthepersonasprovidedintitle39,chapter2[repealed],parts1-3and5-7ortitle39,chapter13,parts1-5;(3)Personswhoareconvictedofnonviolentfelonyoffenses;(4)Personswhoareconvictedoffelonyoffensesinwhichtheuseorpossessionofaweaponwasnotinvolved;(5)Personswhodonotdemonstrateapresentorpastpatternofbehaviorindicatingviolence;(6)Personswhodonotdemonstrateapatternofcommittingviolentoffenses;and(7)Personswhoaresentencedtoincarcerationoronescapeatthetimeofconsiderationwillnotbeeligible.4 .X-Tenn.CodeAnn.40-36-106(a).
