FACTS d    ` Thedefendantandthevictim'smotherwereinvolvedinanongoingrelationship.In d Juneof1993,thedefendant,whilestayinginthevictim'shome,rapedtheelevenyearoldvictimanallyandvaginally.Hewasconvictedoftwocountsofrapeofachild.   PROCEDURALBACKGROUND  t    ` OnJanuary17,1996,thetrialcourtentereditsjudgmentimposingtwoconsecutivesentencesoftwentyoneyearsforrapeofachild.ThisCourtaffirmedthetwojudgmentsofconvictionbutremandedforresentencingontheissueofconsecutivesentences.SeeState &$"% v.TyroneW.Vanlier,Sr.,C.C.A.No.01C019608CR00341,DavidsonCounty(Tenn. B.ExtensiveRecordofCriminalActivity  p     ` Thedefendantcomplainsthetrialcourtimproperlyfoundhehadanextensiverecord H ofcriminalactivity.SeeTenn.CodeAnn.4035115(b)(2).Wedisagree.   ]   `  ` Intheinstantcase,thedefendantwasconvictedoftwocountsofchildrape.Defendantconcededinhispretrialstatementtotheauthoritiesthathehadpriorsexualcontactwiththisvictimonmorethanoneoccasion.Inaddition,thedefendantwasconvictedoftenoffensesbetween1976and1993,toincludethreecountsofassault,twocountsofillegalpossessionofdrugs,drivingundertheinfluence,twogamblingrelatedcounts,andtwocountsofdrivingonarevokedorsuspendedlicense.Thus,wefindthisfactorwasappropriatelyconsideredbythetrialcourt.   C.SexualAbuseofaMinor    ` Defendantarguesthathemustservehisentiresentencewithoutparolepursuantto 2.2 Tenn.CodeAnn.3913523(b).Hearguesthatafortytwoyeareffectivesentenceisnot reasonablyrelatedtotheseverityoftheoffensesinvolved,seeStatev.Taylor,739S.W.2d x616 227,230(Tenn.1987);andisnotnecessarytoprotectthepublicfromfurthercriminalconduct,seeGrayv.State,538S.W.2d391,393(Tenn.1976).SeealsoStatev.Wilkerson, (:x5: 905S.W.2d933,939(Tenn.1995). ` Thedefendantwasconvictedoftwoseparatecountsofrapeofachild.ThetrialcourtfoundthatthedefendantmetthestatutorycriteriaforconsecutivesentencesasasexualoffenderunderTenn.CodeAnn.4035115(b)(5).Thedefendantadmittedthatoveraperiodoftwotothreeyears,priortoJuneof1993,therewereotherundetectedactsofsexualcontactwiththevictim.Furthermore,thedefendantwasinapositionofauthorityovertheyoungvictim.Helivedinthevictimshomeand,onthenightinquestion,wasinchargeofpickingthechildupandcaringforheruntilhermotherreturnedhome.Defendantthreatenedthechildwithaknifeinordertoaccomplishtherape.Inaddition,eventhoughthetrialcourtdidnotconsidertheresidualmentaldamagetothevictim,wefindthatthetestimonyatthesecondsentencinghearingdemonstratedthatthevictimwasstillsufferingfromemotionaltraumabecauseoftheseevents.Shewastakeninhersleep,forcedatknifepointtodisrobe,andthenrapedbothanallyandvaginally.ThetrialcourtproperlyappliedTenn.CodeAnn.4035115(b)(5). ` Specificfindingsregardingtheseverityoftheoffensesandthenecessitytoprotectsocietyisaprerequisitetoconsecutivesentencingunderthe dangerousoffendercategoryassetforthinTenn.CodeAnn.4035115(b)(4).Wilkerson,905S.W.2dat938. %0!$ However,suchspecificfactualfindingsarenotrequiredfortheothercategoriesofTenn.CodeAnn.4035115(b).Statev.Lane,__S.W.2d__(Tenn.1999).Nevertheless,the )$( generalprinciplesofsentencingrequirethatthelengthofsentencebe justlydeservedinrelationtotheseriousnessoftheoffenseand benogreaterthanthatdeservedfortheoffensecommitted.Id.(citingTenn.CodeAnn.4035102(1)and103(2)). /h*.  `  ` Weconcludethetrialcourtdidnoterrinorderingthesentencestobeservedconsecutively.Theaggregatesentencewasjustlydeservedinrelationtotheseriousnessoftheoffenseandwasnotgreaterthanthatdeserved.Thisissueiswithoutmerit.
