IntheDefendantsprosepetitionforpostconvictionrelief,numerousgeneralallegationsofineffectiveassistanceofcounselarealleged.Theallegationsrelateprimarilytoimproperandinadequateinvestigation,counselingandadviceconcerningthechargesandtheconsequencesoftheguiltyplea.Atthehearingonthepostconvictionpetition,theDefendanttestifiedthathismainconcernwaswiththeaggravatedkidnapingconvictionbecauseitcarriedfivemoreyearsthantherobberyconvictions.Hetestifiedthatconcerningthekidnapingcharge,hisattorney toldmethatifIwentaheadandpleadedguilty,wecouldcomebackandhecouldgetittookoffofme.TheDefendantsattorneytestifiedthathedidnot recallanydiscussionofthatnature. Indeterminingwhethercounselprovidedeffectiveassistanceattrial,thecourtmustdecidewhethercounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Tosucceedonaclaimthathiscounselwasineffectiveattrial,apetitionerbearstheburdenofshowingthathiscounselmadeerrorssoseriousthathewasnotfunctioningascounselasguaranteedundertheSixthAmendmentandthatthedeficientrepresentationprejudicedthepetitionerresultinginafailuretoproduceareliableresult.Stricklandv.Washington,466U.S.668,687,rehgdenied,467U.S.1267(1984);Cooperv.State,849S.W.2d744,747(Tenn.1993);Butlerv.State,789S.W.2d898,899(Tenn.1990).Tosatisfythesecondprongthepetitionermustshowareasonableprobabilitythat,butforcounselsunreasonableerror,thefactfinderwouldhavehadreasonabledoubtregardingpetitionersguilt.Strickland,466U.S.at695.Thisreasonableprobabilitymustbe sufficienttoundermineconfidenceintheoutcome.Harrisv.State,875S.W.2d662,665(Tenn.1994). Whenreviewingtrialcounselsactions,thiscourtshouldnotusethebenefitofhindsighttosecondguesstrialstrategyandcriticizecounselstactics.Hellardv.State,629S.W.2d4,9(Tenn.1982).Counselsallegederrorsshouldbejudgedatthetimetheyweremadeinlightofallfactsandcircumstances.Strickland,466U.S.at690;seeCooper,849S.W.2dat746. Thistwopartstandardofmeasuringineffectiveassistanceofcounselalsoappliestoclaimsarisingoutofthepleaprocess.Hillv.Lockhart,474U.S.52(1985).Theprejudicerequirementismodifiedsothatthepetitioner mustshowthatthereisareasonableprobabilitythat,butforcounselserrorshewouldnothavepleadedguiltyandwouldhaveinsistedongoingtotrial.Id.at59. TheDefendantandhisattorneyweretheonlywitnessesatthehearingonthepetitionforpostconvictionrelief.Notingthattosomeextenttheissuewasoneofcredibility,thetrialjudgefoundthatbasedontheevidencepresented,theDefendanthadnotcarriedhisburdenofprovingthatcounselwasineffective.Theevidencesupportsthefindingsofthetrialjudge.Wefindnoerroroflawrequiringreversal.
