OnJuly9,1984,theDefendantwasconvictedoffirstdegreemurderintheperpetrationofafelonyuponhispleaofguiltyintheCriminalCourtofKnoxCounty.Hewassentencedtolifeimprisonment. OnAugust22,1994,sometenyearsafterhisconviction,theDefendantfiledthispetitionforpostconvictionrelief.Thetrialcourtdismissedthepetitionwithoutappointingcounselandwithoutconductinganevidentiaryhearing.ItisfromtheorderdismissingthispetitionthattheDefendantappeals. Onthisappeal,theDefendantarguesthatthetrialcourtshouldhaveconductedanevidentiaryhearingtodeterminewhetherhereceivedineffectiveassistanceofcounselathisguiltypleaandwhetherhisguiltypleawasvoluntary.TheDefendantarguesthatthestatuteoflimitationsshouldnotbeapplicabletohispetitionbecausehebelievedthathistrialattorneywasgoingtoassisthiminfilingallfuturepetitionsandbecausehewasunawarethattherewasastatuteoflimitationsapplicabletopostconvictionproceedings.Hefurtherarguesthatthetrialcourterredbynotallowinghimtopresentevidencetoestablishthatthestatuteoflimitationsshouldnotbeappliedtohispetition. Weseenoreasontoaddressthemeritsofthepetitionforpostconvictionrelief.Eveniftheissuespresentedhavemerit,considerationofthispetitionisclearlytimebarredbythestatuteoflimitationsapplicabletoitwhichreads:8 Apetitionerincustodyundersentenceofacourtofthisstatemustpetitionforpostconvictionreliefunderthischapterwithinthree(3)yearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenorconsiderationofsuchpetitionshallbebarred. .   ׀ The1986amendmentcreatingthethreeyearstatuteoflimitationswaseffectiveJuly1,1986.Thiscourtruledthatthestatuteoflimitationscommencedontheeffectivedateoftheamendment,July1,1986,astothosepotentialsuitsyetunfiled.Statev.Masucci,754S.W.2d90,91(Tenn.Crim.App.1988),perm.toappealdenied,id.(Tenn.1988).Thus,apersonwhosejudgmentbecamefinalpriortotheeffectivedateoftheamendmenthadthreeyears,untilJuly1,1989,tofileapetitionforpostconvictionrelief.ThispetitionwasfiledϜmorethanfiveyearsafterthestatuteoflimitationshadrun. TheDefendantpresentsnoargumentwhichconvincesusthatthestatuteoflimitationsmightbeinapplicabletothispetition.HealsopresentsnoϜargumentwhichconvincesusthattheapplicationofthestatuteoflimitationstothepetitionviolatestheDefendantsconstitutionalrighttodueprocess.
