àThe€appellant,€Milburn€Earl€Wallace,€was€convicted€of€criminal€attempt€toÏcommit€rape,€a€Class€C€œfelony,›€by€a€jury€of€his€peers.€€The€trial€court,€finding€that€theÏappellant€was€a€multiple€offender,€imposed€a€Range€II€sentence€of€six€(6)€yearsÏconfinement€in€the€Department€of€Correction.€€The€appellant€contends€that€theÏevidence€is€insufficient,€as€a€matter€of€law,€to€support€a€finding€by€a€rational€trier€of€factÏthat€he€is€guilty€of€attempted€rape€beyond€a€reasonable€doubt.Ìà àWhen€the€victim€returned€from€turning€out€a€light€in€the€bathroom,€the€appellantÏwas€standing€in€the€hallway.€€He€tried€to€force€the€victim€into€a€bedroom,€but€sheÏsuccessfully€escaped€to€the€living€room.€€The€appellant€grabbed€the€victimððs€arm,€theyÏfell€into€a€chair,€and€subsequently€fell€to€the€floor.€€The€appellant€tried€to€hold€the€victimÍwith€his€legs.€€She€was€able€to€escape€and€ran€outside€the€residence€shouting€forÏhelp.€€The€appellant€chased€the€victim.€€She€picked€up€a€stick€and€threatened€to€hit€theÏappellant.€€He€then€picked€up€a€bigger€stick€and€forced€the€victim€to€drop€her€stick.€€TheÏappellant€grabbed€the€victimððs€arms,€pulled€her€into€a€ditch,€and€then€into€his€trailerÏhome.€€The€victim€was€screaming€for€help.€€The€appellantððs€grandmother€was€watchingÏbut€did€not€help€stop€the€attack.€€He€hit€the€victim€in€the€head€to€get€her€to€stopÏscreaming€and€pushed€her€into€the€trailer€home.€€à àThe€appellant€threw€the€victim€toÏthe€couch€and,€thereafter,€œpulled›€her€onto€the€floor.€€He€pulled€down€his€pants€andÏexposed€his€reproductive€organ.€€He€then€pulled€up€the€victimððs€dress€and€removedÏher€pantyhose.€€When€he€saw€that€the€victim€was€menstruating,€he€immediatelyÏstopped€and€sat€down€on€the€couch.€€The€victim€arose.€€She€attempted€to€get€herÏpantyhose€back.€€However,€the€appellant€held€the€pantyhose€behind€his€back€andÏrefused€to€give€the€pantyhose€to€the€victim.€€She€left€the€appellantððs€trailer,€returned€toÏher€home,€and€called€her€mother€in„law.€Ìà àThe€state€introduced€pictures€showing€injuries€suffered€by€the€victim:€a€longÏbruise€on€her€leg,€multiple€bruises€on€her€arm,€a€bruise€under€her€arm,€and€a€bruise€onÏher€shoulder.€€The€victim€also€suffered€a€black€eye€and€a€cut€ear.€€The€state€alsoÏintroduced€the€victimððs€torn€dress,€torn€bra,€and€torn€pantyhose.€€The€defense€offeredÏno€proof.Ìà
