OnJanuary4,1993,theMadisonCountyGrandJuryreturnedtwoindictmentsagainsttheappellee,KaronL.Washington.Indictmentnumber93120chargedtheoffensesof(a)theftover$1,000and(b)fraudulentuseofacreditcardinexcessof$1,000.Indictmentnumber93121chargedtheoffensesof(a)theftunder$500,twocounts,(b)fraudulentuseofacreditcardunderthevalueof$500,twocounts,(c)resistingarrest,onecount,(d)disorderlyconduct,onecount,and(e)forgery,fourcounts.OnMay25,1993, )   ׀theappelleeenteredpleasofguiltytotheoffensesoffraudbycreditcard,aClassDfelony,andtwocountsofforgery,aClassEfelony.Thetrialcourtsentencedtheappelleetoconfinementfortwo(2)yearsintheDepartmentofCorrectionineachcountpursuanttoapleabargainagreement.Theeffectivesentencewastwo(2)years.However,thesentenceforfraudbycreditcardwastobeservedconsecutivelytoapriorTexassentence. ThetrialcourtgrantedWashington'srequestthatshebegivenashortperiodoftimetotakecareofherpersonalaffairsbeforeexecutionofthesentences.Washingtondidnotappearatthenextcourtdate.Instead,shewastakenintocustodyinShelbyCounty,hercountyofresidence,andthereafterextraditedtoMissouriforcrimescommittedinthatState.TheStateofTennesseeprovidedtheMissouriauthoritieswithadetainer.Asaresult,WashingtonwasreturnedtoMadisonCountyinMayof1995. OnJune5,1995,Washingtonfileda"MotiontoAmendJudgment."Themotionaskedthetrialcourtto"amendherJudgmentofMay25,1993pursuanttotheattachedletter. *   ׀AhearingwasconductedonJune13,1995.WashingtonhadbeenconfinedtotheMadisonCountyPenalFarmforthirtytwo(32)daysonthedateofthehearing. WashingtonaskedthetrialcourttoenteranorderthatpermittedtheTennesseesentencestobeservedconcurrentlywiththeMissourisentences.Thestatearguedthatthetrialcourtdidnothavejurisdictiontoentertainthemotionsincethe1993judgmentswerefinal.Furthermore,Missouri,notTennessee,wasrequiredtodeterminewhetherthesentencesweretobeservedconcurrentlyorconsecutivelybecauseWashingtonwasconvictedinMissouriaftertheimpositionoftheTennesseesentences.Thetrialcourtadvisedcounseltoenterastipulationoffactsandhewouldthendenythemotionsincethejudgmenthadbecomefinaland"it'soutofmycontrol,"and"Ijustdon'thaveanyauthoritytodoit." AsecondhearingwasheldonJune16,1995.Thereisnotranscriptorstatementoftheevidenceofthishearing.NoristhereatranscriptorstatementoftheevidenceastowhatoccurredonJune26,1995,whenthetrialcourtenteredthefollowingorder:    Onthe25thdayofMay,1993,Defendantwasorderedtoserve2yearswhichshehasservedintheMissouriStatePrisonforWomen.ITIS,THEREFOREORDERED,ADJUDGEDANDDECREED,thattheDefendantbereleasedimmediatelyandsheshouldbeplacedonprobationfortheremainingbalanceofhersentence.   X OnJuly7,1995,thetrialcourtenteredthefollowing"AmendedOrderReleasefromCustody:"    Onthe25thdayofMay,1993,Defendantwasorderedtoserve2yearswhichshehasservedintheMissouriStatePrisonforWomen.Theoriginalorder,whichlistsonlydocketnumber93121,isherebyamendedbyaddingdocketnumber93120,because93120wastorunconcurrentlywith93121,butwasinadvertentlyomittedfortheoriginalorder.ITISTHEREFOREORDERED,ADJUDGEDANDDECREED,thattheDefendantbereleasedimmediatelyandsheshouldbeplacedonprobationfortheremainingbalanceofhersentence.   X Thetrialcourtalsoenteredaprobationorder.ThisorderstatesthattheTexassentencesexpiredonOctober14,1993.ItfurtherstatesthattheexpirationdateoftheprobatedsentencewasOctober14,1995.  I.    Asageneralrule,thejudgmentofatrialcourtbecomesfinalthirty(30)daysfollowingtheentryofjudgment. +   ׀Thereareexceptionstothisrule.Thetimelyfilingof(a)amotionforjudgmentofacquittal,(b)motionforanewtrial,(c)motionforarrestofjudgment,or(d)petitionforsuspensionofsentencetollsthefinalityofthejudgmentuntiloneormoreofthesemotionshavebeenresolvedbythetrialcourt. ,   ׀Washingtondidnotfileoneofthesemotionsfollowingher1992convictions.Consequently,thejudgmentsofthetrialcourtwerenottolledinthismanner. Anaccusedmayseekthecorrectionorreductionofasentenceimposedbythetrialcourt"within120daysafterthedatethesentenceisimposedorprobationisrevoked." -   ׀Thestatutespecificallyprovidesthat [n]oextensionsshallbeallowedonthetimelimitation." .   ׀WashingtondidnotfileaRule35motionwithin120daysoftheentryofthejudgmentsinthiscase.ThetimeforthefilingofsuchamotionhadexpiredbeforeWashingtonfiledtheinitialmotionseekingtoamendthejudgment. Whenatrialcourtmakesaclericalmistake,themistake"maybecorrectedbythecourtatanytimeandaftersuchnotice,ifany,asthecourtorders." /   ׀Inthiscase,neitherthereliefsoughtnorthereliefgivenwaspredicateduponamistakemadebythetrialcourtwhensentencingWashington. Itisobviousthatthestatutesandruleshereinabovementionedwillnotsupporttheactiontakenbythetrialcourt.ThisCourtmustnowconsiderwhethertheprovisionscontainedinTenn.CodeAnn.4035212(d)willsupporttheactiontakenbytrialcourt.  II.    TheprovisionscontainedinTenn.CodeAnn.4035212governthemannerinwhichasentenceshallbeserved.AstoanaccusedwhohasbeensentencedtoconfinementintheDepartmentofCorrection,thestatutestates:    (d)Notwithstandingtheprovisionsofsubsection(c),thecourtshallretainfulljurisdictionoveradefendantsentencedtothedepartmentduringthetimeheisbeinghousedinalocaljailorworkhouseawaitingtransfertothedepartment.Suchjurisdictionshallcontinueuntilsuchtimeasthedefendantisactuallytransferredtothephysicalcustodyofthedepartment.   X Thisstatutoryprovisionisrecognizedinthestatutegoverningprobation.Tenn.CodeAnn.4035303(e)providesthat"[p]robationshallbegranted,ifatall,atthetimeofthesentencinghearingexceptforsentencesservedinalocaljailorworkhouseorexceptduringthetimeadefendantsentencedtothedepartmentofcorrectionisbeinghousedinalocaljailorworkhouseawaitingtransfertothedepartmentasprovidedin4035212(d)."(emphasisadded). Inthiscase,MadisonCountyreceivedcustodyofWashingtonafteraMissouricourtfoundthatsheshouldbeextraditedpursuanttotheStateofTennessee'sdetainerandrequestforcustody.SincethedetainerwasforjudgmentsthatoriginatedinMadisonCounty,WashingtonwasreturnedtoMadisonCountyandplacedintheMadisonCountyPenalFarm.TheassistantdistrictattorneygeneralwhorepresentedthestateintheseproceedingsdidnotknowwhyWashingtonhadbeenreturnedtoMadisonCountyorwhyshewasbeinghousedintheCountysworkhouse.Theassistantdistrictattorneygeneralsaidattheinitialhearing:"I'mnotreallysurewhyshe[Washington]wasintheworkhouse,butthisaDOC[DepartmentofCorrection]sentence."However,itisobviouswhyWashingtonwasinMadisonCounty.Thejudgmentswereheldinabeyanceandwereneverexecuted.ItwasnecessaryforWashingtontoreturntoMadisonCountysothatthejudgmentscouldbeexecuted. BeforeatrialcourtmaygrantprobationtoanaccusedwhohasbeensentencedtotheDepartmentofCorrectionandisawaitingtransfer,(a)thetrialcourtmusthavejurisdictiontoenterthejudgment, 0   ׀(b)theaccusedmustbeconfinedtothecountyjailorworkhouse, 1   ׀(c)thenatureoftheoffenseandthelengthofthesentencedonotbarprobation, 2   ׀and(d)itisinthebestinterestofsocietyandtheaccusedtogranttheaccusedprobation.Iftheseprerequisitesarepresent,thetrialcourtmaygranttheaccusedprobation. 3    Inthiscase,alloftheessentialprerequisitesweremet.AlthoughWashingtonhadbeensentencedtoDepartmentofCorrectionsentences,shewasconfinedinthelocalworkhousewhenthetrialcourtgrantedtherelief.ShehadnotbeeninthecustodyoftheDepartmentofCorrectionpriortotheactiontakenbythetrialcourt.Thelengthofthesentenceswastwoyears.Theoffenseswerefraudulentuseofacreditcardandforgery.Thus,neitherthelengthofthesentencesnorthenatureoftheoffensesbarredthesuspensionofthesentencesandplacingWashingtononprobation.Giventhesecircumstances,thetrialcourtclearlyhadjurisdictiontograntthereliefitgavetoWashington. TheonlyquestionthatremainstobeanswerediswhetherWashingtonwasafitpersonforprobation,andprobationwasinthebestinterestofsocietyandWashington.  III.    ThestatearguesthatifthisCourtfindsthatthetrialcourthadtherequisitejurisdictiontograntthereliefsought,thisCourtshouldreversethesuspensionofWashington'ssentencesandgrantofprobationbecauseshewasnotsuitableforprobation.TheflawinthisargumentisthattherecorddoesnotcontainatranscriptorstatementoftheevidenceoftheproceedingsthatoccurredonJune26,1995,orJuly7,1995,whentheordersinquestionwereentered.
