Afterreviewingtherecord,wefindnoreversibleerror.Thejudgmentofthetrialcourtisaffirmed.' 4 4X <X' Q+FACTS .$~#  InJanuary1993,MyronWilcox,themurdervictim,failedtomakeacustomarybirthdaycalltohissoninFlorida.Thesonthoughtthiswasunusualandmadeseveralunsuccessfulattemptstocontacthisfather.Heeventuallycontactedhisstepmother,theappellant.TheappellantinformedhimthatshedidnotknowwherethevictimwasbutassumedhehadgonetoFlorida. InFebruary1993,thesoninstigatedasearchforhisfather.ThesearchconcludedinFebruary1994,whenabodywasrecoveredfromawellontheappellantsproperty.Baseduponstrongcircumstantialevidencewhichwediscusslater,theMaconCountySheriffsDepartmentconcludedthebodywasthatofMyronWilcoxandthattheappellantshothimintheheadwithasmall 95; caliberweapon.Theappellantwassubsequentlyindictedforthefirstdegree  murderofherhusbandandconvictedofseconddegreemurder.  ISSUE1:WHETHERTHETRIALCOURTERREDINDENYINGTHEAPPELLANTSMOTIONFORMISTRIALAFTERTHEPROSECUTORMADECOMMENTSREGARDINGTHEAPPELLANTSINVOCATIONOFHERCONSTITUTIONALRIGHTAGAINSTSELFINCRIMINATION.   4X4  Theappellantcontendsthatthetrialcourterredbydenyingamistrialaftertheassistantdistrictattorneycommentedontheappellantsinvocationofherfifthamendmentrightagainstselfincrimination.Thiscontentionarisesfromthefollowingcolloquybetweentheassistantdistrictattorneyandaprosecutionwitness:'4XN <X4X'8 Q: N NowdownthereinTexaswhenyouwentdownthereandyou  searchedthisvan.Afteryousearchedthevan,canyoutellthejuryornottherewasanyrightsadvisementofthisdefendantdownthereinTexas?  ! ! 8 A: N Yes,sir.D! ! ! 8 Q: N Andafterthoserightswerereadtohertherewasno #l! statementmade,right?  ! ! 8 A: N Yes,sir.%0!$ ! ! 8 Q: N Shewantedtoseeanattorneywhichisfine,right?'#& ! ! 8 A: N Yes,sir.)$( ! ! Atthispointdefensecounselobjectedandrequestedamistrial.Thetrialjudgedeniedthemotionformistrialandissuedthefollowingcurativeinstruction:8 Imgoingtotellyousomethingnow.Thatwasanimproperquestion,completelyimproper.Adefendant,andweallknow,doesnothavetomakeanystatementatanytime,thatsyourConstitutionalright.Nothingcanbeinferredfromthat,fromyourpointofviewatall.Iwouldinstructyounottoinferanythingfromit.Thatsaprotectionyouvegot,Ivegotandeverycitizenofthiscountryhasgot.Andtheresnoreasontomakeastatement.In factdefendantsoranyonewhoisbeingquestioned,isbetteroffnot <949    tomakeastatementinthosecases.Andthisdefendantjust  exercisedherConstitutionalright.  ! !  Inreviewingaclaimallegingerrorinnotdeclaringamistrialbecauseofprosecutorialmisconduct,thisCourtmustdeterminewhethertheimproperconductcouldhaveaffectedtheverdicttotheprejudiceofthedefendant.Judge  ` v.State,539S.W.2d340,344(Tenn.Crim.App.1976).ThisCourthassetout  8  fivefactorswhichmustbeconsideredinmakingthisdetermination.Id.at344.   Thesefactorsareasfollows:04X <X4XN <X08 1. theconductcomplainedofinlightofthefactsand H circumstancesofthecase;  ! ! 8 2. thecurativemeasuresundertaken; \ ! ! 8 3. theintentoftheprosecutorinmakingtheimproperremarks;4 ! ! 8 4. thecumulativeeffectoftheimproperconductandanyother   errorsintherecord;and  ! ! 8 5. therelativestrengthorweaknessofthecase.Id. ! ! Furthermore,thepromptinstructionofatrialjudgegenerallycuresanyerrorunlesstheerrorissoprejudicialthatitmoreprobablythannotaffectedthejudgment.Statev.Tyler,598S.W.2d798(Tenn.Crim.App.1980). %0!$  Thestatepresentedasubstantialamountofevidenceagainsttheappellant.Also,thetrialjudgerespondedwithathoroughcurativeinstruction.Therecordrevealsthattheimpropercommentsoccurredduringredirectexaminationofaprosecutionwitness.ItwasthestatespositionthattheappellanthadcreatedthenoteallegedlyleftbythevictimexplaininghewasleavingforFlorida.Oncrossexamination,defensecounselcreatedtheinferencethattheprosecutionfailedtocomparethenoteallegedlyleftbythevictimtothehandwritingoftheappellant.Onredirect,theprosecutorattemptedtobringoutthefactthatthestatecouldnottakeawritingexemplarfromtheappellanttomakeacomparisonbecausetheappellantinvokedherfifth (:x5: ramendmentrights.Itisevidentthattheprosecutorhadanonmaliciousmotiveinaskingthisseriesofquestions. Wefindthatthesecommentsdidnotaffecttheverdicttotheprejudiceofthedefendant. #  1      ׀Thisissueiswithoutmerit.  `   ISSUE2:WHETHERTHETRIALCOURTERREDINDENYINGTHEAPPELLANTSMOTIONTOREVIEWTHENOTESOFATESTIFYINGWITNESS.   Thenextissuepresentedbytheappellantiswhetherthetrialcourterredinrefusinghertheopportunitytoinspectnotesofatestifyinginvestigativeofficer. TheappellantcontendsthatthisinformationconstitutedJencksActmaterialandwassubjecttodisclosurepursuanttoTenn.R.Crim.P.26.2.Thiscontentionistrueonlyiftheinvestigatorsnotesconstitutea statementasdefinedbyRule26.2.H #  2      ׀Thedeterminationofwhatconstitutesaproducible D! statementisamatterthatrestspurelywithinthediscretionofthetrialjudgeandcanonlybesetasidebythisCourtifthedecisionisclearlyerroneous. Therecordbeforeusisvoidoftheinvestigatorsnotes.Itwasincumbentupontheappellanttopreparearecordthatincludedallmaterialsnecessaryfordispositionofherappeal.Tenn.R.App.P.24(e);Statev.Beech,744S.W.2d585 T,'+ (Tenn.Crim.App.1987).Intheabsenceofanadequaterecordwemustpresumethatthetrialcourtsrulingwasadequatelysupportedbytheevidence. 0T+/ Id.at588;Tenn.R.App.P.13(c)and36(a).Withouttheinvestigatorsnoteswe  cannotdeterminewhetherthetrialjudgesrulingwasclearlyerroneousandmustpresumeheruledcorrectly.Thisissueis,therefore,overruled.  ISSUE3:WHETHERTHETRIALCOURTERREDINREFUSINGTOALLOWTHEAPPELLANTTOINTRODUCETHEPRIORARRESTRECORDOFTHEDECEDENT.   Theappellantcontendsthatthetrialcourterredbyrefusingtoallowhertointroducethevictimspriorarrestrecord.Therecordindicatesthatthevictimhadbeenarrestedforassaultingherson.Sheallegesthatthisarrestrecordwascriticalinestablishingthevictimsheightandweight #  3      ׀andtoillustratethat  p hersonhadboththemotiveandopportunitytokillthevictim. Therecorddoesnotrevealthattheappellanteveryattemptedtointroducethearrestrecordintoevidence.Therefore,thisissuehasbeenwaivedpursuanttoTenn.R.Ct.Crim.App.10.Notwithstandingwaiver,wefindnoerrorsurroundingthisissue.AAnyerrorinrulingtheevidenceinadmisslbeinadmissiblewasharmless.SeeTenn.R.  ApApp.P.36(b).Theappellantwasabletoestablishthevictim'sheightandweightthroughothertestimony.Theappellantquestionedhersonabouttheassaultincidentleadingtothevictimsarrestandaskedhimtheheightandweightofhisstepfather.Althoughtheactualarrestrecordwasnotadmittedintoevidence,theinformationtheappellantsoughttoestablishwasheardbythejury.Thisissueiswithoutmerit.  ISSUE4:WHETHERTHEEVIDENCEWASSUFFICIENTTOSUPPORTAVERDICTOFGUILTBEYONDAREASONABLEDOUBT.   Theappellantcontendsthattheevidencepresentedattrialisinsufficienttosupportherconviction.Greatweightisgiventotheresultreachedbythejuryinacriminaltrial.AjuryverdictapprovedbythetrialjudgeaccreditsthestatesP    P    witnessesandresolvesallconflictsinfavorofthestate.Statev.Williams,657 505 P    P    P    P    P    P    P    S.W.2d405,410(Tenn.1983).Onappeal,thestateisentitledtothestrongestP    P    P    P    P    P    P    P    P    P    P    P    P    legitimateviewoftheevidenceandallreasonableinferenceswhichmaybeP    P    P    P    P    P    P    P    P    P    P    P    P    P    P    P    P    P    P    drawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978). `   Moreover,aguiltyverdictremovesthepresumptionofinnocencewhichtheappellantenjoyedattrialandraisesapresumptionofguiltonappeal.Statev.  ` Grace,493S.W.2d474,476(Tenn.1973).Theappellanthastheburdenof  8  overcomingthispresumptionofguilt.Id.    Wheresufficiencyoftheevidenceischallenged,therelevantquestionforthisCourtiswhether,afterviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimeorcrimesbeyondareasonabledoubt.Jacksonv.Virginia,443U.S. H 307,319(1979);Statev.Duncan,698S.W.2d63,67(Tenn.1985);   Tenn.R.App.P.13(e).Theweightandcredibilityofthewitnessestestimonyaremattersentrustedexclusivelytothejuryasthetriersoffact.Statev.Sheffield,  676S.W.2d542,547(Tenn.1984). Theevidencewassufficienttosustaintheappellantsconviction.Thestatepresentedasubstantialamountofcircumstantialevidenceimplicatingtheappellant.Thevictimsbodywasfoundinawellonthepropertyoftheappellant.TheappellantinstructedheryoungestsontocoverthewellsoonafterMyronWilcoxwaslastseenalive.Thestateestablishedthatthebodyhadbeeninthewellapproximatelythirteenmonths,thesameamountoftimethatMyronWilcoxhadbeenmissing. ThestateintroducedtestimonythatthebodywasclothedinaredvestsimilartoavestwornbyMyronWilcox.Itwasalsoestablishedthattheappellantownedandusedgunsofthesamecaliberthatcausedthedeathofthe bodyrecoveredfromthewell.Finally,aromanticacquaintanceoftheappellant P838 testifiedthatshehadtoldhimthatsheshotherhusbandandstoredhisbodyin   coolsprings.   TennesseesSupremeCourthasheldthataconvictionmaybebasedentirelyon    circumstantialevidencewherethefactsare soclearlyinterwovenandconnectedthatthefingerofguiltispointedunerringlyatthedefendantandthedefendantalone.Statev.Crawford,470S.W.2d610,612(Tenn.1971).In   thiscasethefingerofguiltpointsattheappellant.Thestateintroducedsufficientevidencefromwhichajurycouldhaveconcludedtheappellantwasguiltyofseconddegreemurderbeyondareasonabledoubt.Thisissueiswithoutmerit.  ISSUE5:WHETHERTHESENTENCEIMPOSEDUPONTHEAPPELLANTWASEXCESSIVE.J   Theappellantnextcontendsthathersentencewasexcessive.Ourreviewofthesentenceimposedbythetrialcourtisdenovo,withapresumption D! thatthedeterminationsofthetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1990);Statev.Byrd,861S.W.2d377,379(Tenn.Crim.App.1993). $D # Thepresumptionofcorrectnesswhichattachestothetrialcourtsactionisconditioneduponanaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Furthermore,theburdenof T,'+ showingthatthesentencewasimproperrestswiththeappellant.Id.at169. ,.|)- ̀Inconductingourreview,weconsidertheevidencepresentedatthesentencinghearing,thepresentencereport,thesentencingprinciples,argumentsofcounsel,statementsofthedefendant,thenatureandcharacteristicsoftheoffense,mitigatingandenhancingfactors,andtheappellantsamenabilitytorehabilitation.Tenn.CodeAnn.4035210(b) <949 (1990);Ashby,823S.W.2dat168.Also,thepresumptivesentenceshallbethe  minimumwithintherangeifnoenhancementormitigatingfactorsexist.Tenn.CodeAnn.4035210(c)(1990).Ifenhancementfactorsexistbuttherearenomitigatingfactors,thetrialcourtmaysetthesentenceabovetheminimuminthatrangebutstillwithintherange. Inthiscase,thetrialcourtfoundtwoenhancementfactors:theappellanthadapreviouscriminalhistory,andtheappellantpossessedoremployedafirearmduringthecommissionoftheoffense.Herhistoryincludedtheshootingassaultofanotherhusband.Thetrialcourtfoundnomitigatingfactors.Thecourtalsoquestionedtheveracityandsincerityoftheappellantthroughoutthetrialandsentencingprocess.ThisCourtfindsthattheappellanthasnotovercomethepresumptionofcorrectness.Thesentenceimposedbythetrialcourtisaffirmed. Havingreviewedtheentirerecordandalltheissuespresentedforreview,wefindnoerrormandatingreversal.Accordingly,thejudgmentofthetrialcourtisaffirmed.
