OnAugust21,1992,appellantfiledaprosepetitionforpostconvictionrelief.CounselwasappointedandanamendedpetitionwasfiledFebruary1,1993.Inthatpetitionappellantcontendedprimarilythathewasdeniedtheeffectiveassistanceofcounselbecausetrialcounselfailedtoobjecttothesignlanguageinterpreterusedbythestate.Thatpetitionwasdeniedbythetrialcourt.Thiscourtaffirmed.Wileyv.State,No.03C019306CR00182(Tenn.Crim.App.,Knoxville,March29,1994),perm.app.denied,July18,1994. OnDecember2,1994,appellantfiledthissecondpetitionforpostconvictionrelief.Heagainassertedthegroundofineffectiveassistanceofcounsel.Headdedallegationsthathisrighttocompulsoryprocesswasviolated,thathisrighttotranscriptsandwitnesseswasviolated,thattherewasanillegalseizureofhisguns,andthattherewasnewlydiscoveredevidenceconcerningDNAtesting.Counselwasappointedandfiledanamendedpetitionreallegingthesamegrounds.AhearinginthismatterwasconductedAugust14and15,1995.Thetrialcourtdismissedthepetitiononthegroundsthatallissuesraisedhadpreviouslybeendeterminedorwaived.Appellantappealsthisdismissal.Uponreview,weaffirmthejudgmentofthetrialcourt. Petitionerinsiststhatthispetitionraisesnewfactsonwhichtobaseafindingofineffectiveassistanceandnewallegationsofotherdeficiencies.However,pursuanttoT.C.A.4030112,anissueisdeemedtobe waivedifitreasonablycouldhavebeenraisedinapriorproceeding,evenifitwerenot.Houseadoptedabroad,objectivetestforwaiver,butalsoimputedtheactionsoromissionsofcounseltoapostconvictionpetitioner.Apetitionermaynotovercometherebuttablepresumptionofwaiverbyallegingthathedidnotpersonallywaivethegroundforrelief.House,911S.W.2dat714;Statev.Smith,814S.W.2d45,4748(Tenn.1991).Allissuesraisedinthesecondpetitioncouldhavebeenraisedinthefirstone.Thoseissueshavenowbeenwaived.
