Inhissecondpetitionforpostconvictionrelief,thepetitionerallegedthatthejuryinstructiononreasonabledoubtgivenduringhistrialwasunconstitutional.Afterappointingcounselandholdingahearing,thetrialcourtdismissedthepetition,statingthat [t]hepetitionerhashadapreviouspostconvictionpetitionwhichwasdenied,andthat [t]hisinstructionisandhasbeencontinuallyupheldasconstitutionalbytheCourt[s]ofthisState.Weagree.Althoughacopyoftheinstructionisnotincludedintherecord,therebyprecludingtheCourtfromconductinganadequatereviewofthesoleissueraisedonappeal,thepetitionerapparentlyclaimsthatthe moralcertaintylanguageoftheinstructionrendersitconstitutionallyinvalid.  T.C.A.4030202(c)providesthatnomorethanonepetitionforpostconvictionreliefmaybefiledattackingasinglejudgment,andmandatesthatthetrialcourtshallsummarilydismissanysecondorsubsequentpetitionifapriorpetitionwasfiledandresolvedonthemeritsbyacourtofcompetentjurisdiction.Thetrialcourtinthiscaseconcludedthatthepetitioneralreadyfiledapriorpetitionwhichwasdenied,and,therefore,properlydismissedthepetition.  Nevertheless,thepetitionersclaimdoesnotfallwithinoneofthelimitedcircumstancesunderwhichapriorpetitionmaybereopened.SeeT.C.A.4030217.ThepetitionerisapparentlyrelyinguponVictorv.NebraskaandSandovalv.California,511U.S.1,114S.Ct.1239,127L.Ed.2d583(1994),asestablishingaconstitutionalrightthatwasnotrecognizedatthetimehefiledhisfirstpetition.However,morethanoneyearpassedbetweentherulinginVictorandSandovalandthefilingofthepetitionerssecondpetition.4030217(a)(1).Andcontrarytothepetitionersclaim,theUnitedStatesSupremeCourtdidnotholdunconstitutionalthelanguageoftheallegedreasonabledoubtinstructionatissuehere.Moreover,asthetrialcourtcorrectlynoted,thecourtsofthisstatehavecontinuallyupheldtheconstitutionalityofinstructionswithsimilarlanguage.SeeStatev.Nichols,877S.W.2d722,734(Tenn.1994);Pettyjohnv.State,885S.W.2d364,365(Tenn.Crim.App.1994);Smithv.State,No.02C019511CR00342(Tenn.Crim.App.,Apr.28,1997).
