Weaffirmthejudgmentofthetrialcourt.  OnOctober10,1990,thepetitionerwasconvictedofrobberyandaggravatedrape.ThetrialcourtimposedRangeI,concurrentsentencesofthreeandeighteenyears,respectively.OnMarch19,1992,thiscourtaffirmedtheconvictions.Statev.EricRussellWilson,No.01C019108CR00230(Tenn.Crim.App.,atNashville,March19,1992).ThesupremecourtdeniedanapplicationforpermissiontoappealonJune22,1992.  Thiscourt'sopinionondirectappealsummarizedthefactswhichledtotheconvictions:8 8 Theundisputedevidenceinthiscase,givenbythevictim,showedtheappellantassaultedtheyoungwomannearabusinessinthecityofNashvilleatapproximately10:30p.m.onOctober10,1989.Heheldaknifetoherthroat,forcedhertocommitfellatiouponhim,andthenvaginallypenetratedher.Theappellanttookseveralofthewoman'spersonaleffects,oneofwhichwasfoundonhispersonwhenhewasarrested.Id.,slipop.at12.  Shortlyaftertheassault,thevictimprovidedpolicewithadescriptionofherassailant.Thepetitioner,whowasarrestedonlyashortdistancefromthecrimescene,metthatdescription.Whileattemptingtoverifytheidentityofthepetitioner,policefoundacreditcardinhiswalletwhichbelongedtothevictim.  Inthispetitionforpostconvictionrelief,thepetitionercomplainedthathistrialcounselhadbeenineffectiveforhavingfailedtofileamotiontosuppressthecreditcardevidence.Thepetitionercontendedthatthewarrantlesssearchofhiswalletviolatedthestateandfederalconstitutions.  Thetrialcourtfoundthattherewasnolegitimatebasistosupportthefilingofamotiontosuppress.Itconcludedthattrialcounselhadcompetentlyandeffectivelyperformedhisprofessionalresponsibilities.  Inorderforthepetitionertobegrantedreliefongroundsofineffectivecounsel,hemustestablishthattheadvicegivenortheservicesrenderedwerenotwithintherangeofcompetencedemandedofattorneysincriminalcasesandthat,butforhiscounsel'sdeficientperformance,theresultofhistrialwouldhavebeenϜdifferent.Stricklandv.Washington,466U.S.668,693(1984);Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Theburdenisonthepetitionertoshowthattheevidencepreponderatesagainstthefindingsofthetrialjudge.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978),cert.denied,441U.S.947(1979).Otherwise,thefindingsoffactbythetrialcourtareconclusiveonappeal.Gravesv.State,512S.W.2d603,604(Tenn.Crim.App.1973).  Generally,awarrantlesssearchisperseunreasonable.Coolidgev.NewHampshire,403U.S.443,450(1971);Statev.Bartram,925S.W.2d227,22930(1996).SeeU.S.Const.Amend.IV.;Tenn.Const.Art.I,7.Theburdenisonthestatetoshowthatthesearchorseizurewasreasonable.Statev.Crabtree,655S.W.2d173,178(Tenn.Crim.App.1983).  Anofficermay,however,makealawfularrestwithoutawarrantwhenafelonyhasbeencommittedandtheofficerhasreasonablecausetobelievethatthepersonarrestedhascommittedthecrime.Wadleyv.State,634S.W.2d658,663(Tenn.Crim.App.1982),perm.toapp.denied;Tenn.CodeAnn.407103(3).Absoluteassuranceofguiltisnotnecessary.Greyv.State,542S.W.2d͜102,104(Tenn.Crim.App.1976).Reasonableorprobablecausehasbeendefinedasthatwhichwouldjustifyareasonablepersontobelievethatasuspectisguiltyofafelony.Davisv.State,453S.W.2d438,440(1970).Meresuspicionisnotenough.Westv.State,221Tenn.178,425S.W.2d602,606(1968).  Here,theofficerswhomadethearresthadanaccuratedescriptionoftheassailant.Thepetitioner,whomatchedthatdescription,wasfoundnearthecrimesceneonlyashortwhileaftertheattack.Whenthepetitionerrefusedtoidentifyhimself,policelookedinhiswalletforidentificationandthenfoundthecreditcard.  In1975,oursupremecourtadoptedthefollowingstandardontheissueofreasonableprobablecauseforarrest:8 8 Indealingwithprobablecause,onedealswithprobabilities.Thesearenottechnical;theyarefactualandpracticalconsiderationsofeverydaylifeonwhichreasonableandprudentmen,notlegaltechnicians,act.Statev.Jefferson,529S.W.2d674,689(Tenn.1975).  Oncetherehasbeenalawfularrest,anofficercanconductasearch.ϜUnitedStatesv.Robinson,414U.S.218(1973);Statev.Banner,685S.W.2d298,30001(Tenn.Crim.App.1984);Statev.McMahan,650S.W.2d383,386(Tenn.Crim.App.1983),perm.toapp.denied.Thetrialcourtdeterminedthatthearrestwaslawful.Ourscopeofreviewislimited.Thetrialjudge'sfindingsoffactareconclusiveonappealunlesstheevidencepreponderatesotherwise.Statev.Tate,615S.W.2d161,162(Tenn.Crim.App.1981),permtoapp.denied.Certainly,theevidencedoesnotpreponderateagainstthetrialcourt'sconclusionthattheofficershadreasonablecause,underourstatutorylanguage,andprobablecause,undereitherthefederalorstateconstitutionallanguage,tomakethearrest.Becauseamotiontosuppresswouldhavebeenunsuccessful,thepetitionerhassufferednoprejudice;thatis,theevidenceofthecreditcardwouldhavebeenadmissibleattrialevenifthemotionhadbeenmade.
