Webeginwithabriefsummaryofthefacts.OnFebruary4,1995,theDefendantwasarrestedwhileloadingshirtsintoatruck.TheseshirtswereidentifiedasstolenandintendedforsaletoRandySparks.OnMay10,1995,theDefendantwasconvictedbyajuryoftheftofpropertywithavalueover$60,000. Priortothearrestandconviction,FBISpecialAgentEllisYounghadreceivedinformationfromaconfidentialsourcethattheDefendantwasplanningtosellstolenshirts.TheDefendantstatedfollowinghisarrestthathehadpurchasedtheshirtsfromThomasPickney,storedtheminplasticbagsatafriendsresidence,andthentooktheshirtstoNashvillewherehesoldsomeofthemtoRandySparksfor$13,000.TheDefendantalsosold$1000inshirtstoStephenTerral,whooperatedstallsintheNashvillefleamarket. FollowingtheNashvillesales,theDefendantarrangeda$60,000saletoMr.Sparks.TheDefendantobtainedaccesstoaministorageunitandtookMr.Sparksandanundercoveragenttotheunittoloadtheshirts.TheDefendantwasarrestedintheprocessofthisexchange. WefirstnotetheStatesargumentthattheissuesrelatingtothejurychargehavebeenwaived.Wechosetoaddresstheseissuesonthemerits.  ӜI.   Onappeal,theDefendantfirstarguesthattochargethejurywithcriminalresponsibilityfortheconductofanotherwaserror.Therewasevidenceattrialthattheremayhavebeenotherpartiesinvolvedintheoffense.Thisevidencewarrantedtheinstructiononcriminalresponsibility.Thecharge,however,didnotunfairlyaffecttheproceedingsbecausetheDefendantwasconvictedfortheoffenseforwhichhewasindictedbasedonevidenceofhisownactions,nottheactionsofotherparties. TheDefendantalsoassignsaserrorthetrialcourtsfailuretoincludeaninstructionregardingignoranceormistakeoffactpursuanttoTennesseeCodeAnnotatedsection3911502.TheDefendantdidnotpresentsufficientevidenceattrialtowarrantsuchaninstruction.InStatev.McPherson,882S.W.2d365(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1994),thiscourtnotedthat, beforeanaccusedisentitledtoaninstructiononatheoryofdefense,thedefensemustbefairlyraisedbytheevidenceadducedattrial.Id.at374.TheDefendantslawyerdidnotaskanyquestionsattrialthatwouldestablishevidenceregardingtheDefendantsstateofmind.TheDefendantdidnottestifyastohisownstateofmind.Assuch,therewasnotenoughevidencetorenderthefailuretoinstructonignoranceormistakereversibleerror.̛̜  II.   Thetrialcourtdidnoterrbyfailingtochargeentrapment.TheDefendantdidnotprovidenoticeofanentrapmentdefenseasisrequiredunderTennesseeCodeAnnotatedsection3911505.Thedefensewasnotarguedattrial,andthisissuewasnotraisedinthemotionfornewtrial.Undersuchcircumstances,achargeofentrapmentwasnotrequiredandfailuretoincludethechargeisnotreversibleerror.  III.   TheDefendantalsoarguesthattheevidenceisinsufficienttosupporttheverdict.Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,thestandardiswhether,afterreviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307,319(1979).Questionsconcerningthecredibilityofthewitnesses,theweightandvaluetobegiventheevidence,aswellasallfactualissuesraisedbytheevidence,areresolvedbythetrieroffact,notthiscourt.Statev.Pappas,754S.W.2d620,623(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1987).Normaythiscourtreweighorreevaluatetheevidence.Statev.Cabbage,571S.W.2d832,835(Tenn.1978). AjuryverdictapprovedbythetrialjudgeaccreditstheStateswitnessesandresolvesallconflictsinfavoroftheState.Statev.Grace,493S.W.2d474,476(Tenn.1973).Onappeal,theStateisentitledtothestrongestlegitimateviewoftheevidenceandallinferencestherefrom.Cabbage,571S.W.2dat835.Becauseaverdictofguiltremovesthepresumptionofinnocenceandreplacesitwithapresumptionofguilt,theaccusedhastheburdeninthiscourtofillustratingwhytheevidenceisinsufficienttosupporttheverdictreturnedbythetrieroffact.Statev.Tuggle,639S.W.2d913,914(Tenn.1982);Grace,493S.W.2dat476.  Inthiscase,therewassufficientevidencepresentedattrialforthejurytofindtheDefendantguiltyoftheftover$60,000.Attrial,SpecialAgentEllisYoungtestifiedthattheDefendanttoldhimthat whenhegottheshirtsfromMr.Pickney,Pickneytoldhimtobecoolwiththeshirtswhenhestryingtosellthem.Therewasalsotestimonythatduringtheexchangeoftheshirts,theDefendantaskedthebuyersto stayhere,thesepeople,youknow,thepeoplearenervous,theydontwanttoseeyou,theydontwantyoucomingtotheirhouse.ThesestatementsindicatethattheDefendantknewthattheshirtswerestolen.TherewasalsotestimonythattheDefendanttoldabuyerthattheshirtswere hot.TheDefendantdidsellsomeoftheshirtsandwasfoundinpossessionofalargequantityoftheshirtsatthetimeofthearrest.TheDefendantdidnotproduceevidenceattrialtorefuteanyofthestatementsindicatinghisknowledgeofthenatureoftheshirtsandthejurywaswellwithinitsdiscretiontofindthattheDefendantdidintendtosellstolenproperty. ContrarytotheDefendantsarguments,thejurywasproperlyinstructedconcerningcircumstantialevidence.Evenifthecourthadnotinstructedatallregardingcircumstantialevidence,whenthereisbothdirectandcircumstantialevidencetosupportaverdict,afailuretospeciallyinstructoncircumstantialevidenceisnotreversibleerror.Statev.Caldwell,671S.W.2d459,46566Ϝ(Tenn.),cert.denied,469U.S.873(1984).Evenwithoutthecircumstantialevidence,therewasenoughdirectevidencepresentedattrialtojustifythejurysfinding.TheDefendantalsoarguesthatthecourtfailedtoinstructregardingtheterm recentlystolen.Thecourtsinstructionsinthisregardwereadequate,andtherefore,theclaimiswithoutmerit.  IV.   Therewasalsosufficientprooftoestablishthattheshirtswereofavaluegreaterthat$60,000.Attrial,HomerFerrell,thewarehousemanagerforVanϜHeusen,themakeroftheshirts,testifiedthattheshirtswereworth$90,720.ϜTherewastestimonyfromAgentYoungthatabuyerwaswillingtopayaround$60,000foraportionoftheshirts.Thus,thejurycouldhavereasonablyconcludedthatthevalueexceeded$60,000.
