Whenreviewingthedenialofalternativesentencing,anappellatecourtmustconductadenovoreviewofthesentence,withapresumptionthatthedeterminationofthetrialcourtwascorrect.Tenn.CodeAnn.4035401(d)(1990).Inconductingsuchareview,anappellatecourtmustconsidertheevidence,thepresentencereport,thesentencingprinciples,theargumentsofcounsel,thenatureandcharacteroftheoffense,mitigatingandenhancingfactors,anystatementsmadebythedefendant,andthepotentialforrehabilitationortreatment.Statev.Holland,860S.W.2d53,60(Tenn.Crim.App.1993).Thepresumptionofcorrectnessmustbesupportedbyanaffirmativeshowingintherecordthatthetrialcourtconsideredtheapplicablesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Edwards,868S.W.2d682,700(Tenn.Crim.App.1993).Ifthetrialcourtfailstomakethisshowingintherecord,thepresumptionofcorrectnessisinapplicable,Statev.Shelton,854S.W.2d116,123(Tenn.Crim.App.1992),andappellatereviewisdenovo.Statev.Jones,883S.W.2d597,600(Tenn.1994).Thedefendantalwaysbearstheburdenofshowingtheimproprietyofthesentenceimposed.Statev.Gregory,862S.W.2d574,578(Tenn.Crim.App.1993).̀ TheCriminalSentencingReformActof1989,Tenn.CodeAnn.4035101to605(1990&Supp.1995),recognizesthelimitedcapacityofstateprisonsandmandatesthat convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincingfailureofpasteffortsatrehabilitationshallbegivenfirstpriorityregardingsentencinginvolvingincarceration.Id.4035102(5).AdefendantwhodoesnotqualifyassuchandwhoisanespeciallymitigatedorstandardoffenderofaClassC,D,orEfelonyis presumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.Id.4035102(6).Forsuchadefendant,arebuttablepresumptionexiststhatasentenceotherthanincarcerationwouldresultinsuccessfulrehabilitation.Statev.Fletcher,805S.W.2d785,788(Tenn.Crim.App.1991).However,whenpresentedwithsufficientevidencetoovercomethispresumption,atrialcourtmaysentencethedefendanttoconfinement.Statev.Ashby,823S.W.2d166,169(Tenn.1991). TheCriminalSentencingReformActdictatesthatsentencesinvolvingconfinementshouldbebasedonthefollowingconsiderations: (A)Confinementisnecessarytoprotectsocietybyrestrainingadefendant whohasalonghistoryofcriminalconduct; (B)Confinementisnecessarytoavoiddepreciatingtheseriousnessofthe offenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrence tootherslikelytocommitsimilaroffenses;or (C)Measureslessrestrictivethanconfinementhavefrequentlyorrecently beenappliedunsuccessfullytothedefendant.Tenn.CodeAnn.4035103(1)(1990).IndeterminingAppellantssentence,thetrialcourtmadespecificreferencetoeachoftheseconsiderationsandfoundthatthefactsandcircumstancessurroundingAppellantsoffenseswarrantedconfinement.Becausetherecordreflectsthatthetrialcourtproperlyconsideredtheapplicablesentencing X principlesandallrelevantfactsandcircumstances,thesentenceofthetrialcourtbearsapresumptionofcorrectness. Aspreviouslynoted,Appellantisentitledtothepresumptionthatheisafavorablecandidateforalternativesentencingonlyintheabsenceofevidencetothecontrary.TherecordreflectsAppellanthasanextensiverecordofjuveniledelinquencybasedongrandlarceny,possessionofdrugparaphernalia,vandalism,anddisorderlyconduct.Hisjuvenilerecordalsoshowsvariousviolationsofprobationandcommunityplacement.Asanadult,Appellantwasconvictedofninepropertyrelatedoffensesandtwodrugrelatedoffensesoccurringwithinanapproximateeightmonthperiod.SomeoftheseoffenseswerecommittedwhileAppellantwasreleasedonbondfortheothers.  Appellantsrecorddemonstratesa longhistoryofcriminalconduct.SeeTenn.CodeAnn.4035103(1)(A)(1990).GivenAppellantsfailuretosuccessfullyrespondtoprobationandcommunitybasedplacementinthepast,thetrialjudgewasjustifiedinconcludingthatapunishmentlessrestrictivethanconfinementwouldonlyservetogiveAppellanttheopportunitytocontinuehispatternofunlawfulbehavior.SeeId.4035103(1)(C).Therefore,sufficientevidenceexiststoovercomethepresumptionthatAppellantisafavorablecandidateforalternativesentencingandtowarrantconfinement.
