TheappellantfiledhispetitionforpostconvictionreliefonSeptember21,1993.Inhispetition,theappellantonlychallengedhisconvictionforarmedrobberyoftheArbys,requestingthefollowingrelief: 1.Thattheconviction...beoverturned;[and]2.Thecaseberemandedfornewtrial.Asthebasisforrelief,theappellantallegedthatcounselwasineffectiveinnumerousrespects. .   ׀Theappellantalsoallegedprosecutorialmisconduct. ThepostconvictioncourtappointedcounselonJuly12,1994.ThecourtthenconductedapostconvictionhearingonFebruary14,1995.Theappellantandhistrialattorneyweretheonlywitnessescalledtotestifyatthehearing.Forthefirsttime,theappellantcontendedthatcounselwasalsoineffectiveforfailingtosubmittothetrialcourtamotiontoseverthetwochargessetforthintheindictment.Attheconclusionofthehearing,thepostconvictioncourtdismissedtheappellantspetition,findingthatcounselsrepresentationwasnot ineffectiveinanyrespect. /   ׀Onappeal,theappellantonlychallengestrialcounselsfailuretofileamotiontoseverthetworobberycharges.@ ANALYSIS  Initially,wenotethattheappellanthaswaivedtheissueoftrialcounselsfailuretosubmitamotionforseverance.Nowhereintheappellantsbriefisthereareferencetotherecordofthepostconvictionhearing.Tenn.R.App.P.27(a)(6)and(7),(g);Ct.Crim.App.R.10(b). 0   ׀Moreover,theappellantfailstociteanyauthorityinsupportofhisargument.Tenn.R.App.P.27(a)(7);Ct.Crim.App.R.10(b). 1   כNotwithstandingwaiver,weelecttoaddressthemeritsoftheissuepresented. 2    Whenaclaimofineffectiveassistanceofcounselisraised,theappellantbearstheburdenofshowingthathiscounselmadeerrorssoseriousthatcounselwasnotfunctioningasthecounselguaranteedbytheSixthAmendmentofthefederalconstitution,andtheappellantmustdemonstratethatthedeficientrepresentationdeprivedtheappellantofafairtrialwithareliableresult.Stricklandv.Washington,466U.S.668,687,104S.Ct.2052,2064(1984);Butlerv.State,789S.W.2d898,899(Tenn.1990).Withrespecttodeficientperformance,thecourtmustdecidewhetherornotcounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).TosatisfytheprejudiceprongoftheStricklandtest,thepetitionermustshowareasonableprobabilitythat,butforcounselsineffectiveperformance,theresultoftheproceedingwouldhavebeendifferent.Strickland,466U.S.at694,104S.Ct.at2068.Thisreasonableprobabilitymustbe sufficienttoundermineconfidenceintheoutcome.Id.SeealsoHarrisv.State,875S.W.2d662,665(Tenn.1994). First,thereisnoproofintherecordthattrialcounseldidnotfileamotiontosevertheoffenses. 3   ׀Second,thepostconvictioncourtconcluded thatamotiontoseverwouldnothavebeengrantedand,therefore,trialdefensecounselsfailuretomakeonewasirrelevant. Thefactualfindingsofthepostconvictioncourtareconclusiveonappealunlesstheevidencepreponderatesagainstthosefindings.Butler,789SW.2dat899.Thiscourtcannotreweighorreevaluatetheevidenceorsubstituteitsinferenceforthosedrawnbythepostconvictioncourt.Taylorv.State,875S.W.2d684,686(Tenn.Crim.App.1993),perm.toappealdenied,(Tenn.1994)(citingBlackv.State,794S.W.2d752,755(Tenn.Crim.App.1990)).Onappeal,thepetitionerhastheburdenofdemonstratingwhytheevidencecontainedintherecordpreponderatesagainstthejudgmententeredbythepostconvictioncourt.Id.Therecordisdevoidofanyevidencethatwouldcontradictthefindingsofthecourt.Theindictmentsarenotincludedintherecord,and,therefore,weareunabletodeterminethedateordatesonwhichtheseoffenseswerecommitted.SeeTenn.R.App.P.24(b).Moreover,therecordissilentconcerningtheissuesofwhethertheoffenseswerepartofacommonschemeorplanandwhethertheevidenceofoneoffensewouldhavebeenadmissibleatthetrialoftheother.SeeTenn.R.Crim.P.14(b)(1).Theappellanthasfailedtomeethisburden.
