àThe€petitioner€complains€that€his€counsel€wasÏineffective€for,€among€other€things,€having€failed€to€conduct€anÏadequate€investigation€and€"coerc[ing]"€the€defendant€to€agreeÍto€a€sentence€greater€than€the€statutory€range.€€òòSeeóó€Tenn.€CodeÏAnn.€ðð€39„13„401;€Tenn.€Code€Ann.€ðð€40„35„112(a)(3).€€TheÏpetitioner€testified€that€he€had€never€been€convicted€of€a€crimeÏprior€to€this€incident.€€He€stated€that€he€entered€his€pleaÏafter€talking€with€counsel€only€because€he€feared€a€possibleÏlife€sentence€if€he€demanded€a€trial€and€was€concerned€about€theÏpossible€effect€of€recent€charges€made€against€him€in€Illinois.€ÏThe€petitioner€contends€that€his€trial€counsel€failed€to€explainÏthe€differences€in€sentencing€ranges€and€had€failed€to€adviseÏhim€that€a€Range€I€robbery€required€a€term€of€between€three€andÏsix€years.€€€òòÌÌà àà àóóTrial€counsel€testified€that€the€petitioner's€previousÏcriminal€record€might€have€called€for€a€higher€sentence€withinÏthe€range€and€included€the€possibility€of€consecutiveÏsentencing.€€He€stated€that€the€petitioner€had€been€advised€ofÏan€offer€for€a€twelve„year,€Range€I€sentence€and€that€theÏpetitioner€had€authorized€a€counter€offer€which€included€aÏdismissal€of€the€especially€aggravated€robbery€and€a€Range€I,Ïten„year€sentence€on€the€other€three€offenses.€€Trial€counselÏasserted€that€he€was€unaware€that€the€petitioner€had€received€aÏten„year€sentence€for€each€conviction,€as€opposed€to€anÍaggregate€ten„year€term,€until€the€filing€of€the€post„convictionÏpetition.€€He€believed€that€the€petitioner€had€received€a€totalÏof€ten€years€at€30%€for€the€three€convictions€even€though€noneÏof€the€sentences€were€to€be€served€consecutively.€€He€testifiedÏthat€he€thought€the€error€could€have€been€corrected€by€amendingÏthe€judgment€form.Ì€€€Ìà àà àThe€assistant€district€attorney€general,€James€W.ÏThompson,€agreed€at€the€post„conviction€hearing€that€theÏoriginal€plea€agreement€was€for€an€aggregate€ten„year€sentenceÏfor€all€three€robberies.€€The€plea€agreement€provided€that€theÏdefendant€receive€a€sentence€of€œ"ten›€years€at€œ30%"›€for€all€threeÏrobbery€offenses€and€that€the€especially€aggravated€robbery€beÏdismissed.€€Thompson€stated€at€the€evidentiary€hearing€that€theÏstateððs€intent€was€œ"to›€give€him€10€years€on€œeverything"›€andÏconceded€that€the€judgment€reflecting€a€ten„year€sentence€forÏeach€conviction€was€œ"outside›€the€range€.€.€.€and€œviolate[d›]€theÏœstatute."›€€He€suggested€that€the€judgment€be€amended€for€twoÏthree„year€sentences€and€one€four„year€sentence,€eachÏconsecutive€to€the€other.ÌÌà àà àAt€the€conclusion€of€the€hearing,€the€trial€courtÍruled€that€the€petitioner€had€not€been€denied€the€effectiveÏassistance€of€counsel€and€complimented€trial€counsel€for€œ"an›Ïexcellent€job€œrepresenting"›€the€petitioner.€€The€court€held€thatÏthe€judgments€which€reflected€concurrent€sentences€of€ten€yearsÏfor€each€robbery€conviction€were€proper€and€any€mistake€wasÏmerely€a€technical€error.€€In€dismissing€the€petition,€the€trialÏcourt€ruled€in€part,€as€follows:ÌÓÓœà8 àà8 à6.›€€The€defendant/Petitioner€entered€a€pleaÏagreement€with€the€State€for€[an]€effectiveœ× ƒ: ××  ×›Ïsentence€of€10€years.ÌÌœà8 àà8 à7.›€€The€judgment€prepared€by€the€StatesððÏattorney€is€so€filled€out€as€to€be€inÏviolation€of€the€sentencing€guidelines.ÌÌœà8 àà8 à8.›€€The€error€in€the€judgment€isÏministerial€and€has€no€bearing€or€effect€onÏthe€validity€of€the€defendant[ðð]s€plea€norÏdoes€it€affect€the€10€year€sentence€toÏwhich€the€defendant/petitioner€agreed€toÏserve.ÌÌà8 àà8 à9.€€Post„Conviction€is€not€the€properÏavenue€to€address€the€issue€of€an€incorrectÏ[judgment].ÌÌà8 àà8 à10.€€Any€errors€in€filling€out€theÏjudgments€are€not€attributed€to€trialÏcounsel€and€cannot€be€cured€by€Post„Conviction€[r]elief.ÓÓÌThe€trial€court€determined€that€trial€counsel€had€not€beenÍineffective€by€suggesting€a€plea€agreement€of€a€sentence€of€tenÏyears€with€a€release€eligibility€date€at€30%€for€three€robberyÏoffenses.€€It€is€implicit€in€the€ruling€that€the€trial€courtÏfound€nothing€illegal€about€the€sentence.€€òòÌóóÌà àà àBased€upon€the€greater€weight€of€the€authoritiesÏavailable,€we€are€constrained€to€set€aside€this€sentence€asÏillegal€and€remand€the€cause€to€the€trial€court.€€Because€theÏsentence€proposed€in€the€plea€agreement€can€be€interpreted€asÏexceeding€the€statutory€limits,€the€trial€court€must€reject€theÏoriginal,€recommended€sentence.€€Thereafter,€the€proceedingsÏshall€be€governed€by€Tenn.€R.€Crim.€P.€11(e).€€òòSeeóó€òòState€v.ÏHodgesóó,€815€S.W.2d€151€(Tenn.€1991).€€ÌÌà àNext,€the€petitioner€contends€that€he€did€notÏknowingly€and€voluntarily€enter€his€pleas€of€guilt.€€He€does€notÏcontend€that€the€trial€court€failed€to€follow€the€requiredÏprocedure.€€Instead,€he€asserts€that€he€did€not€understand€theÏdifferences€between€the€sentencing€ranges€and€that€he€did€not,Ïtherefore,€voluntarily€and€knowingly€enter€his€plea.€€€à àà àÌà àà àIn€òòBoykin€v.€Alabamaóó,€395€U.S.€238€(1969),€the€UnitedÏStates€Supreme€Court€ruled€that€defendants€should€be€advised€ofÏcertain€of€their€constitutional€rights€before€entering€pleas€ofÍguilt.€€Included€among€those€required€warnings€are€the€rightÏagainst€self„incrimination,€the€right€to€confront€witnesses,€andÏthe€right€to€a€trial€by€jury.€€òòIdóó.€at€243.€€The€overridingÏòòBoykinóó€requirement€is€that€the€guilty€plea€must€be€knowingly€andÏvoluntarily€made.€€òòIdóó.€at€242„44.€€In€òòState€v.€Mackeyóó,€553ÏS.W.2d€337€(Tenn.€1977),€our€supreme€court€established€aÏprocedure€for€trial€courts€to€follow€in€accepting€guilty€pleas.€€ÌÌà
