Atthesentencinghearing,theappellant'sproofconsistedofthefollowing:hewas20yearsold,employed,hadnopriorcriminalrecord,andwaswillingtopayrestitution.Baseduponthesecircumstances,herequestedcommunitycorrectionsorprobation.Thestateopposedtheappellant'srequestbaseduponthefollowingconsiderations:(1)theappellantwasinvolvedinthreeseparatecrimesoccurringoveraperiodoftime;(2)theappellanthadusedknowledgehegainedasaShoney'semployeetosteal$1,400.00fromtheShoney'ssafe;(3)theappellanthadtaken34,000baseballandbasketballcardsfromMartha'sAntiques;(4)theappellanthadtakenapproximately$770.00initemsfromS&SAuto;and(5)theappellantstillowedapproximately$400.00inrestitutiontoDollarAmusement. Thetrialcourtfoundthattheappellantwasapropercandidateforalternativesentencing.However,thecourtalsofoundthattheappellanthadcommittedthreeseparateanddistinctoffensesoccurringoveraperiodoftime.ϜThecourtconveyedparticularconcernintheappellant's"disloyalty"demonstratedbyusingknowledge,gainedasanemployee,toburglarizehisemployer.Thetrialcourtconcludedthatintheinterestofbothjusticeandsocietyandforthesakeofdeterrence,theappellantshouldserve90dayscontinuousincarceration.Thebalanceofhissentencewillbeservedonsupervisedprobation. Whenasentencingissueisappealed,thisCourtshallconductadenovoreviewwiththepresumptionthatthetrialcourt'sfindingsarecorrect.Tenn.CodeAnn.4035401(d)(1990);Statev.Byrd,861S.W.2d377,379(Tenn.Crim.App.1993).Thepresumptionofcorrectnessisconditioneduponanaffirmativeshowing,intherecord,thatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofadefendant'ssentence,includingthemannerinwhichheorsheistoservethesentence,thisCourtmustconsider:(1)theevidencereceivedatthetrialandthesentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandargumentstosentencingalternatives,(4)thenatureandcharacteristicsofthecriminalconduct,(5)anymitigatingand  enhancementfactors,(6)anystatementsmadebythedefendantinhisorherownbehalf,and(7)thedefendant'spotentialforrehabilitationortreatment.Tenn.CodeAnn.4035210&103(1990).Amongthefactorsapplicabletotheprobationdeterminationarethecircumstancesoftheoffense,thedefendant'scriminalrecord,socialhistory,presentcondition,thedeterrenteffectuponthedefendant,andthebestinterestofthedefendantandthepublic.Statev.Grear,568S.W.2d285(Tenn.1978). SentencesinvolvingconfinementaretobebasedonthefollowingconsiderationscontainedinTenn.CodeAnn.4035103(1)(1990):8  (A)8 Confinementisnecessarytoprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct;8  (B)8 Confinementisnecessarytoavoiddepreciatingtheseriousnessoftheoffenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses;or8  (C)̛8 Measureslessrestrictivethanconfinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothedefendant....Ascanbegleanedfromtherecord,(A)and(C)arenotimplicated.Therefore,whetherornotappellantshouldbedeniedprobationwillbedecidedunderTenn.CodeAnn.4035103(1)(B)(1990). ` X- XTherecordreflectsthatthetrialcourtfollowedthesentencingprinciplesandimposedalawfulsentence.Inrejectingappellant'srequestforcommunitycorrectionsorfullprobation,thetrialcourtemphasized:(1)thenatureandnumberoftheappellant'soffenses,(2)theneedfordeterrence,and(3)theneedtoprotecttheinterestofsociety.Wewillnotdisturbatrialcourt'ssentencewhenstatutoryprocedureisfollowedandthecourt'sfindingsaresupportedbytherecord. `  pӜ  __________________________________  PAULG.SUMMERS,JudgeCONCUR:_______________________________JOSEPHM.TIPTON,Judge_______________________________JERRYL.SMITH,Judge
