Ӏ BACKGROUND  P #X.XXX.ǘ#X.XXX. OnApril4,1996,KevinEzzellobservedthedefendantquarrelingwith (x FatimaMattox,thedefendantsformergirlfriend,inaparkinglotnearEzzellsworkplace.Ezzellintervened,andthe_defendantpulledahandgunfromhispocketandpointeditatEzzell.Whenthedefendantlookedawayforamoment,Ezzellpunchedhiminthefaceandtriedtosubduehim.ThedefendantwrestledfreeandfiredseveralshotsatEzzell.HethenforcedMattoxintohiscarandfledtheparkinglot. Ezzellfollowedinhisowncar,attemptingtogetthedefendantslicenseplatenumber.__Duringthechase,thedefendantreloadedandfiredseveralmoreshotsatEzzell.EzzelltestifiedthatthedefendantalsopointedthegunatMattoxandthatsherepeatedlyopenedthepassengersidedoorofthedefendantsmovingvehicleinapparentattemptstoescape.Policeofficersultimatelyjoinedthepursuitandapprehendedthedefendantwhenheturnedontoadeadendstreet. Mylearnedcolleagueswouldholdthatthetrialcourtcorrectlyappliedenhancementfactor(16)tothefactsofthiscaseconsistentwiththeholdingofStatev.Sims,909S.W.2d46(Tenn.Crim.App.1995).Simsholdsthatboth  \ factors(10)and(16)maybeappliedinsituationswhereindividualsotherthanthevictimareintheareaandaresubjecttoinjury.Seeid.at50.I,ontheother  hand,woulddifferandholdthatthetrialcourtincorrectlyappliedenhancementfactor(16)tothefactsofthiscaseconsistentwiththeholdingsofStatev. <#" Bingham,910S.W.2d448(Tenn.Crim.App.1995).Binghamholdsthat %X $ enhancementfactor(16)maynotbeappliedtoaconvictionforvehicularhomicidebyrecklessness.Seeid.]ca]ct452;s^cee^c_c_c`calso`cacacbcStatev.CharlesJustin (#( Osbornebccc,No.01C019806CC00246(Tenn.Crim.App.ccdcccfccdcdcFdceciled,May12,1999,at l*%* Nashville).ecbcacacbc`c_c_c`c^cXcXc^cIamintheminorityonthispanelwhenIconcludethatfactor(16)isinapplicabletothedefendantsconvictionsbasedonrisktopersonsotherthanavictimoftheconvictedoffenses.Thisconclusionnotwithstanding,Iwouldnotrequirealterationofthedefendantssentences.  Forthesereasons,thispanelconcludesthatthetrialcourtsapplicationofenhancementfactor(9)waserroneousastothedefendantsrecklessendangermentconviction.Amajorityofthispanelconcludesthatenhancement 84: factors(10)and(16)areproperlyappliedtobothoffenses.Theseconclusions,however,donotrequirealterationofthedefendantssentences.Fiveenhancementfactorsremainontheattemptcountandfourenhancementfactorsremainontherecklessendangermentcount.Thetrialcourtdidnotindicatetheweightaccordedtothevarioussentencingfactors.Thispanelfindsthatenhancementfactors(1),(8)fc,fcand(10)areeachentitledtosignificantweightonthefactsofthiscasemorethansufficienttowarrantmaximumsentencesonbothcounts.Incontrast,themitigatingfactorsallowedbythetrialcourtareslight.Theimposedsentencesareappropriate.#X\XXX\ī0#X\XXX\ Finally,theappellant_asserts___that,consideringhispresentencejailcredit,#X\XXX\ı=#X\XXX\  theimposedperiodofconfinementwasgreaterthatoneyearand,therefore,violativeofTennesseeCodeAnnotated4035306(a)#X\XXX\č>#X\XXX\.Duetounusualdelays, @ thedefendanthadservedfourhundredandthirtytwodaysconfinementandwasreleasedpriortosentencing.Athissentencinghearing,thetrialcourtorderedthatthedefendantserveanadditionalsixmonthsdayfordayconfinement.____________________________________________Thus,thedefendantseffectiveperiodofconfinementwasapproximatelytwentyonemonths,allofwhichthedefendantcompletedpriortothisappeal.#X\XXX\g?#X\XXX\Because <#" thedefendanthasservedhisentireperiodofconfinementandthereexistsnoremedyfortheallegederror,wefindthisissuemoot.#X\XXX\D#X\XXX\  CONCLUSION  l*%* "E#X\XXX\E#_ ThejudgmentofthetrialcourtisAFFIRMED. 8,', Ѐ̀   @ Q@|| D̀______________________________F*F   @ Q@ DJOHNEVERETTWILLIAMS,JudgeF 84: ЇCONCUR:_______________________________DAVIDH.WELLES,JudgeQDD/D    QDD/D_______________________________JOEG.RILEY,Judge!G
